Book Imam Al Shatibi s Theory of the Higher Objectives and Intents of Islamic Law

Download or read book Imam Al Shatibi s Theory of the Higher Objectives and Intents of Islamic Law written by Ahmad Al-Raysuni and published by International Institute of Islamic Thought (IIIT). This book was released on 2005-01-01 with total page 482 pages. Available in PDF, EPUB and Kindle. Book excerpt: With the end of the early Islamic period, Muslim scholars came to sense that a rift had begun to emerge between the teachings and principles of Islam and Muslims’ daily reality and practices. The most important means by which scholars sought to restore the intimate contact between Muslims and the Qur’an was to study the objectives of Islam, the causes behind Islamic legal rulings and the intentions and goals underlying the Shari'ah, or Islamic Law. They made it clear that every legal ruling in Islam has a function which it performs, an aim which it realizes, a cause, be it explicit or implicit, and an intention which it seeks to fulfill, and all of this in order to realize benefit to human beings or to ward off harm or corruption. They showed how these intentions, and higher objectives might at times be contained explicitly in the texts of the Qur’an and the Sunnah, while at other times, scholars might bring them to light by means of independent reasoning based on their understanding of the Qur’an and the Sunnah within a framework of time and space. This book represents a pioneering contribution presenting a comprehensive theory of the objectives of Islamic law in its various aspects, as well as a painstaking study of objectives-based thought as pioneered by the father of objectives-based jurisprudence, Imam Abu Ishaq al-Shatibi; in addition, the author presents us with an important study of al-Shatibi himself which offers a wealth of new, beneficial information about the life, thought and method of this venerable man.

Book Islamic Ethics of Technology

Download or read book Islamic Ethics of Technology written by Amana Raquib and published by The Other Press. This book was released on 2015-04-10 with total page 406 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book approaches the question of technology from an Islamic ethical perspective. The book tries to broaden the scope of the Sharia to deal comprehensively with the ethical questions and dilemmas that arise in the midst of a postmodern technological culture due to the absence of well-defined religious-ethical ends. It looks at the maqasid as a universal ethical theory to be interpreted and applied in the global technological context. It weaves the contemporary philosophical analysis of technology within the maqasid discourse and assesses modern technology through the lens of the ultimate aims and purposes of the Sharia. It works out the relationship between the various objectives and how they can be developed into an Islamic ethics of technology. Following in the recent interest in the objectives of the Sharia, the book further expands the scope of the maqasid and carries it further to encompass metaphysical and ethical debates surrounding technology. Anyone interested in finding alternatives to the existing technological model will find this book valuable. Specifically those interested in Islam and Modern World and how ijtihad is being undertaken to tackle contemporary ethical problems will find this book helpful.

Book Salafism in the Maghreb

Download or read book Salafism in the Maghreb written by Frederic Wehrey and published by Oxford University Press. This book was released on 2019-11-21 with total page 256 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Arab Maghreb-the long stretch of North Africa that expands from Libya to Mauritania-is a vitally important region that impacts the security and politics of Europe, sub-Saharan Africa, and the broader Middle East. As Middle East scholars Frederic Wehrey and Anouar Boukhars show in Salafism in the Maghreb, it is also home to the conservative, literalist interpretation of Islam known as Salafism, which has emerged as a major social and political force. Through extensive interviews and fieldwork, Wehrey and Boukhars examine the many roles and manifestations of Salafism in the Maghreb, looking at the relationship between Salafism and the Maghreb's ruling regimes, as well as competing Islamist currents, increasingly youthful populations, and communal groups like tribes and ethno-linguistic minorities. They pay particular attention to how seemingly immutable Salafi ideology is often shaped by local contexts and opportunities. Informed by rigorous research, deep empathy, and unparalleled access to Salafi adherents, clerics, politicians, and militants, Salafism in the Maghreb offers a definitive account of this important Islamist current.

Book Towards Realization of the Higher Intents of Islamic Law

Download or read book Towards Realization of the Higher Intents of Islamic Law written by Gamal Eldin Attia and published by International Institute of Islamic Thought (IIIT). This book was released on 2007-01-01 with total page 315 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book takes an important step "towards the realization of the higher intents of the Islamic law". First, it opens the door towards the integration of contemporary values and worldview into the maqasid terminology. This is carried out via the sections on "the role of reason and experience in identifying maqasid". Secondly, the book gives answers to the complex theoretical questions on the role of maqasid in ijtihad, juristic theorization (usul), and the Islamization of the human, social, and physical sciences. Last, but not least, the book highlights the role and the necessity of a 'maqasid-informed' mindset on the intellectual and communal levels, and takes a pioneering futuristic look into this very important branch of Islamic knowledge.Maqasid al-Shariah (Higher Intents of the Islamic Law) is the most promising tool for the 'contemporization' of Islamic law and its philosophical foundations. It is also - as this book reveals - a promising tool for the realization of Islamic values and principles in the realms of judiciary, society, and even science.

However, there is an incongruence in applying multilayered and opaque Tijarah contracts for investment purposes. This has contributed to the divergence between Shariah and Common Law and caused tremendous problems and systemic legal risks to Islamic finance. The authors of Shariah Investment Agreement introduce a legal tool in the form of a Shariah Investment Agreement carefully drafted to ensure that it is Shariah-compliant and can be applied in Common Law jurisdictions as well, so as to allow for the execution of risk-sharing investment in Islamic finance. It details the building blocks and key considerations that must be noted when drafting such agreements so the investor and investee will know what to expect when entering into such a contract. Proper implementation of the Shariah Investment Agreement will pave a clear route to a harmonious convergence between Shariah and Common Law and lead to Islamic finance developing further to become a stronger, unstoppable force in the finance industry.

It is also one that remains resistant to universal dogma, with a wide range of responses to women’s social roles across the Islamic world. Reflecting this heterogeneity, the editor of this volume has assembled the latest research on the issue, which combines contemporary with historical data. The material comes from around the world as well as from Muslim and non-Muslim researchers. It takes in work from majority Muslim nations such as Bangladesh, Iran, Iraq, Lebanon, Pakistan, Palestine, Tunisia and Turkey, as well as countries with troubled interfaith relations such as India and Israel. Nations with minority Muslim populations such as France, the UK, Canada and Australia, are also represented. The work also features varying Islamic sub-groups such as the two main ones, Sunni and Shi’a, as well as less well known populations such as the Ismaili Muslims. In each case, the work is underpinned by the very latest socio-theological insights and empirical data.
