And there the book was the only evidence against the defendant. But here the plaintiffs' case does not rest solely upon the evidence furnished by the statute; there was evidence independently of the book that the defendant was a proprietor of the shares in question. There was an indorsement in his own hand-writing on a scrip-certificate for twenty shares brought to the Company's office to be registered, of his name, addition, and place of abode. As it appears the defendant did not sign the parliamentary contract, and as he can only become a proprietor in that way (a) Ante, p. 215. 1841. The London Grand Junction Railway Co.. Freeman. or by a transfer by deed, the book being primd facie evidence of his being a proprietor, it lies with him to shew the shares were not conveyed to him by deed. Parke, B.--In a late case in the Court of Exchequer, where the defendant concealed from the Company the fact of the deed of transfer to him being executed in blank, he was held to be estopped from taking advantage of that defect (a). And in The Cromford and Highpeak Railway Company v. Lacey (b), it was held that a defendant, who, with a knowledge of a misrecital in the act, had paid calls and acted as a proprietor, was estopped from questioning the validity of the act on that ground; and that it was not incumbent upon the plaintiffs to shew that the defendant had executed a contract under seal, to prove him a proprietor within the meaning of the act. Excerpt: ... the railroad), referring also to the 79th, 80th, 196th, 197th, 200th (a), and other general clauses, I have no hesitation in concluding (in accordance with the defendants' argument), that, by the effect of that statute, the defendants were intended to have, and empowered to make, on land north of Fishergate, a station (in the largest sense of the word) for passengers and goods, whether coming from, or going to, the canal, or from or to such station only; and secondly, that they (the defendants) were obliged, in favour of the Canal Company, (at the time when it was intended that their railway or tramroad should be taken from them), to give to that Company the accommodation pointed out by the act. Now, upon inspection of a map of the county, shewing the line of the North Union Railway and the line originally projected for the Bolton and Preston Railroad, it will be seen, that the line of the former, from Euxton to Preston, and the line of the latter, from Chorley to Preston, run parallel to, and not very far distant from each other; and it was thought expedient that the defendants' intended line, north of Chorley, and lying between Chorley and Fishergate, in (a) Ante, p. 352, note. 1843. Excerpt: ...by the above-named Company against a not the correct poor-rate made on the 20th November, 1847, for the parmode of rating a railway to the relief of the poor; but the value which the land occupied in each parish produces, after the due allowances, is that upon which the railway is to be rated in such parish. Any expenses, wherever arising, which the Company can shew to be necessary for keeping the hereditaments, which are the subject of the assessment, attheirvalue.andforthejustprotection of the Company in each parish, may properly be taken into consideration. A Railway Company is entitled to a deduction from the rateable value, in onlcrto countervail the depreciation which takes place in the value of the permanent way, and to maintain it in a state to command the supposed rent, which is the measure of such assessment. Such deduction is not included in working expenses. And, the fact that the Company has not incurred the expense, or laid by from their receipts any sum to meet it, will not disentitle them to make such deduction; in this respect, there is no substantial distinction between a railway and house property, or any other of a perishable nature, which must require renewal. By agreement between the London and Brighton R. C. and the South Eastern R. C, the traffic of the latter was to pass free over a certain portion of the line of the former, in consideration of the traffic of the former passing free over a certain portion of the line of the latter. A certain distance of the line of the appellant Company within the respondent parish, was affected by this arrangement. No part of the South Eastern R. C. was within that parish: --Hdd, that this was the same in substance as if so many tickets were daily issued, without money paid for..
