Moreover, he is known to be an extremely gifted lecturer, who is able to set forth ethical issues very lucidly. His erudition and profundity are also evident in the two texts that are central to this book, i.e. 'The Problem of the Foundation of Moral Philosophy' and 'Can Forgiveness Heal?' These lectures constitute a remarkable effort on the part of Ricoeur to find an original and more radical foundation of ethics than can be expressed in any law. He demonstrates quite convincingly why the law is not the primary category of ethics. He further deals with the question of what might be the evangelical orientation of ethics. Finally, he sheds light on the specific role of forgiveness. The two lectures by Ricoeur, which have been translated here from French into English, and to which an introduction and three multi-disciplinary commentaries have been added, not only elucidate a fundamental question in the field of ethics, but, in a more general sense, they are also fine examples of philosophical reasoning.

A consequence of practicability is that law requires elaborated and explicit methodologies that determine how to do things with norms. This consequence forms the core idea behind this book, which employs methods from legal theory to inform and examine debates on methodology in applied ethics, particularly bioethics. It is argued that almost all legal methods have counterparts in applied ethics, which indicates that much can be gained from comparative study of the two. The author first outlines methods as used in legal theory, focusing on deductive reasoning with statutes as well as analogical reasoning with precedent cases. He then examines three representative kinds of contemporary ethical theories, Beauchamp and Childress’s principlism, Jonsen and Toulmin’s casuistry, and two versions of consequentialism—Singer’s preference utilitarianism and Hooker’s rule-consequentialism—with regards to their methods. These examinations lead to the Morisprudence Model for methods in applied ethics.

Book excerpt: Günther's book demonstrates that most objections to moral and legal principles are directed not against the validity of principles but against the manner of their application. If one distinguishes between the justification of a principle and its appropriate application, then the claim that the application of the principle in each individual case follows automatically from its universal justification proves to be a misunderstanding. Günther develops this distinction with the help of Habermas's discourse theory of morality. He then employs it to extend Kohlberg's theory of moral development and to defend this against Gilligan's critique. In the third and fourth parts of the book, Günther shows--in debate with Hare, Dworkin, and others--how argumentation on the appropriate application of norms and principles in morality and law is possible.
