Book excerpt: Bankruptcy law is developing rapidly in the countries of Central and Eastern Europe (CEE) that have recently escaped the domination of the Union of Soviet Socialist Republics (USSR). The communist governments fell in those countries that were separate from the USSR in 1989, and those countries that were a part of the USSR gained their independence and acquired new non-communist governments in 1989 (the Baltic states) and 1991 (Ukraine, Belarus, Moldova, and Russia). While many other areas of law that are basic to the development of a market economy need substantial development or revision, bankruptcy law is leading the way, for the most part, in all of these countries.However, the legal structures and economic conditions in the CEE countries are quite different from those in the United States and, in consequence, pose unique problems for the application of bankruptcy law. The most important difference is the process of privatization of state-owned enterprises, in which bankruptcy law has a unique and important role. This Article explores those legal structures and economic conditions and discusses their implication for bankruptcy law in these countries.This Article is based principally on that I have learned from my experience teaching seminars on bankruptcy law (and other subjects) in the CEE countries and in advising various government officials on bankruptcy law and other commercial law. It also draws to a certain extent on conversations with colleagues who have taught seminars similar to those that I have taught in the region.

Book excerpt: The last quarter century has been marked by the ascension of neoliberalism--market deregulation, state decentralization, and reduced political intervention in national economies. Not coincidentally, this period of dramatic institutional change has also seen the emergence of several schools of institutional analysis. Though these schools cut across disciplines, they have remained isolated from and critical of each other. This volume brings together four--rational choice, organizational, historical, and discursive institutionalism--to examine the rise of neoliberalism. In doing so, it makes tremendous methodological strides while substantively enlarging our knowledge about neoliberalism. The book comprises original empirical studies by top scholars from each school of analysis. They examine neoliberalism's rise on three continents and explore changes in macroeconomic policy, labor markets, taxation, banking, and health care. Neoliberalism appears as much more complex, diverse, and contested than is often appreciated. The authors find that there is no convergence toward a common set of neoliberal institutions; that neoliberalism does not incapacitate states; and that neoliberal reform does not necessarily yield greater efficiency than other institutional arrangements. Beyond these important empirical contributions, this book is a methodological milestone in that it compares different schools of institutionalist analysis by seeing how they tackle a common problem. It reveals a second movement within institutionalism--one toward rapprochement and cross-fertilization among paradigms--and explains how this might be furthered with benefits throughout the social sciences. Book excerpt: The past 25 years have seen a dramatic transformation in Europe’s former communist countries, resulting in their reintegration with the global economy, and, in most cases, major improvements in living standards. But the task of building full market economies has been difficult and protracted. Liberalization of trade and prices came quickly, but institutional reforms—such as governance reform, competition policy, privatization and enterprise restructuring—often faced opposition from vested interests. The results of the first years of transition were uneven. All countries suffered high inflation and major recessions as prices were freed and old economic linkages broke down. But the scale of output losses and the time taken for growth to return and inflation to be brought under control varied widely. Initial conditions and external factors played a role, but policies were critical too. Countries that undertook more front-loaded and bold reforms were rewarded with faster recovery and income convergence. Others were more vulnerable to the crises that swept the region in the wake of the 1997 Asia crisis.
