This book was released on 2017-11-27 with total page 362 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Commentaries on the Written Laws and Their Interpretation While this book is written to be consulted, it is meant also to be read. There is no other legal subject whereon a book which shall be read is so much needed. And the one here presented is of dimensions so small - the mas tery of its contents is so completely within the hours avail able to the busiest practitioner or judge - that I venture the hope of finding for it readers of these classes. To the younger practitioner, and to the student, it, if found wor thy, will, let me add the further hope, make plainer and smoother a path trodden every day by every person whose avocations are legal. It may be cited by its title, or, if preferred, by the name of the larger volume whereof it constitutes a part. Book Commentaries on the Law of Statutory Crimes

Download or read book Commentaries on the Law of Statutory Crimes written by Joel Prentiss Bishop and published by Forgotten Books. This book was released on 2017-11-30 with total page 1016 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Commentaries on the Law of Statutory Crimes: Including the Written Laws and Their Interpretation in General, What Is Special to the Criminal Law, and the Specific Statutory Offenses as to Both Law and Procedure The volume here presented, supplementing the two vol umes entitled Criminal Law, and the two on the law of Pleading and Evidence and the Practice in Criminal Cases, called, for short, Criminal Procedure, completes a series ccv ering the whole field of American criminal law, criminal evi dence, criminal pleading, and criminal practice, both at the common law and under the statutes. In the construction of the series, and in the printing of the successive editions, there have been some changes of matter from one work to another, all duly pointed out when they occurred. As the volumes stand in the later editions, the four which precede this, while mingling in their explanations the written law with the nu written, are silent on the questions discussed in this volume. These are an exposition of the general principles of statutory interpretation, which, since they are in the main the same in criminal cases and in civil, extends necessarily into the civil department; elucidations of the principles of interpretation special to the criminal law, with their specific applications; such topics as the statute of limitations in criminal causes, pleadings upon private statutes and municipal by-laws, and some others of the like kind; and, finally, discussions of the offenses which are purely or in substance statutory, in distino tion from more statutory extensions of common-law crimes. As to the last-named particular, Book V, entitled Statutory Extensions of Common-law Offenses, might seem to occupy an exceptional position. But the statutes discussed in it are such as, while analogous to some common-law inhibitions. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from Commentaries on the Law in Shakespeare: With Explanations of the Legal Terms Used in the Plays, Poems and Sonnets, and Discussions of the Criminal Types Presented Referring to the current criticism of his Author, we find that Dr. Samuel Johnson, in his preface to his edition of the plays, published in 1768, said: His adherence to general nature, has exposed him to the censure of critics, who form their judgments upon narrower principles. Dennis and Rymer think his Romans not sufficiently Rom an; and Voltaire censures his kings as not completely royal.8 This distinguished Editor and Commentator thus feels called upon to apologize for the Poet, with the explanation that Shakespeare always makes nature pre dominate over accident.' Book excerpt: Excerpt from The Law of Faith: With a Lawyer's Notes on the Written Law The relation of Faith to Faithfulness and the coupling of the one with the other strikes with emphasis the strong ethical note, sometimes lack ing in the treatment of this subject. The seeking and finding of both faith and faithfulness in the nature and character of God whence they come to men and women who are created in His image, will challenge attention and carry conviction. The excellent and well chosen title of the book, The Law of Faith, sets forth admirably what is fundamental in the thought of the author and the Biblical conception and treatment of this subject. Book Principles and Practice of American Politics

Download or read book Principles and Practice of American Politics written by Samuel Kernell and published by CQ Press. This book was released on 2018-04-17 with total page 449 pages. Available in PDF, EPUB and Kindle. Book excerpt: Combining timeless readings with cutting-edge articles and essays, Principles and Practice of American Politics, Seventh Edition, enriches your understanding of the American political system by examining the strategic behavior of key players in U.S. politics. This collection of classic and contemporary readings brings concepts to life by providing you with real examples of how political actors are influenced by the strategies of others and are governed by the Constitution, the law, and institutional rules. Carefully edited by award-winning authors Samuel Kernell and Steven S. Smith, each reading is put into context to help you understand how political actions fall within a major national political forum. New to the Seventh Edition Nine new and updated essays encourage you to reflect on the continuing debates over the polarization of the American electorate and Congress, the role of social media and “fake news” in influencing public views of politicians and issues, the fragile Trump coalition, the efficacy of polling in tracking public opinion, and other issues more relevant than ever in the wake of the 2016 elections. Additional essays challenge you to think more carefully about alternative institutions and political arrangements. The new essays present institutions of majority rule, the nature of racial discrimination, and the proper role of the court as less settled issues that provide students an opportunity to think through (and discuss) their views on the future direction of American civic life. Each selection is artfully framed by Kernell and Smith’s contextual headnotes to make them appropriate for classroom use. Original readings written specifically for the volume give the book a coherent treatment of the performance of U.S. political institutions.

Book The Oxford Edition of Blackstone s Commentaries on the Laws of England

Download or read book The Oxford Edition of Blackstone s Commentaries on the Laws of England written by William Blackstone and published by Oxford University Press. This book was released on 2016-08-04 with total page 450 pages. Available in PDF, EPUB and Kindle. Book excerpt: Oxford's variorum edition of William Blackstone's seminal treatise on the common law of England and Wales offers the definitive account of the Commentaries' development in a modern format. For the first time it is possible to trace the evolution of English law and Blackstone's thought through the eight editions of Blackstone's lifetime, and the authorial corrections of the posthumous ninth edition. Introductions by the general editor and the volume editors set the Commentaries in their historical context, examining Blackstone's distinctive view of the common law, and editorial notes throughout the four volumes assist the modern reader in understanding this key text in the Anglo-American common law tradition. Property law is the subject of Book II, the second and longest volume of Blackstone's Commentaries. His lucid exposition covers feudalism and its history, real estate and the forms of tenure that a land-owner may have, and personal property, including the new kinds of intangible property that were developing in Blackstone's era, such as negotiable instruments and intellectual property.

INTRODUCTORY ESSAY CIVIL SOCIETY AND GOVERNMENT. The design of this introductory essay is to inquire into the origin and foundation of civil society and government; to unfold the nature, sources, and sanctions of political power; and to establish some general principles of polity, law, and administration. Next in importance to the science of religion, which teaches our relations to the Creator, and the science of morality, which explains our relations to our fellow men, is the science of government, which unfolds our relations and duties as members of civil society. There is, indeed, a beautiful alliance between theology, ethics, and jurisprudence. These sciences have a common origin, a common basis, and a common end.* The science of legislation, in effect, embraces our relations to God, to individual man, and to society. It includes within itself the most important principles of religion, morality, and law. No subject can more worthily engage the attention of a rational being; a being who has the happiness of himself and his species at heart. *Translator's Pref. to Burlamaqui's Principles of Natural and Politic Taw. The true origin of civil government and its ultimate foundation, undoubtedly lie in the will of God. Government is, therefore, a divine institution. Reason, revelation, and the best human authority, concur in enforcing this conclusion. Let us interrogate each of these teachers in turn. What, in the first place, is the testimony of reason, that faculty of the soul, 'whose high office it is to investigate the mutual relations of things, to compare these relations together, and thence to infer just principles for forming our belief, and guiding our conduct? The exact point we are now in search of is, whether it be the will of...
