Como consecuencia de las distintas Directivas en materia de consumo se ha producido en cierta medida una excesiva producción legislativa que dificulta a los operadores jurídicos su conocimiento y aplicación. A dicha proliferación de leyes y abundante normativa de protección de los consumidores respondió, en su momento, la promulgación del RD-Leg 1/2007, por el que se aprobó el "Texto Refundido de la Ley General para la Defensa de los Consumidores y Usuarios y otras leyes complementarias". Gran parte del contenido del Texto Refundido se debe a la transposición de varias Directivas de la Unión Europea. La dificultad de la revisión constante de las normas de protección del consumidor es evidente y de hecho en los últimos tiempos se han producido varias reformas por la necesidad de transposición de diferentes Directivas. Así mediante RD 7/2021, de 27 de abril, se transponen las Directivas 2019/770 y 2019/771. Y de la misma manera por medio del RD-Ley 24/2021, de 2 de noviembre se transpone la Directiva 2019/2161. La última reforma, esta sí por Ley, ha sido la L. 4/2022, de 25 de febrero, de protección de los consumidores y usuarios frente a situaciones de vulnerabilidad social y económica.Con esta obra se pretende que, si bien dentro de la dificultad, se recojan las cuestiones fundamentales, artículo por artículo, del Texto Refundido. Además, se espera conseguir que el operador jurídico, al abordar una materia concreta, encuentre el estado actual de la doctrina y la jurisprudencia, tanto del Tribunal Supremo como del Tribunal de Justicia de la Unión Europea, y a la par donde acudir a las obras de referencia.

Book excerpt: Thirty years after the entry into force of the Directive on liability for defective products (Council Directive 85/374/EEC), and in the light of the threat to user safety posed by consumer goods that make use of new technologies, it is essential to assess and determine whether the Directive remains an adequate legal response to the phenomenon of products brought to market that fail to ensure appropriate levels of safety for their users. This book is the result of an extensive international research project funded by the Polish National Science Centre. Individual country reports analyze the implementation of the Directive in the domestic law of several EU and EEA Member States (namely Austria, Czech Republic, Denmark, England, France, Germany, Italy, Netherlands, Norway, Poland, Spain, and Switzerland) and the relationship of the implemented rules with the already existing rules of tort law. The country reports show that the practical significance of product liability differs widely in the various Member States. The analysis is based on more than 720 cases from more than 20 countries, in addition to the OECD and UN model treaties and more than 630 books, articles, and official documents. The increased significance of the digital economy has rendered the traditional concept of PE inadequate for the allocation of taxing jurisdiction over the modern, mobile or digital international business. The author’s in-depth analysis explains the legal elements of the PE principle with attention to their continuing benefit and their shortcomings: criteria defining a PE- place of business, location, right of use, duration, business connection, business activity, ordinary course of business; evidence of a right of use to a place of business; business activities included in the PE concept of the tax treaties; identification of projects offshore and onshore; UN model treaty deviations from the OECD agency clause; distinction between jurisdictions with significant natural resources and countries possessing the capital, technology and know-how necessary to explore and exploit these resources; and how policies in each country may erode the PE concept. The book provides many synopses of court decisions and administrative rulings upon which the analysis is based. In addition to cases previously published in law reports and other publications, a number of unpublished decisions are included. A key word index makes it easy to find what is needed in any particular matter. The PE principle, in one version or another, is used in several thousand tax treaties in force today. Turning Houses into Homes not only maps the history, changes, development and structure of the retail furnishing industry in Britain over three centuries, but also examines the relationships between the retailer and the consumer, looking at how retailers helped stimulate and shape the demand of their customers. Whilst work has been done on specific aspects of the home, very little has been written on the interaction between the retailer and consumer, and the pressures brought to bear on them by issues such as gender, education, status, symbolism, taste, decoration, hygiene, comfort and entertainment. As such, this book offers a valuable conjunction of retail history and consumption practices, which are examined through a multi-disciplinary approach to explore both their intimate connections and their wider roles in society.

Credit Nation examines how the drive to expand credit shaped property laws and legal institutions in the colonial and founding eras of the republic. In this major new history of early America, Claire Priest describes how the British Parliament departed from the customary ways that English law protected land and inheritance, enacting laws for the colonies that privileged creditors by defining land and slaves as commodities available to satisfy debts. Colonial governments, in turn, created local legal institutions that enabled people to further leverage their assets to obtain credit. Priest shows how loans backed with slaves as property fueled slavery from the colonial era through the Civil War, and that increased access to credit was key to the explosive growth of capitalism in nineteenth-century America. Credit Nation presents a new vision of American economic history, one where credit markets and liquidity were prioritized from the outset, where property rights and slaves became commodities for creditors' claims, and where legal institutions played a critical role in the Stamp Act crisis and other political episodes of the founding period.
