Book excerpt: Excerpt from A Compilation of Laws Affecting the Regulation of Public Utilities (Including Water Powers) 1907-1911: Published by the Railroad Commission of Wisconsin, August, 1911 Cities, under general law; water works; rates; collection; indebtedness. Section 925 - 98.When cities own the water works or lighting works the water rates or charges for lighting shall be collected by the treasurer and be first devoted to the expense of maintaining and operating the works, paying the principal and interest of any indebtedness created in the construction or purchase thereof, and the balance, if any, shall be paid into the general fund. The common council of every city which shall construct or own and operate lighting works or water works to supply the city and its inhabitants with light or water may, by ordinance, fix the rates to be charged for light or water furnished the inhabitants thereof, and provide for the collection of the same either quarterly or semi-annually in advance or otherwise provided, such rates, shall be uniform for like services in all parts of the city. The provisions of the next following section shall apply to the listing and collection of unpaid rates or charges for light or water so furnished, so far as they are applicable. Ch. 367, 1909. Water mains, when owned by city; expenses. Section 925 - 106.The preceding provisions relating to the construction of water mains in whole or in part at the expense of abutting owners shall not apply except in cases where the city owns the works, and in cases where the water works are now owned or may hereafter be purchased by the city the extensions of mains after such purchase shall be made at the expense of the city at large or at the expense of abutting property as the council shall determine. The latter basis is certainly the sounder, and, in the absence of any specific legislation on the subject, would, it is safe to say, if the situation should arise in any case at the present day, receive judicial recognition in any court, for in the last analysis the fundamental distinction between a public calling and a pri vate calling is an economic one. Book excerpt: Excerpt from Public Service Commission Laws: A Comparison of the Laws of New York; Wisconsin, Massachusetts, New, Jersey and Maryland Municipal Ownership. In New York and Maryland it is provided that no municipality shall acquire any utility for other purposes than to supply its own needs, without first having secured the consent of the commission. Valuation of Property. The Wisconsin law provides for a valna tion by the commission of the property of all public utilities. In de termining such value, the commission may avail itself oi any information in the possession of the State board of assessment. A public hearing shall be held, and upon such hearing the commission shall fix the value and file'a statement thereof with the utility and with the clerk of the municipality where it is situated. A te-valuation may be made at any time on the initiative of the commission. Maryland adopted a similar provision and required a separate state ment of the property in each municipality. The other states give no such grants of power but in certain cases, at least in New York, there is an implied power in particular cases to value the property as a basis for rate making. Enforcement of Orders. Every order or direction of the commis sion in New York goes into effect at a time designated by the commission in the order. A rehearing may be had on application, if the commission so determine, but such rehearing shall not stay the Operation of the order or direction. Violation of any lawful order or direction of the commission is punishable bv fine and each day's violation constitutes a separate offense. The commissions in New York. Wisconsin and Mary land have summary power to commence action in the courts to prevent by mandamus or injunction any violation or threatened violation of law or order of the commission, or to require anything to be done which the public utility has failed or is about to fail to do.
