Book excerpt: La enseñanza de la teoría del Derecho cuenta ya con una cierta tradición en los planes de estudio de las facultades de Derecho, aun cuando con ese nombre no haya figurado en los mismos hasta época reciente. Junto a las diferentes dogmáticas, que tienen por objeto el estudio del Derecho positivo vigente, la teoría del Derecho pretende alcanzar un mayor nivel de abstracción, dando cuenta de la estructura y funcionamiento de los sistemas jurídicos en general o, cuando menos, de la fisonomía que presentan tales sistemas en el marco de la cultura jurídica moderna. Con todo, y al margen de que tal vez no resulte posible ni deseable una nítida y absoluta separación entre teoría y dogmática, el propósito docente que anima estas páginas constituye una razón suplementaria para haber intentado ofrecer una construcción atenta a las concretas determinaciones del Derecho positivo. Por eso, sin abdicar del enfoque y de las preocupaciones que caracterizan a la teoría del Derecho, se ha procurado siempre contrastar sus aportaciones en el banco de pruebas del sistema normativo hoy vigente, que al fin y al cabo representa el objeto fundamental de conocimiento para nuestros estudiantes. Estos Apuntes quieren ser una aportación más, y sin duda, como ya anuncia su título, una de las más modestas, a la consolidación de una cierta forma de entender la teoría del Derecho que ha conocido un indiscutible desarrollo en la literatura jurídica de los últimos tiempos; una teoría elaborada desde la filosofía jurídica, pero que ha renunciado a la vieja ilusión de construir modelos ideales por completo desconectados de la realidad y de lo que constituye el punto de referencia insoslayable de toda reflexión sobre el Derecho.
