Book Bloomsbury Professional Law Insight Cannabis Law and Regulation

Download or read book Bloomsbury Professional Law Insight Cannabis Law and Regulation written by Mark Taylor and published by Bloomsbury Publishing. This book was released on 2020-03-04 with total page 215 pages. Available in PDF, EPUB and Kindle. Book excerpt: The business of cannabis is exploding as: adult recreational markets open in some of the world's largest economies in defiance of international treaties; and governments increasingly approve research to develop medicinal forms of the drug. Cannabis Law and Regulation is a comprehensive analysis of the changing cannabis laws of more than 50 of the largest and most significant global markets, with insight from legal experts, political and government figures and public health officials. The business of cannabis is exploding as adult recreational markets open in some of the world's largest economies in defiance of international treaties and governments increasingly approve research to develop medicinal forms of the drug. Individual legal, compliance and tax issues are covered, where relevant, as the book examines existing recreational and medicinal cannabis laws and regulations, and where and why they are changing. The shift from black market product to regulated entity has legal ramifications for several service industries, from financial services and insurance to farming, cultivation, marketing, IP, copyright and trademark law. Cannabis Law and Regulation covers the US, Canada, Uruguay and other emerging areas where recreational use has been legalised, and the rapidly transforming European, African and Asian landscapes where a rush to become the top global medicinal cannabis hub is taking place. Where recent court cases, rulings, directives, government initiatives, trials and, in some cases, total decriminalisation have created a patchwork of global markets for participants to navigate and serve, Cannabis Law and Regulation is an essential legal guide. At approximately 150 pages, criminal and medical law practitioners, consultants, professors, doctors, business executives and drug regulators will find this a crucial, but quick read. Bloomsbury Professional Insights provide guidance for legal and tax practitioners on developing, specialist areas or existing, complex areas where understanding is required after recent changes in legislation or court decisions.

Book Rethinking Cannabis Legislation Insights from Advocacy Groups

Download or read book Rethinking Cannabis Legislation Insights from Advocacy Groups written by Christopher Hunter Tramel and published by Independently Published. This book was released on 2018-05-13 with total page 236 pages. Available in PDF, EPUB and Kindle. Book excerpt: Prohibition and regulation of substances in the United States transformed throughout the 20th century namely through the Pure Food and Drug Act, the prohibition of alcohol, the Marihuana Tax Stamp Act, and the Controlled Substances Act, with each further expanding the amount of substances regulated and the consequences of breaking the regulations. The first chapter will briefly outline major events and legislation from 1937 to the present day and how such events and legislation set the stage for grassroot initiatives on the state level seeking to take advantage of the medicinal properties of Cannabis sativa and its impact on relative incarceration rates throughout the era. The second chapter investigates the 'three qualifiers' necessary to be classified as a Schedule I controlled substance and challenges such with the findings of federal commissions, patents, and programs; similar medicines, and the surge in state-level acceptance as well as public support for the medicinal use of Cannabis sativa. The lack of settling of the Schedule I classification with regards to Cannabis sativa in the face of such legitimate findings has created an environment possibly violating provisions of the Fourth, Fifth, Eighth, Ninth, Tenth, and Fourteenth Amendments of the United States Constitution. Finally, this thesis will critically approximate the economic impact of the Schedule I classification of Cannabis sativa from the commencement of the Shafer Commission in 1972 to the present day. Such historic, social, and economic impacts around the "War on Cannabis sativa" are grounds proving the legitimacy of the movement of cannabis law reform seen in the modern landscape of the United States. Likewise, such findings should act as evidence that the Schedule I classification of such is unconstitutional, unethical, and thwarted medical progressivism, freedom of choice, and treatment of fellow Americans since 1937.

Book The Concept of Dilemma in Legal and Judicial Ethics

Download or read book The Concept of Dilemma in Legal and Judicial Ethics written by Przemysław Kaczmarek and published by Wydawnictwo C.H.Beck. This book was released on 2018-10-12 with total page 355 pages. Available in PDF, EPUB and Kindle. Book excerpt: Judges and lawyers have to shape their moral competences in order to maintain their professional ethics at a high standard if they want to effectively meet the challenges that modern society will throw at them. This requirement is due to the growing expectation that they will be socially and morally responsible for the law. Thus, the need to place ethics at the heart of legal education, and to make ethical reflection pervasive in academic courses, becomes more obvious every day. Using the concept and examples of moral dilemmas is a way of facilitating this task. The main purpose of this book is to analyse the concept of moral dilemma in context of judicial and legal ethics, and to provide material for legal education. The structure of this book is designed with this double aim in mind. The theoretical part presents the concept of dilemmas on grounds of metaethics and the perspectives for its application in a professional legal context. The former encompasses situations of conflict of duties or obligations, in which the choice of one conduct necessarily prevents a different conduct, and therefore leads to an unacceptable outcome. Hence, the situation of dilemma always involves an issue of moral responsibility and the problem of “dirty hands”. How such situations are present in legal practice and how to deal with them is the main concern of this part. The considerations are divided into three levels of reflection – deontological, axiological, and moral responsibility. The practical part of the book contains an overview of 150 dilemmas that can be useful in legal ethics or other legal courses. The dilemmas are divided into chapters covering the following branches of law: criminal law, civil and commercial law, family and custody law, labour and social security law, and constitutional law. Every dilemma presents a description of the facts, a reconstruction of dilemma, its standard solution and some critical remarks from a meta-ethical perspective. The dilemmas cover situations regularly met in everyday practice, as well as examples of more exceptional challenges in connection with constitutional crises that have occurred in Poland in recent years.

Book Drug Use for Grown Ups

Download or read book Drug Use for Grown Ups written by Dr. Carl L. Hart and published by Penguin. This book was released on 2022-01-11 with total page 305 pages. Available in PDF, EPUB and Kindle. Book excerpt: “Hart’s argument that we need to drastically revise our current view of illegal drugs is both powerful and timely . . . when it comes to the legacy of this country’s war on drugs, we should all share his outrage.” —The New York Times Book Review From one of the world's foremost experts on the subject, a powerful argument that the greatest damage from drugs flows from their being illegal, and a hopeful reckoning with the possibility of their use as part of a responsible and happy life Dr. Carl L. Hart, Ziff Professor at Columbia University and former chair of the Department of Psychology, is one of the world's preeminent experts on the effects of so-called recreational drugs on the human mind and body. Dr. Hart is open about the fact that he uses drugs himself, in a happy balance with the rest of his full and productive life as a researcher and professor, husband, father, and friend. In Drug Use for Grown-Ups, he draws on decades of research and his own personal experience to argue definitively that the criminalization and demonization of drug use--not drugs themselves--have been a tremendous scourge on America, not least in reinforcing this country's enduring structural racism. Dr. Hart did not always have this view. He came of age in one of Miami's most troubled neighborhoods at a time when many ills were being laid at the door of crack cocaine. His initial work as a researcher was aimed at proving that drug use caused bad outcomes. But one problem kept cropping up: the evidence from his research did not support his hypothesis. From inside the massively well-funded research arm of the American war on drugs, he saw how the facts did not support the ideology. The truth was dismissed and distorted in order to keep fear and outrage stoked, the funds rolling in, and Black and brown bodies behind bars. Drug Use for Grown-Ups will be controversial, to be sure: the propaganda war, Dr. Hart argues, has been tremendously effective. Imagine if the only subject of any discussion about driving automobiles was fatal car crashes. Drug Use for Grown-Ups offers a radically different vision: when used responsibly, drugs can enrich and enhance our lives. We have a long way to go, but the vital conversation this book will generate is an extraordinarily important step.
