Book excerpt: This study of Burchard's 'Decretum', a popular book of Catholic canon law compiled just after the year 1000, sheds new light on the development of law and theology long before the Gregorian Reform, normally considered as a watershed in the history of the Latin Church. Practical episcopal concerns and an appreciation of new scholarly methods led Burchard to be dissatisfied with the quality of contemporary jurisprudence and particularly with the teaching texts available to local bishops. Drawing upon new manuscript discoveries, the author shows how Burchard tried to create a new text that would address these problems. He carefully selected and compiled canons from earlier collections and then went on to tamper systematically with the texts he had chosen. By doing so, he created a book of church law that appeared to be based on indisputable authority, that was internally consistent and that was easy to apply through logical extrapolation to new cases. The present study thus provides a window into the development of legal and theological reasoning in the medieval West, and suggests that, thanks to the work of ambitious bishops, the flowering of law and theology began far earlier, and for different reasons, than scholars have heretofore supposed.

By 1250 canon law had grown into something more than a profitable occupation: it had become a recognizable profession in the strict meaning of the term as it is still used today. University law faculties trained aspiring canonists in the mysteries of their craft and put them through intellectually demanding exercises that terminated in a formal examination before they received their degrees. Judges in church courts formally admitted them to practice after verifying their educational qualifications and administered prescribed rules of conduct. Particular topics are the canonists' system of legal ethics, the education and training of canon lawyers in university law faculties, and some fundamental features of the professional practice of canon law, both in medieval Europe and in the crusading states of the Levant.

This book offers a complete reappraisal, drawing on a detailed examination of the surviving letters produced by the papal chancery to show that conversely, it was a vital and innovative pontificate. It argues that during what was a stabilising period for the papacy in an era of peace, Honorius and the chancery were able to enact the instruments and ecclesiological claims dictated by external threats and produced during previous papacies. In particular, it shows that by adapting the content and form of the letters it issued, Honorius's chancery, led by the official Haimeric, played a decisive role in extending the ecclesiological thinking of the papacy. Furthermore, these years paved the way for ideas which were further developed later in the twelfth century, especially the arguments created by the warring parties in the Schism of 1130 to legitimise their respective popes. This study thus presents a different view of Honorius' administration, highlighting the strategies to which the papacy turned in order both to govern ecclesiastical institutions and to deal with secular matters, when previous protocols and routines could no longer be relied upon.
