Book excerpt: A groundwater management district organized pursuant to K.S.A. 82a-1020 e̲t̲ s̲e̲q̲., is required, pursuant to K.S.A. 82a-1026, to hold annual meetings for the purpose of electing members of the board of directors. Only persons who are defined as eligible voters by K.S.A. 82a-1021(e) may vote or serve as directors, and the district may if it chooses require voters to complete affidavits attesting to their eligibility. Such affidavits showing that the person is an eligible voter are subject to the Kansas Open Records Act, K.S.A. 1984 Supp. 45-215 e̲t̲ s̲e̲q̲., and are not included under any of the provisions of K.S.A. 1984 Supp. 45-221 which allow certain records to be closed. They should therefore be disclosed, subject to the other provisions of the act. However, a previous conviction in another state must be considered in determining whether diversion of a defendant is in the interest of justice. Book excerpt: An entity created by action of a city, a county and a chamber of commerce (which is not itself subject to either the Kansas Open Records Act or the Kansas Open Meetings Act) may be subject to both such acts if certain requirements are met. In the case of the Kansas Open Records Act (KORA), K.S.A. 45-215 e̲t̲ s̲e̲q̲., the entity must be supported by public funds in whole or in part. While an exception exists for the mere provision of goods or services, an entity which is established by a city and county and to which they appoint members, and which has the task of performing functions they assign, is a public agency for the purposes of KORA. Records concerning the prospective location of a business in the area may or may not be subject to disclosure, depending on whether the requirements of K.S.A. 1985 Supp. 45-221 have been met. The Kansas Open Meetings Act (KOMA) applies if the entity is subordinate to a legislative or administrative agency of the state, and is supported in whole or in part by public funds. In the case of an entity which has a majority of its members appointed by a city and a county, which is charged with the performance of duties which would otherwise be done by the units of government themselves, and which receives funding from such governments, the tests are satisfied and KOMA applies. Questions involving the prospective location of a business in the area may be discussed in executive session only as they concern the acquisition of real property or confidential data relating to the financial affairs of the business. Book excerpt: K.S.A. 12-4415(b), as amended by L. 1985, ch. 48, section 1, sets forth factors which a city prosecutor must consider in determining whether a person is eligible for diversion for the offense of driving while under the influence of alcohol. One of the factors which precludes the offering of diversion is the occurrence of an accident involving personal injury at the time of the offense. Given the lack of any legislative language to the contrary, such personal injury may be to either the defendant or another passenger, driver or third-party. In that the legislature intended to restrict a prosecutor's discretion in the offering of diversion to DUI offenders, even minor injuries not involving hospitalization are sufficient to preclude the use of diversion, which itself is a privilege and not a right. Book excerpt: K.S.A. 48-929 requires each county in this state to maintain a disaster agency responsible for emergency preparedness and coordination of response to disasters. Such agencies are required to prepare a disaster emergency plan for the area under their jurisdiction. In addition, local disaster agencies are required to prepare and distribute to all local officials a clear and complete statement of those officials' responsibilities in implementing such a plan. Although a disaster emergency plan is not formally activated until a declaration of disaster is accomplished according to law, there are some aspects of such a plan which must be carried out before a formal declaration of disaster. In our opinion, the emergency responsibilities of a local official under an appropriate disaster emergency plan may include certain acts which, of necessity, precede a formal declaration of a state of disaster emergency. Book excerpt: Under the provisions of K.S.A. 75-6116 (as amended by L. 1985, ch. 293, 11), the obligation of a city to pay attorneys fees incurred by a city officer in defending a civil rights action is subject to the conditions and limitations prescribed by K.S.A. 75-6108. Those conditions include the filing of a written request (within 15 days after service of process upon the employee) that the city provide for the defense of the employee. K.S.A. 75-6108(d) and (e). Where no such request is filed, a city is not liable for attorneys fees incurred by the employee; however, the city governing body may, in its discretion, pay attorneys fees notwithstanding the failure to file a written request. Book excerpt: The Reports of the decisions of the Kansas Supreme Court and Court of Appeals may be copyrighted as compilations. However, any such copyright cannot cover the opinions of the judges and justices or other material prepared by them in the discharge of their judicial duties. The copyright protection afforded the Reports is limited to the Appellate Reporter's own work and labor in the production of the Reports. The publication of advance sheets without copyright notice under copyright laws existing prior to January 1, 1978, resulted in forfeiture of the copyright on the material contained therein, which cannot be revived by subsequent publication in copyrighted volumes of the Reports. However, the publication of advance sheets without copyright notice after that date under current copyright laws does not constitute a forfeiture, and the works are protected from infringement as long as they are properly registered within five years after first publication. Neither one of these circumstances affects the validity of the copyright of the Reports as a compilation of preexisting material, but the copyright can only cover new and original material contributed by the reporter. The use made of the Reports by West Publishing Company and K-Bar Research, Inc., pursuant to licensing agreements, has not resulted in forfeiture of the copyright protection afforded the Reports. Book excerpt: K.S.A. 1984 Supp. 25-2108a(b) prescribes the conditions under which a city utilizing non-partisan elections must hold a primary election. The statute on its face is uniformly applicable to all cities, and is contained in an act (L. 1982, ch. 157) which is also uniform. K.S.A. 25-2113, which is contained in a different act, sets forth a general rule for non-partisan city elections, but also contains a provision for partisan city elections in Johnson County. The inclusion of this provision renders K.S.A. 25-2113 non-uniform, and thereby subject to a charter ordinance under a city's home rule authority. However, in the absence of such an ordinance which would allow partisan elections, the general provisions of K.S.A. 1984 Supp. 25-2108a concerning primary elections continue to apply. Ed. 2d 147 (1973), permits a state to regulate or even prohibit abortion after the stage of viability, except where it is necessary, in appropriate medical judgment, to preserve the life or health of the mother. Such regulations must be narrowly tailored to fit the precise state interest at stake. As a result, attempts to specify a particular time during a pregnancy when viability occurs or to interfere with the judgment of the attending physician have been struck down as unconstitutional, although general prohibitions on post-viability abortions have been upheld.
