Attendance at the workplace is instead an employer choice of location, and so should be categorically excluded from the essential functions analysis for employment discrimination claims under the Americans with Disabilities Act (ADA). When plaintiffs seek to pursue an employment discrimination claim they are burdened with proving their disability and proving that they can perform the essential functions of their position. Employers are burdened with proving the functions they deem essential are indeed essential and establishing an affirmative defense if an accommodation is available and it causes them an undue hardship because of significant difficulty or expense.2 Employees pursuing a remote work accommodation struggle to establish their ability to perform the essential functions while also establishing that it is reasonable to work remotely when employers assert that attendance at the workplace is an essential function. Categorically excluding attendance from the essential functions analysis and instead shifting the burden to employers to prove the undue hardship defense is both permissible and advised under the existing employment discrimination framework.
