Book excerpt: “The racial categories that the schools use are completely bonkers, an arbitrary mess mostly left over from the work of federal bureaucrats in the 1970s that can’t withstand the slightest scrutiny. The administrators who rely on these categories are beholden to senseless and unscientific distinctions—they aren’t even competent or rational racialists. Justice Samuel Alito raised this issue in the arguments, pretty clearly relying on the work of George Mason University professor David Bernstein, who eviscerated the categories in an amicus brief and has written a book on their origin and implications, Classified: The Untold Story of Racial Classification in America.” –National Review Americans are understandably squeamish about official racial and ethnic classifications. Nevertheless, they are ubiquitous in American life. Applying for a job, mortgage, university admission, citizenship, government contracts, and much more involves checking a box stating whether one is Black, White, Asian, Hispanic, or Native American. While reviewing the surprising history of American racial classifications, Classified raises questions about the classifications’ coherence, logic, and fairness; for example: · Should Pakistani, Chinese, and Filipino Americans be in the same category despite their obvious differences in culture, appearance, religion, and more? · Why does the government not allow Americans to classify themselves as bi- or multi-racial? · How did the government decide that a dark-complexioned, burka-wearing Muslim Yemini should be classified as generically white, but a blond-haired, blue-eyed immigrant from Spain should be classified as Hispanic and treated as a member of a minority group? · Why does the government require biomedical researchers to classify study participants by the official racial categories, when the classifications have no scientific basis? In an increasingly diverse society with high rates of intergroup marriage, the American system of racial classification is getting even more arbitrary and absurd. With rising ethno-nationalism threatening democracy around the world, it’s also dangerous. Classified argues that the time has come to consider abolishing official racial classification and replace it with the separation of race and state.

Book excerpt: Every day we make predictions based on limited information, in business and at home. Will this company's stock performance continue? Will the job candidate I just interviewed be a good employee? What kind of adult will my child grow up to be? We tend to dismiss our predictive minds as prone to bias and mistakes, but in The Tell, psychologist Matthew Hertenstein reveals that our intuition is surprisingly good at using small clues to make big predictions, and shows how we can make better decisions by homing in on the right details. Just as expert poker players use their opponents' tells to see through their bluffs, Hertenstein shows that we can likewise train ourselves to read physical cues to significantly increase our predictive acumen. By looking for certain clues, we can accurately call everything from election results to the likelihood of marital success, IQ scores to sexual orientation -- even from flimsy evidence, such as an old yearbook photo or a silent one-minute video. Moreover, by understanding how people read our body language, we can adjust our own behavior so as to ace our next job interview or tip the dating scales in our favor. Drawing on rigorous research in psychology and brain science, Hertenstein shows us how to hone our powers of observation to increase our predictive capacities. A charming testament to the power of the human mind, The Tell will, to paraphrase Sherlock Holmes, show us how to notice what we see.

Book International Trademark Classification

Download or read book International Trademark Classification written by Jessie N. Roberts and published by Oxford University Press. This book was released on 2012-03-01 with total page 584 pages. Available in PDF, EPUB and Kindle. Book excerpt: International Trademark Classification: A Guide to the Nice Agreement helps trademark and IP attorneys properly classify goods and services on trademark applications. It explains the forty-five Classes of goods and services adopted under the Nice Agreement, a worldwide classification system for trademark registration adhered to by more than seventy countries. Author Jessie N. Roberts sets forth the Official Text of Class Headings and the Explanatory Notes for which goods and services are included or excluded from each Class. This is followed by an examination of each item within the Class, including items for which there are no official explanations. This book can be helpful to trademark practitioners and national offices in the classification of items not included in the alphabetical list. The approach is international in scope, and is not organized from the viewpoint of any specific jurisdiction. This new Fourth Edition clarifies some of the Classes--particularly Classes 5, 9, and 28--and makes the Alphabetical List of the Nice Agreement more logical and useful.
