Book excerpt: Excerpt from The Basis for Legislation on Fishery Questions When we speak of the depletion, or complete exhaustion of fisheries, it must be understood that these terms are not used in an absolute sense, but only so far as they affect the supply for the use of mankind, or, in other words, the output of the industry. The quantity of fish may be diminished in two ways, in the one case, when the catch exceeds the reproduction, and in the other, when the fish are frightened away from the haunts of the fishermen. I quite agree with the views so often expressed as to the difficulties which have hitherto stood in the way of a proper study of the life and habits of the inhabitants of the sea, which is the only thing that would conduce to an early solution of the problem but the experience gained from ascertained facts concerning fisheries, throws enough light to induce a conclusion, in any rational mind, in one or the other direction. Book excerpt: Legislating for an ecosystem approach to fisheries (EAF) is complex, due to the holistic nature of EAF involving multiple factors that underpin the social, economic, environmental, and institutional aspects of fisheries sustainability. These factors include ecosystems integration, risks, inter-sectoral collaboration, research, participatory processes, monitoring, control, surveillance, and enforcement, among others. To assess how an EAF is being implemented through national policy and legal frameworks, FAO developed "A diagnostic tool for implementing an ecosystem approach to fisheries through national policy and legal frameworks". The present legal report on the EAF used the diagnostic tool to assess the alignment of selected policy and legal instruments of Togo with an EAF. This assessment analysed the extent to which 82 EAF legal requirements, which are considered the minimum standards in legislating for an EAF, are reflected in Togo's policies and legislation relevant to the fisheries sector of the country and other relevant sectors (such as environment, wildlife, ecosystems, and maritime affairs). Based on this preliminary diagnosis, gaps were identified in the assessed instruments, and recommendations were made for improving the implementation of an EAF. This report was elaborated following a participatory approach with the involvement of the national competent authorities of Togo. Drafted in July 2021, the report was submitted to the national authorities of Togo in October 2021. The Ministère de l'économie maritime, de la pêche et de la protection côtière (MEMPPC) [Ministry of Maritime Economy, Fisheries and Coastal Protection] endorsed this EAF Legal Report of Togo in December 2021.

It deals principally with the management of fishery resources, relations between the EC and third States in fisheries matters, the marketing of and trade in fishery products, financial assistance to the fisheries sector, and aquaculture. However, the CFP is not just a matter for those with an economic interest in fisheries. It also raises many issues of more general concern, such as the capacity of the EC and its Member States to manage important natural resources sustainably, the impact of fishing on the wider marine environment, and relations between developed and developing States. This book addresses the CFP from a legal perspective. It provides a detailed account of the very large body of EC law comprising the CFP, and draws on the European Commission's associated documents to aid interpretation and add context. As a result, the book will be of value to anyone wanting knowledge of the law of the CFP. Although not addressing the Commission's 2009 Green Paper on reform of the CFP, the book should provide a useful reference point against which to view the reform of parts of the CFP that is anticipated to take place over the next few years.
