Book Constitutional Justice in Southeast Europe

Download or read book Constitutional Justice in Southeast Europe written by Enver Hasani and published by Nomos Verlagsgesellschaft. This book was released on 2012 with total page 194 pages. Available in PDF, EPUB and Kindle. Book excerpt: Constitutional courts play potentially significant roles in the transformation of legal orders in transition states. This collection offers a comparative analysis of constitutional justice in Southeast Europe and its place in the common European legal space. The comparison brings together longer transition experiences like Hungary's with rare insights into the later wave of constitutional transformation in little-studied jurisdictions like Kosovo, Serbia and Albania. Thematically it focuses on the relationship of constitutional courts to ordinary judiciaries and to the European Court of Human Rights. How are the interactions between these judicial bodies regulated? Do they cooperate or conflict in practice? And what is the resulting impact of the constitution and of the ECHR in legal reality? Through this lens, the authors highlight patterns and processes of constitutionalization and Europeanization and shed light on wider trends in the evolution of constitutional justice and the rule of law. Constitutional courts emerge as interfaces between various layers of domestic and international law and as building blocks in the European multi-level architecture of human rights protection.

Book International Criminal Justice and the Politics of Compliance

Download or read book International Criminal Justice and the Politics of Compliance written by Christopher K. Lamont and published by Routledge. This book was released on 2016-04-22 with total page 235 pages. Available in PDF, EPUB and Kindle. Book excerpt: International Criminal Justice and the Politics of Compliance provides a comprehensive study of compliance with legal obligations derived from the International Criminal Tribunal for the former Yugoslavia's (ICTY) Statute and integrates theoretical debates on compliance into international justice scholarship. Through the use of three models of compliance based on coercion, self-interest and norms, Christopher Lamont explores both the domestic politics of war crimes indictments and efforts by external actors such as the European Union, the United States and the Tribunal itself to induce compliance outcomes. He examines whether compliance outcomes do or do not translate into a changed normative understanding of international criminal justice on the part of target states.

Book Cultures of Crisis in Southeast Europe

Download or read book Cultures of Crisis in Southeast Europe written by Klaus Roth and published by LIT Verlag Münster. This book was released on 2017 with total page 370 pages. Available in PDF, EPUB and Kindle. Book excerpt: The history of the Balkan Peninsula of the last two centuries is marked by deep transformations and upheavals. The emergence and disappearance of states, ethnic conflicts and wars, changes of political systems, economic crises, migration movements, and natural disasters are the more visible of such upheavals. Most of them have been experienced as deep crises that forced people to adapt to often radically new situations. All too often crisis management became a permanent way of life. The included essays focus on the cultures of crisis and on the reactions of societies and individuals to them: on their impact on everyday life, on peoples' strategies of coping, on the processes of adaptation, and on peoples' attitudes.
