Scrutiny of China's nuclear exports and non- proliferation commitments indicate an adherence to strict "letter-of-the-law" obligations. Yet, China's commitment to the norms and values of the non- proliferation regime is controversial. The difference between China's legal obligations and the international norms of acceptable export behavior is a function of the ambiguity inherent in international treaties and agreements. Stephen Meyer's motivational hypothesis is used to evaluate China's nuclear- export decision-making process. China's motivational profile created by the combination of 16 incentives and disincentives on one hand, and international and domestic conditions on the other. Two case studies are used to illustrate that this profile is not static. As environmental conditions and China's national priorities change, so does China's motivational profile. in the past, U. S. attempts to alter China's nuclear-export activities were successful when the targeted changes were congruent with China's national priorities. For the United States to influence China's future nuclear-export activities, it must first understand China's national priorities and determine the corresponding export motivations that influence China's decision-making process. The United States should then work to change conditions, which would shift the balance of incentives and disincentives, thereby changing the outcome of China's cost- benefit calculus.

A major power with access to nuclear technology, China has a significant impact on international nuclear weapons proliferation, but its attitude towards the spread of the bomb has been inconsistent. China’s mixed record raises a broader question: why, when and how do states support potential nuclear proliferators? This book develops a framework for analyzing such questions, by putting forth three factors that are likely to determine a state’s policy: (1) the risk of changes in the nuclear status or military doctrines of competitors; (2) the recipient’s status and strategic value; and (3) the extent of pressure from third parties to halt nuclear assistance. It then demonstrates how these factors help explain China’s policies towards Pakistan, Iran, and North Korea. Overall, the book finds that China has been a selective and strategic supporter of nuclear proliferators. While nuclear proliferation is a security challenge to China in some settings, in others, it wants to help its friends build the bomb. This book will be of much interest to students of international security, nuclear proliferation, Chinese foreign policy and International Relations in general.

Book excerpt: The 1968 Nuclear Non-proliferation Treaty has proven the most complicated and controversial of all arms control treaties, both in principle and in practice. Statements of nuclear-weapon States from the Cold War to the present, led by the United States, show a disproportionate prioritization of the non-proliferation pillar of the Treaty, and an unwarranted underprioritization of the civilian energy development and disarmament pillars of the treaty. This book argues that the way in which nuclear-weapon States have interpreted the Treaty has laid the legal foundation for a number of policies related to trade in civilian nuclear energy technologies and nuclear weapons disarmament. These policies circumscribe the rights of non-nuclear-weapon States under Article IV of the Treaty by imposing conditions on the supply of civilian nuclear technologies. They also provide for the renewal and maintaintenance, and in some cases further development of the nuclear weapons arsenals of nuclear-weapon States. The book provides a legal analysis of this trend in treaty interpretation by nuclear-weapon States and the policies for which it has provided legal justification. It argues, through a close and systematic examination of the Treaty by reference to the rules of treaty interpretation found in the 1969 Vienna Convention on the Law of Treaties, that this disproportionate prioritization of the non-proliferation pillar of the Treaty leads to erroneous legal interpretations in light of the original balance of principles underlying the Treaty, prejudicing the legitimate legal interests of non-nuclear-weapon States.

On balance, U.S. efforts to stem the proliferation of nuclear weapons and technology have been very successful. Unfortunately, implementation of U.S. non-proliferation policy in China has been inconsistent and ineffective. Despite limited success in encouraging Chinese adherence to international norms over the years, evidence suggests that the U.S. has failed to stem China's supply of nuclear and missile technology and materials to rogue states. China continues to proliferate because of its security concerns, its tenuously competitive relationship with the United States, and its economic and political ambitions. The U.S. has tolerated this behavior because it is unwilling to impose real sanctions on China for fear of losing commercial and trade ties. Lack of mutual understanding and effective engagement also contributes to the problem. The stakes are high. If the U.S. does not effectively enforce its non-proliferation treaties and agreements with China, it could face challenges to its global leadership, the emergence of a regional nuclear arms race in Asia, and diminished national security.
