Updated as of May 29, 2018 In this document, the Federal Communications Commission ("FCC" or "Commission") revises its rules to: require prior express written consent for all autodialed or prerecorded telemarketing calls to wireless numbers and for prerecorded calls to residential lines and, accordingly, eliminate the established business relationship exemption for such calls to residential lines while maintaining flexibility in the form of consent needed for purely informational calls; require all prerecorded telemarketing calls to allow consumers to opt out of future prerecorded telemarketing calls using an interactive, automated opt-out mechanism; and limit permissible abandoned calls on a per-calling campaign basis, in order to discourage intrusive calling campaigns. The Commision also exempts from its telemarketing requirements prerecorded calls to residential lines made by health care-related entities governed by the Health Insurance Portability and Accountability Act of 1996. Taken together, today's actions offer consumers greater protection from intrusive telemarketing calls and protect consumers from unwanted autodialed or prerecorded telemarketing calls to wireless numbers and from unwanted prerecorded telemarketing calls to residential lines, also known as "telemarketing robocalls," and maximize consistency with the analogous Telemarketing Sales Rule ("TSR") of the Federal Trade Commission ("FTC"), as contemplated by the Do-Not-Call Implementation Act ("DNCIA") in a way that reduces industry confusion about telemarketers' obligations and does not increase compliance burdens for most telemarketers. Book excerpt: The Telephone Consumer Protection Act of 1991 (TCPA) subjects a telemarketer's use of autodialed telephone calls, automated text messages, and faxes to statutory damages of $500 per violation or up to $1,500 per willful violation. Depending on the circumstances of the violating communication, the TCPA's penalties can exceed by orders of magnitude any plausible economic estimate of the recipient's actual harm, such that the TCPA, as applied, likely violates the Due Process Clause of the Fifth Amendment.A violating communication causes actual harm of between 6.8 cents and 70.7 cents per violating communication, depending on the communication channel used. The remainder of the TCPA's statutory damages is purely punitive. The punitive component of the TCPA's statutory damages is between 706 and 22,058 times the total actual damages that a violating communication imposes. That multiplier can vary significantly according to the specific circumstances of the violating communication. Given the Supreme Court's jurisprudence on punitive damages, lower courts must take seriously the possibility that the TCPA's statutory damages violate the Due Process Clause of the Fifth Amendment as applied.

The Telephone Consumer Protection Act was enacted by Congress in 1991 to fill a gap in state consumer protection statutes relating to auto-dialing technology, unsolicited “robo-calls”, and abusive telemarketing practices. The appeal in Mims focuses on language in the statute that provides: “A person or entity may, if otherwise permitted by the laws of rules of a State, bring an action in an appropriate state court.” The Court will decide whether the statutory language requires private TCPA lawsuits to be brought in state court only, divesting federal courts of jurisdiction, or whether the statutory language permits individuals to bypass state courts and pursue TCPA violations in federal court.Although the Mims appeal does not involve a class action but rather an individual lawsuit, the Court's decision may have implications for TCPA class action litigation. During the past decade, federal and state courts have entertained a wave of so-called “blast fax” class actions for alleged violations of the TCPA. While some states have allowed certification of TCPA claims, other states have rejected this. Federal courts that have entertained TCPA class actions in their diversity jurisdiction have split regarding whether such cases can be certified under Federal Rule 23.At oral argument on November 28, 2011, Chief Justice Roberts Jr. characterized the TCPA as “the strangest statute I have ever seen,” and Justice Samuel Alito deemed it “the oddest creature.”
