Bonded labour affects between 15 and 20 million labourers within the region, and is shaped by locally specific interconnections between ethnicity, class, caste and, critically, gender structures. Masculinity and Modern Slavery in Nepal explores the role of masculinity in shaping the structures and experience of slavery and subsequent freedom. While many I/NGOs and human rights organisations use freedom from slavery as a powerful and emotive goal, the lived reality of freedom for many bonded labourers often results in disappointment and frustration as they navigate diverse expectations of masculinity. Taking Nepal as a case study, the book illustrates how men’s gendered experiences of bondedness and freedom can inform perspectives on the transition to freedom and modernity in South Asia more broadly. Researchers of modern slavery, gender studies, and South Asian studies will be interested in the rich analysis on offer in this book.

Book excerpt: The UN estimates that 20 million are held in bonded labor. Several economic analyses assert that bonded laborers accept these contracts voluntarily, which could imply that a ban would make such laborers worse off. We question the voluntary nature of bonded labor, discuss different theories and new evidence on the issue, and propose a new mechanism whereby landlords keep workers trapped. With different types of landlords not revealed to the laborer, we show how some landlords manipulate loan terms so that the laborer becomes bonded if future labor is rendered as collateral. Enforcement mechanisms and the monopolistic market for credit thus play a joint role. Providing alternative sources of credit, offering proper conflict resolution institutions for settling labor-contract disputes and banning the practice of bonded labor could emancipate bonded laborers, which would make them better off.

Book excerpt: The Kamaiya liberation campaign was one of the robust interventions of the General Federation of Nepalese Trade Unions (GEFONT), which aimed to put a stop to informal and forced (almost slavery in many dimensions) labour practices. The Kamaiya system was one of the most vulnerable bonded labour systems prevailing in Nepal until the last century. As Kamaiyas were in debt-bondage, they are compelled to work for a landlord from generation to generation. As a first step to liberate the bonded Kamaiyas, GEFONT launched in 1996 the Kamaiya Liberation Forum-Nepal (KLFN) and in the same year organized the Federation of Agricultural Workers of Nepal (FAWN) to represent all agricultural workers, including Kamaiyas. In the succeeding years, GEFONT engaged in various initiatives and actions to bring to the government and to the public the plight of the Kamaiyas. Together with national and international non-government organizations and donor agencies, GEFONT also embarked on various projects and activities aimed at improving the welfare of the Kamaiyas and their families. On 17 July 2000, through a Resolution of Commitment in Parliament, the government declared freedom for the Kamaiyas. The government further prohibited every type of bondage and enacted The Kamaiya Labour (Prohibition) Act in 2002. In spite of gaps in the Act and the inherent problems seen during the rehabilitation of Kamaiyas, there have been positive developments as a result of GEFONT's interventions and initiatives: landless Kamaiyas have received land ownership, houses with toilet facilities, and access to drinking water; children attended schools; almost all former Kamaiya workers received at least a minimum wage; children are increasingly withdrawn from child labour; and around a halfdozen freed Kamaiya have been elected/selected in the parliament, the Constituent Assembly. Also, trade unions have begun to unionize former Kamaiyas along with other agricultural labourers in the districts. Unionization was one of the more satisfactory outcomes of the campaign. At the time FAWN was registered as a federation, the membership rate was high - more than 76,000, about half of which comprised ex-Kamaiyas.

Despite the fact that the United Nations has reported debt bondage as the most prevalent form of forced labour worldwide, there it is still little known about the real practical impacts of this approach to the lives of marginalised people. Based on extensive ethnographic research, this book will be a useful guide to students and scholars of modern slavery, international development, and South Asian studies.
