Book excerpt: From the entry into force of the Lisbon Treaty the EU has among its constitutional objectives the goal of achieving a highly competitive social market economy. It is for the first time in the history of integration, that the concept of social market economy found its way into the Treaty objectives. At the same time, however, the EU has not been given any specific powers to actively develop social policies. The social market economy objective is therefore largely seen as a requirement for a more balanced approach in situations where liberalizing logic of the internal market and its economic freedoms collides with social rights and security systems, which are traditionally strong in many EU countries. Such understanding of the social market economy objective increases the role of European Court of Justice (CJEU), as the Member States, through the legislative process, have not shown so far any willingness to modify by legislative acts the relationship between economic freedoms and social rights. In the pre-Lisbon period the CJEU disappointed the left side of the EU ́s political spectrum by several of its judgments in which the judges gave priority to economic freedoms over social rights. It is therefore interesting to review whether the CJEU has accepted the signal brought about by changes in the primary law of the EU and whether it has approached differently the balance between economic freedoms and social rights in the name of achieving the EU ́s objective of social market economy.

Book excerpt: This monograph, which was also designed as a short reference book for specialized undergraduate and graduate courses on EU law, intends to shed light on, and legally frame, the evolution of the doctrine of services of general economic interest (SGEIs). The book emphasizes the pivotal role played by SGEIs in striking a fair balance between market and social objectives. To this end, the book claims, first of all, that SGEIs have a dual nature inasmuch as they act as a limitation to/derogation from the free market and, simultaneously, as a value and positive obligation addressed at national authorities, undertakings, and EU institutions. The EU notions of access to public services and universal service are the clearest signal of such phenomenon. Secondly, the book claims that the transfer of competences from the Union to the Member States and the reaffirmation of Member States’ sovereignty in crucial sectors of the economy are not the only solutions to foster social rights. In fact, this narrative is apt to undermine the foundations, spirit, and purpose of the process of European integration, especially at a time like the present, when new forms of populism and anti-Europeanism are on the rise, and when a European response is imperative to counter the spread of the coronavirus in European countries. The book concludes that SGEIs’ regulation is an area of law where the EU institutions have generally successfully put into action and consolidated the social market economy principles on which the EU was founded. This is even further proof that the EU is not merely the reflection of interests linked to market completion, but also and foremost a ‘Community based on the rule of law’. The book will be a valuable resource for academics and researchers in EU Law, European Public Law and EU competition law.

Book excerpt: The term 'social market economy' was introduced in the Treaty on European Union in order to emphasise that social and economic objectives of the European Union are both important, and have to be reconciled with each other. This contribution describes how social objectives have been developed in EU law since the establishment of the European Economic Community. The Court of Justice of the European Union has interpreted Treaty provisions to give them maximum effect for the realization of these objectives. However, tensions with the economic objectives exist when economic freedoms are confronted with social rights. This contribution examines how the CJEU balances these interests, and how this relates to the social market economy. There are also areas where economic rights have no counterpart at the EU level, but where they interact with social policies of Member States. Here too, the concept of social market economy is relevant. After a discussion of these various dimensions of the term social market economy, the subsequent articles of this Special Issue are introduced.

At the same time, however, the EU has not been given any specific powers to actively develop its social policy. After six years of legal force of the Lisbon Treaty there is still no clarity on how should the EU interpret the legacy of German post-war Sozialmarktwirtschaft, whether it should strive for its own economic and social “Constitution”, whether it can try to fulfil the objective of social market economy through the instruments of EU law. The paper argues that some, rather partial, measures enacted by the EU legislator would be desirable and feasible without creating a danger of over-regulation that would threaten the freedoms of the internal market or distort the existing division of powers between the EU and the Member States in the social field. The social market economy concept, being itself a compromise between the free markets and social welfare requirements, can act there as a guarantee that neither unbounded market freedoms nor socializing policies would dominate the EU.

Book excerpt: The article attempts to answer the above question because the social market economy, prima facie one of many objectives set out in Article 3 of the TEU, is above all else an integrated social model, a collection of other objectives, and a concept that ranks other objects in a systematic whole. Reaching this aim requires adequate competencies. The article takes 10 main parts of the social market economy content as analysed by current doctrine and compares it with the list of EU competencies as listed in the founding treaties. Through this detailed analysis it comes to the conclusion that although EU competencies are relevant for the majority of social market economy content, the more a particular problem relating to social market economy approaches significant aspects of the functioning of the state, the smaller the impact of the EU and its competences.
