In reference to two of the most prominent, against the organizers of the exhibitions 'Caution, Religion!' and 'Forbidden Art 2006', the author examines the ways in which the meaning of art and its socio-political effects are argued in court: How do these trials attempt to establish a normative concept of art, and furthermore a binding juridical understanding of art? How is the discussion of what is permissible in art being framed in Russia today? Research into the post-Soviet art trials has been mainly journal-driven until today. Only the fairly recent trials of the Pussy Riot activists and Pyotr Pavlensky provoked lengthy publications, but these are mostly concerned with explicitly political and activist art rather than its particular discourse when on trial. This book, however, takes a scholarly approach towards (Russian) art on trial. It puts the cases in a national-historical context, which is compared from international perspectives, and particularly focuses on the way in which these proceedings have intensified juridical power over artistic freedom (of speech) in the production of art in Russia. This book will appeal to academics and students in the areas of art history, cultural science, sociology, and Slavic studies, as well as jurists, curators and museum specialists, researchers and employees in cultural institutions.

It offers an integrated presentation of procedures and processes that allow analysts and experts to think clearly about numbers, particularly the inputs for decision support systems and models. This presentation encompasses research originating in the communities of structured probability elicitation/calibration and multi-criteria decision analysis, often unaware of each other’s developments. Chapters 2 through 9 focus on processes to elicit uncertainty from experts, including the Classical Method for aggregating judgements from multiple experts concerning probability distributions; the issue of validation in the Classical Method; the Sheffield elicitation framework; the IDEA protocol; approaches following the Bayesian perspective; the main elements of structured expert processes for dependence elicitation; and how mathematical methods can incorporate correlations between experts. It stresses differences between artworks and other things; and locates the understanding of artworks both in a narrative of the history of art and in the institutional practices of the art world. Hence its distinctiveness lies in its strong account of the difference between, on the one hand, the judgement and appreciation of art and, on the other, the judgement and appreciation of all the other things in which we take an aesthetic interest. For only by acknowledging this contrast can one do justice to the importance regularly ascribed to art. The contrast is explained by appealing to an occasion-sensitive account of understanding, drawn from Charles Travis directly, but with Gordon Baker (and Wittgenstein) as also proximate rather than remote. On this basis, it argues, first, that we need to offer accounts of key topics only as far as questions might be raised in respect of them (hence, not exceptionlessly); and, second, that we should therefore defend the view that the meaning of artworks can be changed by later events (the historical character of art, or forward retroactivism) and that art has an institutional character, understood broadly on the lines of Terry Diffey’s Republic of Art. Besides providing a general framework, Artistic Judgement also explores the applications of the ideas to specific artworks or classes of them.

It comes in many guises: a musical hook, a financial strategy, a striptease, a novel of ideas. Above all, acclaimed theorist Sianne Ngai argues, the gimmick strikes us both as working too little (a labor-saving trick) and as working too hard (a strained effort to get our attention).
