Book excerpt: Excerpt from Commentaries on the Criminal Law, Vol. 1 Those who have examined the second edition of my work on the law of Criminal Procedure, published a few months ago, will see that I have done for this work what I did for that. I have rearranged the matter throughout, added some new topics, improved many of the old discussions by presenting the doctrines in new lights and new relations, cited the latest cases, pruned away what could be spared of the old to give place to what is better and fresh, and pre fixed in a peculiar type headings to the sections to enable the practitioner rapidly to get at the contents of the book. Book excerpt: Excerpt from New Commentaries on the Criminal Law Upon a New System of Legal Exposition, Vol. 1 of 2: General and Elementary; Complete in Itself Herein we have an illustration of what every lawyer was compelled to learn before he became fit for practice; namely, that he cannot carry the entire body of the law in his memory, yet that he must carry a part of it, and must know where to look for the rest. And, what is the special truth, he must select wisely the part to be carried. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from Commentaries on the Law of Criminal Procedure, or Pleading, Evidence, and Practice in Criminal Cases, Vol. 1 It is the purpose of the author, in future editions of his works connected with the criminal law, to make such improvements and additions as shall render them complete guides, as far as elementary books can be, both to students and to practitioners, in this department of our law. As observed in the Preface to the first edition, these two volumes on Criminal Procedure are not so closely connected with the work on the Criminal Law as to render their separate use inconvenient. Yet in divid ing the larger subject into Law and Procedure, for the two works, I took care that there should be as little repetition as possible in the one, of what was treated of in the other. And as such a division is necessarily artificial to a considerable extent, the result is that readers may sometimes be in doubt into which work to look for a particular thing. For this reason, I have in a few instances referred to the work on the Criminal Law, in the Alphabetical Index to these volumes. Book Commentaries on the Law of Statutory Crimes

Download or read book Commentaries on the Law of Statutory Crimes written by Joel Prentiss Bishop and published by Forgotten Books. This book was released on 2017-11-30 with total page 1016 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Commentaries on the Law of Statutory Crimes: Including the Written Laws and Their Interpretation in General, What Is Special to the Criminal Law, and the Specific Statutory Offenses as to Both Law and Procedure The volume here presented, supplementing the two vol umes entitled Criminal Law, and the two on the law of Pleading and Evidence and the Practice in Criminal Cases, called, for short, Criminal Procedure, completes a series ccv ering the whole field of American criminal law, criminal evi dence, criminal pleading, and criminal practice, both at the common law and under the statutes. In the construction of the series, and in the printing of the successive editions, there have been some changes of matter from one work to another, all duly pointed out when they occurred. As the volumes stand in the later editions, the four which precede this, while mingling in their explanations the written law with the nu written, are silent on the questions discussed in this volume. These are an exposition of the general principles of statutory interpretation, which, since they are in the main the same in criminal cases and in civil, extends necessarily into the civil department; elucidations of the principles of interpretation special to the criminal law, with their specific applications; such topics as the statute of limitations in criminal causes, pleadings upon private statutes and municipal by-laws, and some others of the like kind; and, finally, discussions of the offenses which are purely or in substance statutory, in distino tion from more statutory extensions of common-law crimes. As to the last-named particular, Book V, entitled Statutory Extensions of Common-law Offenses, might seem to occupy an exceptional position. But the statutes discussed in it are such as, while analogous to some common-law inhibitions. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book excerpt: Excerpt from Commentaries on the Written Laws and Their Interpretation While this book is written to be consulted, it is meant also to be read. There is no other legal subject whereon a book which shall be read is so much needed. And the one here presented is of dimensions so small - the mas tery of its contents is so completely within the hours avail able to the busiest practitioner or judge - that I venture the hope of finding for it readers of these classes. To the younger practitioner, and to the student, it, if found wor thy, will, let me add the further hope, make plainer and smoother a path trodden every day by every person whose avocations are legal. It may be cited by its title, or, if preferred, by the name of the larger volume whereof it constitutes a part. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Modern American Law: A Systematic and Comprehensive Commentary on the Fundamental Principles of American Law and Procedure, Accompanied by Leading Illustrative Cases and Legal Forms, With a Revised Edition of Blackstone's Commentaries The attention of citizens generally is being at tracted to a reform of our penal institutions. Some progress in that direction has been made by legisla tion and some by improvements in state institutions. Thus many of our offenders are now treated as pa tients for the surgeon or physician rather than as criminals to be confined in penitentiaries. Public spirited bodies are also investigating the causes of crime and are seeking to find ways and means for its prevention. Success in reducing the number of criminal ofiend ers rests largely upon a reform in the administration of criminal law and criminal procedure as enforced in the courts today. In turn, a knowledge of the basic principles of these branches of the law is the first essential to reform. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Commentaries on the Law in Shakespeare: With Explanations of the Legal Terms Used in the Plays, Poems and Sonnets, and Discussions of the Criminal Types Presented Referring to the current criticism of his Author, we find that Dr. Samuel Johnson, in his preface to his edition of the plays, published in 1768, said: His adherence to general nature, has exposed him to the censure of critics, who form their judgments upon narrower principles. Dennis and Rymer think his Romans not sufficiently Rom an; and Voltaire censures his kings as not completely royal.8 This distinguished Editor and Commentator thus feels called upon to apologize for the Poet, with the explanation that Shakespeare always makes nature pre dominate over accident.'
