During the pre-reform period employers in California faced the largest average WC premiums in the nation, whereas the post-reform period saw decreases in injuries, cost per claim and premiums. We assess the impact of the reforms on employees by examining the propensity to seek care for minor injuries before and after the reforms and reveal who bore the incidence of reforms. We test for a change in propensity to seek care via the ``Monday effect" often documented in the literature and examine if the prevalence of Monday claims changed after the reform years. We also examine the incidence of the reforms by revealing if reductions in Workers' Compensation insurance premiums were passed-through to the worker in the form of higher real wages. We use a control state and apply the difference-in-differences method to measure the effects in California relative to the counter-factual. We control for occupational risk by creating an index of relative risk by occupation for each state and find that wages in California increased during the post-reform period relative to our control group. In our intra-state comparison, we find that relative to low-risk industries, workers in high risk industries experienced decreases in their wages despite a decrease in the average WC premium.

Workers' compensation was a Progressive Era response to problems associated with high rates of industrial injury, inadequate levels of compensation, and rising and uncertain costs for employers. The Legislature enacted an integrated program of compensation, insurance and safety in which injured workers were promised timely and adequate compensation, employers would be protected against lawsuits if they carried insurance against industrial accidents, and the State would administer a full program of occupational health and safety. Today, nearly 80 years later, the system faces many of the problems prompting its creation.

Book excerpt: The large excess fraction of difficult-to-diagnose injuries on Monday was originally thought to reflect employees' use of workers' compensation to cover weekend injuries. However, there has been mixed evidence found supporting this notion. This paper takes advantage of substantial reforms in California which both made filing false claims more difficult and less attractive via reduced benefits. The effects of the reforms on the frequency of Monday claims and hard-to-diagnose injuries are empirically tested using 2002-2006 workers' compensation claims from a large temporary employment agency, an industry with pronounced asymmetric information. In the post-reform period, the fraction of claims on Monday for difficult-to-diagnose injuries drops by 7 percentage points in California - with no change for branches in other states. The results are consistent with false claims explaining a part of the Monday effect, in industries with large asymmetric information. That said, when taking into account the effects of the reforms on claim costs and overall claim rates, the excess number of Monday claims make up less than 4 percent of the cost reductions brought on by the reforms.
