Book excerpt: Responde este Compendio al reto planteado por la extraordinaria y drástica reducción de períodos lectivos generada, en la mayor parte de las Universidades europeas, por el denominado proceso de Bolonia. En efecto, respecto de la propiedad privada y los derechos reales puede afirmarse en términos aproximativos que la reducción ha sido especialmente intensa, sustituyendo una asignatura de carácter anual por una semestral o cuatrimestral, en la generalidad de los centros universitarios. En consecuencia, el presente Compendio de derechos reales ofrece una visión sucinta, aunque cuidada y especialmente analítica, de los problemas fundamentales de la propiedad privada y de la transmisión y generación de derechos reales limitados incidentes sobre los diversos tipos de bienes objeto de apropiación humana, afrontando así las nuevas y contingentes circunstancias universitarias. En suma, aborda este Compendio la propiedad privada; la posesión; los diversos derechos reales limitados, de goce, de garantía y de adquisición preferente; y, finalmente, el sistema hipotecario español. El conjunto de tales materias ha sido, además, sometido a una especial reordenación sistemática, que acentúa los perfiles propedéuticos en relación con exposiciones más amplias, como la propia del Profesor Lasarte, en los dos tomos, cuarto y quinto, de sus conocidos y acreditados Principios de Derecho civil. La edición, totalmente revisada, ha sido actualizada conforme a las siguientes disposiciones legislativas: el Real Decreto Legislativo 6/2015 (texto refundido de la Ley sobre Tráfico, Circulación de Vehículos a Motor y Seguridad Vial); el texto refundido de la Ley del Suelo y rehabilitación urbana, aprobado por Real Decreto Legislativo 7/2015, de 30 de octubre, y, finalmente, la Ley 42/2015, de 5 de octubre, de reforma de la Ley de Enjuiciamiento Civil; todas ellas disposiciones normativas de general repercusión e incidencia en el conjunto de las materias tratadas en este libro. Ha sido tenido en cuenta también la Resolución-Circular de la DGRN de 3 de noviembre de 2015, en cuanto establece el código registral único de las fincas inscritas y la representación georreferenciada a partir del 1 de noviembre de 2015. En relación con la jurisprudencia, se incorporan por primera vez a esta quinta edición, entre otras, la STC 93/2015 (sobre la Ley andaluza 1/2010, de vivienda) y las SSTS-1{487} 132/2015 (acción de deslinde); 265 y 705/2015 (cláusulas abusivas); 700/2015 (uso por períodos sucesivos por los comuneros); 768/2015 (adjudicación de inmueble en subasta en relación con el enriquecimiento injusto); 79/2016 (intereses moratorios); 82/2016 (enriquecimiento injusto en caso de accesión); 85/2016 (servidumbre por destino) y 217/2016 (inexistencia de retracto de comuneros).

Tampoco una exposición doctrinaria de las locuciones plasmadas, sólo se busca mostrar sencillamente, algunas locuciones y vocablos visualizados en diversos textos, cuyos autores se exponen en la bibliografía, haciendo con mucho respeto hacia ellos. De inicio se muestra un capítulo de "introducción", con lo que se busca explicar la importancia del contenido, se detalla una "breve historia romana" alusiva a los "orígenes de la península italiana", los "pueblos que conformaron la península itálica", sobre todo los pueblos que se establecieron en la región del Lazio, (centro-sur de Italia), los etruscos, (norte-centro de Italia) y los colonizadores griegos que se establecieron en el sur de Italia, todos ellos contribuyeron al crecimiento de Roma a partir de su fundación en el siglo VIII a.C. La obra de "Rómulo y Remo", "La Monarquía", "La República, "El Imperio" (sus emperadores y su ocaso); cómo surge el "Derecho Romano", y "el uso del latín en el derecho". Con la explicación breve en cada una de las locuciones y vocablos, (de las de mayor importancia), se busca explicar el sentido de las mismas, es decir, lo que pensaron y quisieron decirnos los antiguos jurisconsultos romanos. De manera general, se muestra brevemente la historia romana, la conformación del Derecho y las locuciones con una breve explicación.
