Hall, Esq, gave a Similar judgment in his Lords Baltimore, at p. 61, thus Throughout, Cecilius seems never to have lost courage and, under all circumstances, he bore himself With wisdom, patience, forbearance, and tact and, by these qualities, he tri umphed in the end. His own interests and his own authority, he carefully guarded, but at the same time, he as carefully sought the welfare of the Province and of the people, who were in a sense his subjects, and when con cessions seemed reasonably demanded, he knew how and when to yield and SO exercised a much less autocratic power than was conferred by the terms of the charter from which his authority was derived. These estimates coincide with the opinion of the present editor. With the period now begun in this volume, the student of Maryland History loses the wise guidance of John Leeds Bozman, the first historian of Maryland, whose remarkable work closes at this date. A new period had been reached, new questions arose, new conditions of living were experienced, the separation of Maryland from Virginia was certain, and thirty years followed before Balti more's power in the Province should again be overthrown. The Province no longer had only two centres of life; but Shores of the Chesapeake were becom ing dotted with plantations and the tobacco ships penetrated nearly every river and estuary which was tributary to the Bay. Lord Baltimore was to reap the fruit of his labors and his descendants should gain a rich return from the Province which he had founded and over which he had resumed his rule. It is a toilsome task to work one's way through the volumes of Proceedings to the Assembly, but unless such work is successfully prosecuted by students with a kindly feeling toward the participants in the discussions we cannot have impartial history. No. 4 (1711 L. No. 5 (1724 H. S. (1752 and R. G. (1769 the last also containing the laws passed by the State Assembly in 1777 and several following years. Liber B. L. C. (1731 - 1752) was also found in the Land Office and all these volumes were transferred to the vault Of the Maryland Historical Society, with the prompt cooperation of their former custodians, under the provisions Of the Act of 1882, ch. 138. It has thus been possible to print. For the first time in this volume, the private acts passed from 1730 to 1732, as these were not included in' the contemporary printing of the Session Laws, Unfortunately, the printing of the volume had so far progressed that it was necessary to place the private acts Of 1730 in an appendix. It is expected to print, in volume 38 of the Archives, all acts hitherto not included in the series. From 1711 to 1729, and hereafter to publish all the acts of each session in their proper place. We Shall thus possess the complete corpus Of the Provincial statute laws of the Eighteenth Century, which fact is one which must cause considerable pleasure to every lover of the history Of Maryland. In these cataclysmic times, it is often a delight to divert one's thoughts to the affairs of a quieter and Simpler age and the picture of that age is now more complete, because of the ability to read the entire enactment Of each session Of the legislature. The private acts, which generally relate to naturalization of individuals, and to the correction of defects in deeds and wills, are Of considerable value for deciding questions Of pedigree and title to land. Book excerpt: Excerpt from Archives of Maryland: Judicial and Testamentary Business of the Provincial Court; 1637 1650 The Provincial Court at St. Mary's was the chief judicial body in the Province, being not only a court of first instance for all matters civil, criminal, and testamentary for the city and county of St. Mary's, but having also appellate jurisdiction over the county courts. It was com posed, during the years embraced in this volume, of the Governor as presiding judge, and one or more of the members of the Council as associate judges. In the absence of the Governor, the councillor next in commission presided. The judges were sworn to give judgment according to the laws of the Province, and were disabled from sitting in cases in which they were personally interested. During these years the Province was so Sparsely settled, that we are justified in surmising that nearly all the judicial business was brought, in one form or another, before the Provincial Court. Unfortunately, the record is not complete, the part from February, 1644/ 5. To May, 1647, being lost; for which we may probably thank Ingle and his brigands. While the contents of this volume cannot have the same general interest as the records of the Assembly and Council, there is much in them worthy of attention by students of Maryland's early history and institutions, who may here note how laws and principles of law that had grown up under very different conditions were adapted without violence to the needs of the infant colony. One feature that cannot be overlooked is the singular absence Of crimes of violence. Leaving out of view the little sea-fight at Poco moke, the Offences against the person consist of two homicides and one (unproved) battery. In the case of the homicides, both the victims were Indians; and it is interesting to see how careful the court was to allow no partiality to interfere with justice, a jury who doubted whether pagans had the same standing in the court as Christians being promptly dismissed and a new trial ordered. The process against Lewis and others (p. 35) shows that offensive speeches and unreasonable disputations about religion had been for bidden by public proclamation more than eleven years before the passing of the Act concerning Religion. We find also here (p. 189) the first reference to the importation of negro slaves, and (p. 304) perhaps the first recorded purchase of negroes. Probably the solitary recorded instance of a deodand occurs on p. 10. The custom of the country, as it was called, or the outfit that a master was legally bound to give his servant at the expiration of his term of service, is here (pp. 361, 470) judicially defined.
