Book excerpt: After the collapse of the Soviet bloc, there are only five socialist or communist countries left in the world – China, Cuba, Laos, North Korea, and Vietnam – which constitute about one-quarter of the world’s population. Yet, there is little scholarship on their constitutions. These countries have seen varying socioeconomic changes in the decades since 1991, which have led in turn to constitutional changes. This book will investigate, from a comparative and interdisciplinary perspective, how and why the constitutional systems in these five countries have changed in the last three decades. The book then breaks the constitutional changes down into four questions: what are the substantive contents of constitutional change, what are the functions, what are the mechanisms, and what are the driving forces? These questions form a framework to process the changes the five countries have gone through, such as making new constitutions, amending current ones, introducing more rights, allowing citizens to engage in changes, enacting legislation, and defining the constitutional authority of the three state branches and their relationship with the Communist Party. While all five countries have adapted their constitutional systems, the degree, mechanisms, and influential factors are not identical and present considerable variations. This book examines and explores these differences and how they developed. Constitutional Change in the Contemporary Socialist World offers a comprehensive and holistic view of an understudied and overlooked area of constitutional law, essential for anyone studying or working in law, politics, or policy.

The volume studies legal historians and legal histories written in Eastern European countries during the socialist era after the Second World War. The book investigates whether there was a unified form of socialist legal historiography, and if so, what can be said of its common features. The individual chapters of this volume concentrate on the regimes that situate between the Russian, and later Soviet, legal culture and the area covered by the German Civil Code. Hence, the geographical focus of the book is on East Germany, Russia, the Baltic states, Poland and Hungary. The approach is transnational, focusing on the interaction and intertwinement of the then hegemonic communist ideology and the ideas of law and justice, as they appeared in the writings of legal historians of the socialist legal orders. Such an angle enables concentration on the dynamics between politics and law as well as identities and legal history. Studying the socialist interpretations of legal history reveals the ways in which the 20th century legal scholars, situated between legal renewal and political guidance gave legitimacy to, struggled to come to terms with, and sketched the future of the socialist legal orders. But as radicalized Chinese youth rose up against Party officials, events quickly slipped from the government's grasp, and rebellion took on a life of its own. Turmoil became a reality in a way the Great Leader had not foreseen. The Cultural Revolution at the Margins recaptures these formative moments from the perspective of the disenfranchised and disobedient rebels Mao unleashed and later betrayed. The Cultural Revolution began as a "revolution from above," and Mao had only a tenuous relationship with the Red Guard students and workers who responded to his call. Yet it was these young rebels at the grassroots who advanced the Cultural Revolution's more radical possibilities, Yiching Wu argues, and who not only acted for themselves but also transgressed Maoism by critically reflecting on broader issues concerning Chinese socialism. As China's state machinery broke down and the institutional foundations of the PRC were threatened, Mao resolved to suppress the crisis. Leaving out in the cold the very activists who had taken its transformative promise seriously, the Cultural Revolution devoured its children and exhausted its political energy. The mass demobilizations of 1968-69, Wu shows, were the starting point of a series of crisis-coping maneuvers to contain and neutralize dissent, producing immense changes in Chinese society a decade later.
