Book excerpt: A major point of contention in the policy debates over tort reforms during the most recent malpractice "crisis" has been whether rising liability insurance costs lead physicians to relocate to lower-cost states, restrict the scope of their practice (for example, by eliminating high-risk procedures), or stop practicing altogether. We investigated the extent to which these dynamics occurred in Pennsylvania, one of the states hit hardest by rising insurance premiums, by analyzing 1993-2002 Pennsylvania insurance department administrative data on liability insurance policies held by 47,366 physicians in 18 specialties with high and low liability risk. Our analyses addressed three questions relating to the malpractice "crisis period," 1999 to 2002: (1) Did the per-capita supply of high-risk specialists in Pennsylvania decrease? (2) How frequently did high-risk specialists stop practicing in Pennsylvania? (3) How frequently did high-risk specialists narrow their scope of practice to exclude high-risk procedures? We used low-risk specialists during the crisis period and high-risk specialists in the years preceding the crisis period as benchmarks for comparisons. For nearly all specialties, the proportions of high-risk specialists restricting their scope of practice were not significantly different during the crisis period than before. Overall, less than 3% (average annual percentage) of physicians performing major procedures shifted to minor procedures only (0.7%) or no procedures (1.8%) during the malpractice crisis period, and 8.2% of specialists performing only minor procedures shifted to no procedures. In the analysis of physicians leaving Pennsylvania practice, most specialties saw 10 to 20% of their ranks exiting practice each year. However, there were no statistically significant differences in the proportion leaving between high-risk and low-risk specialties, or among high-risk specialists during versus before the crisis period. The overall supply of physicians in Pennsylvania (including new entrants to the Pennsylvania market) grew 5.8% between 1993 and 2002, from 181 to 191 per 100,000 Pennsylvania residents. The total per-capita supply of high-risk specialists increased slightly during the crisis period. The only notable decrease in physician supply was in Obstetrics-gynecology: the supply of Ob-gyns dropped 8% during the crisis period. However, the decline continued a trend that predated the onset of the crisis. Our analysis found much more modest effects of the liability crisis on physician supply than have been suggested by physician survey studies. We discuss several methodological issues which may explain the disparate findings regarding physician supply effects in studies that administrative datasets and studies that rely on physician survey data. Part III looks at malpractice litigation from the viewpoint of the practicing physician. Some of the chapters are broadly relevant to all doctors—the rise of e-medicine, and the importance of effective communication, for example. The other ch- ters are constructed around individual medical specialties, but discuss issues that are of potential interest to all. Part IV looks ahead. “The Case for Legal Reform” presents changes in medical-legal jurisprudence that can be of immediate benefit. The final two chapters take a broader perspective on aspects of our entire health care system and its interface with law and public policy.

Book excerpt: We explore whether the composition of the physician work force is impacted by the clinical standards imposed on physicians under medical liability rules. We theorize that physicians of particular backgrounds will be attracted to regions when the malpractice laws of those regions favor the type of medicine characteristic of those backgrounds. To test this prediction, we rely on a quasi-experiment made possible by states shifting from local to national customs as the basis for setting standards at court, a distinction that captures meaningful differences in the clinical expectations of the law in light of the well documented phenomenon of regional variations in medical practices. Using data from the Area Health Resource File from 1977 to 2005, we find that the rate of surgeons among practicing physicians increases by 2-2.4 log points following the adoption of national-standard laws in initially low surgery-rate regions-i.e., following a change in the law that effectively expects physicians to increase practice intensities. We find that this response is nearly three times greater in rural counties. We also find that this supply effect is unidirectional, with no evidence to suggest that surgeons retreat when initially high-surgery-rate regions change their laws so as to expect less intensive practice styles.

It is likely that most people will experience at least one diagnostic error in their lifetime, sometimes with devastating consequences. Diagnostic errors may cause harm to patients by preventing or delaying appropriate treatment, providing unnecessary or harmful treatment, or resulting in psychological or financial repercussions. The committee concluded that improving the diagnostic process is not only possible, but also represents a moral, professional, and public health imperative. The ongoing opioid crisis lies at the intersection of two public health challenges: reducing the burden of suffering from pain and containing the rising toll of the harms that can arise from the use of opioid medications. Chronic pain and opioid use disorder both represent complex human conditions affecting millions of Americans and causing untold disability and loss of function. In the context of the growing opioid problem, the U.S. Food and Drug Administration (FDA) launched an Opioids Action Plan in early 2016. As part of this plan, the FDA asked the National Academies of Sciences, Engineering, and Medicine to convene a committee to update the state of the science on pain research, care, and education and to identify actions the FDA and others can take to respond to the opioid epidemic, with a particular focus on informing FDA's development of a formal method for incorporating individual and societal considerations into its risk-benefit framework for opioid approval and monitoring.

Among its important findings is that at most one in ten patients injured through medical negligence receives compensation through the malpractice system. The focus of public attention has been on the rising cost to physicians of malpractice insurance. Although Patricia Danzon analyzes this question thoroughly, her view is much broader, encompassing the malpractice system itself--the legal process, the liability insurance markets, and the feedback to health care. As an economist, she is concerned with the efficiency or cost-effectiveness of the system from the point of view of its three social purposes: deterrence of medical negligence, compensation of injured patients, and the spreading of risk. To provide evidence of the operation of the system in practice, to distinguish fact from allegation, and to evaluate proposals for reform, she has undertaken a detailed empirical analysis of malpractice claims and insurance markets.
