Book excerpt: Kansas is a member state in the Interstate Compact on Mental Health by the terms of K.S.A. 65-3101, which incorporate the compact into Kansas statutes. Part of the compact concerns the escape of dangerous or potentially dangerous patients from institutions in any state party to the compact. Upon the capture and identification of such patients, they are to be detained until they can be returned to the state in which they were committed. In this specific circumstance, the provisions of K.S.A. 59-2901 et seq., relating to orders for protective custody and commitment, do not apply, and the patient may be held without such proceedings prior to return to the state from which he escaped. Book excerpt: Neither attachment nor garnishment of wages held by the Board of Public Utilities, and due its employees, is available to the Board for the purpose of recovering unpaid utility bills due the Board from those employees, because it is impermissible for an aggrieved party to attach or garnish wages it holds for its own employees. A fundamental right of every creditor is that of set-off. The Board of Public Utilities is, therefore, entitled to exercise the right of set-off as a remedy to recover unpaid utility bills from the sums it owes employees in the form of wages. Since "state action" exists, such right must be exercised in accordance with the dictates of the "due process clause" of the Fourteenth Amendment to the United States Constitution. Book excerpt: An attorney, appointed to represent an indigent defendant under the Kansas Indigent Defense Services Act, may accept compensation for such services from private sources as long as the attorney complies with the Act's requirements regarding such compensation. The Act requires the appointed attorney to report to the court the availability of private funds sufficient to fully pay for representation of a defendant and to seek permission to either withdraw from the case or to accept compensation. K.S.A. 1982 Supp. 22-4507 requires an attorney to report any partial compensation received to the Board of Indigents Defense Services when he or she submits a claim for compensation under the Act. K.S.A. 1982 Supp. 22-4510 does not prohibit the acceptence of such compensation as long as the attorney acts as authorized or directed under the Act. Book excerpt: For purposes of civil proceedings under the Code for Care of Children, the legislature defined types of behavior which would constitute sexual abuse by reference to sex offenses in the criminal code, however, it did not thereby intend to adopt a criminal definition of sexual abuse. Thus, while certain acts described as sex offenses in the criminal statutes may not be punishable crimes if committed with a child age 16 years or older; those same acts may constitute abuse of that child under the definition of that term in the Code for Care of Children. Book excerpt: The failure of county voters to approve a proposition to issue general obligation bonds of the county pursuant to subsection (c) of K.S.A. 1985 Supp. 19-15,116 to finance construction of a new county jail does not effect the exercise of the authority granted to the board of county commissioners in subsection (d) of the same statute. Thus, the board of county commissioners may continue to levy a tax authorized by a resolution adopted pursuant to subsection (d) to create a building fund for a new county correctional facility. Similarly, the board of county commissioners may issue general obligation bonds of the county, as authorized by subsection (d), for the same purpose. In subsections (c) and (d) of K.S.A. 1985 Supp. 19-15,116 the legislature has given Kansas counties two separate authorizations for the issuance of general obligation bonds to finance the construction and improvement of county public buildings. The failure of a prerequisite election under subsection (c) does not prevent the county from issuing duly authorized bonds for the same purpose under subsection (d). In subsection (d) the legislature has given a board of county commissioners due authority to issue general obligation bonds of the county, as limited therein, without submitting the proposition to a vote of the county electorate. Such an amendment must, in order to have effect, be transmitted to and approved by the legislature in the same manner as water purchase contracts. Book excerpt: A city ordinance which purports to authorize "independent contractors" to exercise the sovereign power of the city is contrary to statewide public policy, and is void. However, individuals who act as city attorney and municipal judge, under such an ordinance, are d̲e̲ f̲a̲c̲t̲o̲ officers of the city, and their acts are valid insofar as they involve the public and third parties. Additionally, the legal and judicial services provided by said individuals constitute "employment," as said term is defined in the Old Age and Survivors Insurance Act, and social security contributions are payable by the city with respect to remuneration paid for such services. Book excerpt: Section 4(d) of 1983 House Bill No. 2327 (L. 1983, ch. 171), the new Kansas Open Records Act, provides that each request for access shall be acted upon as soon as possible, but not later than three business days following receipt of the request. Only if the request cannot be met within this time must the custodian of the records provide an explanation of the cause for further delay. In addition, the phrases "provide access to" and "permit inspection of" are used interchangeably throughout the bill, and may accordingly be treated as synonymous for purposes of interpretation.
