Book excerpt: The document contains the final report of a project to determine the factors that account for disproportionate representation of minority students in special education programs, especially programs for mentally retarded students; and to identify placement criteria for practices that do not affect minority students disproportionately. Chapter 1 looks at six potential causes of disproportionate placement of minorities in educable mentally retarded (EMR) programs: legal and administrative requirements, characteristics of students, quality of the instruction received, possible biases in the assessment process, characteristics of the home and family environment, and broader historical and cultural contexts. Chapter 2 describes characteristics of EMR students, then reviews the historical origins of special education in America with attention to the role of the standardized intelligence test for identification and placement of mentally retarded students. A third chapter is split into two sections--one on the issues surrounding the instruments that comprise a comprehensive battery for assessing a child who is unable to learn normally in the classroom, and the other on an ideal assessment process in which the comprehensive assessment would be embedded. Chapter 4 considers the components of effective education programs for EMR students and reviews three approaches to instruction (the separate class structure, the resource room, and the teacher consultant model). A final chapter lists recommendations for improvements in special education referral, assessment, and placement procedures and instructional practices. Part 2 discusses legal standards that require nondiscrimination in the assessment, classification, and placement of children with disabilities and reviews existing case law. Part 3 emphasizes the need to distinguish between different ways to analyze program representation statistics and notes that some of the problems of disproportionate minority representation arise from misunderstandings of these statistics. Part 4 reviews a variety of criteria and guidelines for analysis and decision-making. Part 5 looks at the prevention of disproportionate minority representation through court orders, reevaluation projects, the use of alternative criteria and assessment procedures, and prereferral intervention. Part 6 considers possible ways to change the acceptability and ensure the effectiveness of special education. Book excerpt: This book surveys the exclusion of students with disabilities from obtaining an appropriate education in the early history of the nation to the current time. It finds that in spite of the tireless efforts of parents, advocates, court legislations and federal mandates, students with disabilities especially minority students and second language learners, still continue to be deprived of an appropriate education. Research conducted in a mid-sized urban school district in Southern California found that teachers recommendation of minority students and second language learners for special education referral was not in compliance with state and federal mandates. Even though there was an honest effort by both federal and state governments to improve the quality of education for children with disabilities this was not occurring at the school level. They still continue to be deprived of the opportunity for an education in the regular education setting and become candidates for referral to special education.
