It argues the inclusive approach currently employed by ASEAN to set up a human rights body covering all member states cannot produce a strong regional human rights mechanism. The mosaic of Southeast Asia reveals great diversity and high complexity in political regimes, human rights practice and participation by regional states in the global legal human rights framework. Cooperation among ASEAN members to protect and promote human rights remains limited. The time-honored principle of non-interference and the “ASEAN Way” still predominate in relations within ASEAN. These factors combine to explain why the ASEAN Intergovernmental Commission on Human Rights is unlikely to be strong and effective in changing and promoting regional human rights protection.

Book excerpt: The Chinese Exclusion Act of 1882, which barred practically all Chinese from American shores for ten years, was the first federal law that banned a group of immigrants solely on the basis of race or nationality. By changing America's traditional policy of open immigration, this landmark legislation set a precedent for future restrictions against Asian immigrants in the early 1900s and against Europeans in the 1920s. Tracing the origins of the Chinese Exclusion Act, Andrew Gyory presents a bold new interpretation of American politics during Reconstruction and the Gilded Age. Rather than directly confront such divisive problems as class conflict, economic depression, and rising unemployment, he contends, politicians sought a safe, nonideological solution to the nation's industrial crisis--and latched onto Chinese exclusion. Ignoring workers' demands for an end simply to imported contract labor, they claimed instead that working people would be better off if there were no Chinese immigrants. By playing the race card, Gyory argues, national politicians--not California, not organized labor, and not a general racist atmosphere--provided the motive force behind the era's most racist legislation.

Book excerpt: Balancing the Tides highlights the influence of marine practices and policies in the unincorporated territory of American Sāmoa on the local indigenous group, the American fishing industry, international seafood consumption, U.S. environmental programs, as well as global ecological and native concerns. Poblete explains how U.S. federal fishing programs in the post–World War II period encouraged labor based out of American Sāmoa to catch and can one-third of all tuna for United States consumption until 2009. Labeled "Made in the USA," this commodity was sometimes caught by non-U.S. regulated ships, produced under labor standards far below continental U.S. minimum wage and maximum work hours, and entered U.S. jurisdiction tax free. The second half of the book explores the tensions between indigenous and U.S. federal government environmental goals and ecology programs. Whether creating the largest National Marine Sanctuary under U.S. jurisdiction or collecting basic data on local fishing, initiatives that balanced western-based and native expectations for respectful community relationships and appropriate government programs fared better than those that did not acknowledge the positionality of all groups involved. Despite being under the direct authority of the United States, American Sāmoans have maintained a degree of local autonomy due to the Deeds of Cession signed with the U.S. Navy at the turn of the twentieth century that created shared indigenous and federal governance in the region. Balancing the Tides demonstrates how western-style economics, policy-making, and knowledge building imposed by the U.S. federal government have been infused into the daily lives of American Sāmoans. American colonial efforts to protect natural resources based on western approaches intersect with indigenous insistence on adhering to customary principles of respect, reciprocity, and native rights in complicated ways. Experiences and lessons learned from these case studies provide insight into other tensions between colonial governments and indigenous peoples engaging in environmental and marine-based policy-making across the Pacific and the globe. This study connects the U.S.-American Sāmoa colonial relationship to global overfishing, world consumption patterns, the for-profit fishing industry, international environmental movements and studies, as well as native experiences and indigenous rights. Book excerpt: The sociopolitical climate of Hawai‘i has changed substantially in recent decades, and archaeologists working to decipher the islands’ past are increasingly faced with a complexity of issues involving Kanaka Maoli (Native Hawaiian) concerns. Among these are the push for sovereignty; cultural perpetuation and revitalization; legal challenges to Kanaka Maoli programs, such as Hawaiian Home Lands and the Office of Hawaiian Affairs; and compliance with the Native American Graves Protection and Repatriation Act (NAGPRA). In Kuleana and Commitment, Kathleen L. Kawelu examines the entangled interactions between Kanaka Maoli and archaeologists in Hawai‘i by conducting an ethnographic investigation of the discipline of archaeology itself. She explores the development of Hawaiian archaeology, discusses important cases of the recent past, and focuses on the interpersonal relationships between these two key groups involved in heritage management in Hawai‘i. By revealing and understanding the contemporary attitudes of Kanaka Maoli and archaeologists toward each other, Kawelu suggests a change in trajectory toward a more collaborative approach in practicing Hawaiian archaeology. Through interviews with individuals from both communities, Kawelu taps into collective narratives that reveal two overarching themes. The first narrative speaks about the continuation of Kanaka Maoli cultural practices and beliefs, for example, kuleana (responsibility); the second speaks about the kind of commitment to Hawaiian archaeology and Kanaka Maoli descendants that is desired from archaeologists. Requests for respect, communication, and partnership are heard in the narratives. These same qualities also serve as the foundation for community-based archaeology, which challenges the exclusive access of archaeologists to the past and places the discipline and its practitioners among a broader group of stakeholders, particularly descendant communities.
