Book Collective Security Under International Law

Download or read book Collective Security Under International Law written by Hans Kelsen and published by The Lawbook Exchange, Ltd.. This book was released on 2001 with total page 284 pages. Available in PDF, EPUB and Kindle. Book excerpt: Washington, D.C.: United States Government Printing Office, 1957. vi, 275 pp. Reprinted 2001, 2011. The noted jurist Hans Kelsen advances his theory that collective security is "...an essential function of law, national as well as international, and that, therefore, there exists an intrinsic connection between international security and international law; in other terms, that collective security of the state is, just as collective security of the individual within the state, by its very nature a legal problem." Foreword p. ii. "Professor Kelsen's high standing as a scholar is sufficient to commend in advance any volume that comes from his pen. But in this case he has chosen a subject that will at once challenge attention. The main function of the volume, in the words of the author, 'is to show that collective security is an essential function of law,' that it is 'by its very nature a legal problem.' A generation ago there were many in high places to contest the thesis. Today the bitter lesson of two world wars has established the principle for practical purposes, in spite of the difficulty of putting it into practice. But the legal aspects of the thesis remain to be clarified, and this is what Professor Kelsen does with all his power of legal analysis and systematic presentation. (...) [We] must be grateful for what we are given, an acute analysis of a fundamental principle, the applications of which we can make from our own knowledge of recent history." --C. G. Fenwick, American Journal of International Law 52 (1958) 811.

Book The Arms Trade and International Law

Download or read book The Arms Trade and International Law written by Zeray Yihdego and published by Bloomsbury Publishing. This book was released on 2007-11-16 with total page 380 pages. Available in PDF, EPUB and Kindle. Book excerpt: Shortlisted for the 2008 Young Authors Inner Temple Book Prize There are believed to be about 700 million small arms and light weapons (SALW) in the world, often contributing to highly destabilising security and other concerns in international law. SALW are the primary source of violations and abuses of humanitarian and human rights principles by states, rebels, terrorists and criminals. Many consider them the real weapons of mass destruction of our time, causing about half a million deaths annually. The unrestricted international transfer of SALW by states (99 states and 1000 companies involved in manufacturing and supply) is one of the major contributory and aggravating factors of this crisis; another is the illicit traffic in small arms. This book deals with the proliferation of SALW and their unregulated trade and transfer across borders. It addresses questions of definition, manufacturing, trade/transfer, and issues relating to state responsibility. The primary focus is on conventional small arms, in particular military-style weapons. The book tackles the core and most divisive legal problem of whether or not the laws relating to arms control and relevant norms of international law provide substantive restrictions upon the transfer of small arms by states. The application of the norms of international peace and security, non-intervention, humanitarian and human rights laws, and evolved relevant customary rules of arms control relating to these norms are considered particularly carefully. Questions of application and enforcement of relevant rules and institutional responses to the problem are also examined. The UN began considering an arms trade treaty in 2006; the publication of the book at this critical moment in time will make a positive contribution towards shaping the debate and aims to further enhance understanding in an area where close analysis is required.

Book The Foundations of Modern Arms Control

Download or read book The Foundations of Modern Arms Control written by Robert M. Blum and published by Taylor & Francis. This book was released on 2024-04-30 with total page 249 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book is an international history of the foundation of modern arms control, highlighting the fact that the instrument is varied, resilient, successful, and enduring. The narrative begins after the Napoleonic wars when newly arisen peace movements focused on arbitration as a path to “ending the war system.” It moves on to the international community’s embrace of “total and complete disarmament” and then to its acceptance of more limited measures by 1968, including the agreements that remain in force today. The book connects the past to the present of multiple negotiations, successful and failed, and underlines how the peace movement increasingly influenced the national policy of the major Western powers, especially the United States. It also highlights the increasing diversification of arms control players, including women and people of color as well as the countries they represented. Based on original research in multinational records and the latest scholarship, the book illustrates the reasons multilateral arms control remains a key instrument of international relations. The chapters are organized both chronologically and thematically, with the result that they cover different amounts of time in order to encompass a given issue and to capture the development of particular threads. The main narrative evolves into a decadeslong quest for a global treaty on “general and complete disarmament,” which otherwise paces the book and shapes its chapters. This book will be of much interest to students of arms control, global governance, peace studies, and International Relations.

Available in PDF, EPUB and Kindle. Book excerpt: This book addresses one of the least understood issues in modern international history: how, between 1930 and 1945, Britain lost its global pre-eminence to the United States. The crucial years are 1930 to 1940, for which until now no comprehensive examination of Anglo-American relations exists. Transition of Power analyses these relations in the pivotal decade, with an epilogue dealing with the Second World War after 1941. Britain and the United States, and their intertwined fates, were fundamental to the course of international history in these years. Professor McKercher's book dissects the various strands of the two powers' relationship in the fifteen years after 1930 from a British perspective - economic, diplomatic, naval and strategic.
