Book excerpt: Incitement to terrorism connects the dots between evil words and evil deeds. Hate precedes terror. History has already taught us that incitement to genocide and to crimes against humanity unchecked will inevitably bring devastation to humankind. Incitement is an affront to the dignity of its victims, and poses a dire threat to all people of good will. However, combating incitement to terrorism poses operational, constitutional and human rights challenges on many fronts, both domestically and internationally. What is incitement? Where should the line be drawn between protected speech and incitement that should be criminalized? Does war change the calculus of what are appropriate and lawful measures to contain and respond to such incitement? And, perhaps most challenging of all, how does social media and the nature of communication and engagement in today’s virtual world change or complicate how we think about and can respond to incitement?

Book The Criminalization of Incitement to Terrorism from an International Perspective

Download or read book The Criminalization of Incitement to Terrorism from an International Perspective written by Ye Tao and published by Springer Nature. This book was released on 2023-07-25 with total page 175 pages. Available in PDF, EPUB and Kindle. Book excerpt: This book critically analyzes the criminalization of incitement to terrorism under the fundamental principles of legality, necessity, and proportionality with the aim of striking a fair balance between security and liberty on this complicated issue. The criminalization of incitement to terrorism has gained momentum, but no exact or generally accepted definition of this offense exists at the international level. What’s more, given that the criminalization of incitement to terrorism results in restrictions on the exercise of citizens’ freedom of expression, there should be certain limitations on those criminal measures to avoid unnecessary or disproportionate infringement of this fundamental human right. Nevertheless, there has not been a precise standard by which to determine how to draw the line between anti-terrorism and the protection of freedom of expression. Hence, it could be concluded that the criminalization of incitement to terrorism concerns how to balance security and liberty, and the safeguarding principles of legality, necessity, and proportionality should be fully observed in considering this issue. This book studies definitions of “incitement”, “terrorism”, and “incitement to terrorism” under the relevant international and national legislation, and points out the existing absence, ambiguousness, or substantive divergence in defining actus reus and mens rea regarding incitement to terrorism. It carefully considers the current need for and essential limitations on criminal measures against incitement to terrorism in accordance with the principles of necessity and proportionality, and particularly focuses on how to balance the protection of freedom of expression with the criminalization of incitement to terrorism. In considering how to draw a line between the two, the book formulates precise requirements for objective and subjective elements of this offense in accordance with the principle of legality. Given its scope, it will be of interest not only to academics, human rights lawyers and practitioners, but also to policymakers, as it offers an extensive evaluation of the effects and counter-effects of existing criminal measures.

Book Global Responses to Maritime Violence

Download or read book Global Responses to Maritime Violence written by Paul Shemella and published by Stanford University Press. This book was released on 2016-04-13 with total page 345 pages. Available in PDF, EPUB and Kindle. Book excerpt: Global Responses to Maritime Violence is a full discussion of maritime security short of war that goes beyond the current literature in both scope and perspective. The chapters in this volume examine terrorism, piracy, armed robbery at sea, illegal maritime trafficking, illegal fishing, and other maritime crimes. Contributors uncover both threats and responses as a complex ecosystem that challenges even the strongest national and regional institutions. Managing this system is a "wicked problem" that has no ultimate solution. But the book offers strategic precepts to guide the efforts of any government that seeks to improve its responses to maritime violence. The bottom line is that maritime violence can be managed effectively enough to protect citizens and national economies that depend on the sea. Comprehensive in scope, the volume coheres around the premise that good governance in the maritime domain, though difficult, is worth the considerable resources required.

Book Identity and Travel Documents and the Fight Against Terrorism

Download or read book Identity and Travel Documents and the Fight Against Terrorism written by Council of Europe. Committee of Ministers and published by Council of Europe. This book was released on 2005-01-01 with total page 28 pages. Available in PDF, EPUB and Kindle. Book excerpt: Although the vast majority of persons applying for and using identity and travel documents do so for lawful purposes, they are also used by terrorists, for whom they constitute an important tool. Genuine identity documents in particular, obtained through lawful procedures, are vital to terrorists' operational success. Recommendation Rec(2005)7 of the Committee of Ministers to member states concerning identity and travel documents and the fight against terrorism therefore aims to ensure the proper, rapid and reliable identification of individuals, in particular as regards the issuing of such documents. It calls on member states to take measures to strengthen the security of identity and travel documents and indicates the appropriate course of action to take when such documents are lost stolen. The recommendation also contains provisions dealing with proof of identity as well as registration of birth and issuance of births certificates, which are necessary to obtain identity and travel documents. Finally, the recommendation contains provisions dealing with international co-operation calling for the exchange of information with other member states and with international law enforcement bodies, in particular regarding lost or stolen identity and travel documents, whether issued or blank.

Book Special Investigation Techniques in Relation to Serious Crimes Including Acts of Terrorism

Download or read book Special Investigation Techniques in Relation to Serious Crimes Including Acts of Terrorism written by Council of Europe. Committee of Ministers and published by Council of Europe. This book was released on 2005-01-01 with total page 32 pages. Available in PDF, EPUB and Kindle. Book excerpt: In order to combat terrorism and serious crime, law enforcement authorities have had to adapt their investigative means and develop special investigation techniques. These techniques are used to systematically gather information in such a way that they do not alert those being investigated. Since there is a risk that they may infringe individual rights, special investigation techniques must be subject to control. This has been advocated by the European Court of Human Rights which "has already recognised the need, inherent in the Convention system, for a proper balance between the defence of the institutions of democracy in the common interest and the protection of individual rights". This publication contains Recommendation Rec(2005)10 of the Committee of Ministers to member states on "special investigation techniques" in relation to serious crimes including acts of terrorism. It aims at promoting the effective use of special investigation techniques by judicial and prosecuting authorities in the framework of their criminal investigations in relation to serious crimes, including acts of terrorism, whilst ensuring strict respect for the rights and freedoms of the individual.

Book The Charlie Hebdo Affair and Comparative Journalistic Cultures

Download or read book The Charlie Hebdo Affair and Comparative Journalistic Cultures written by Lyombe Eko and published by Springer Nature. This book was released on 2019-11-14 with total page 452 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Charlie Hebdo terrorist attack of January 7, 2015 shook French journalism to the core and reverberated around the world, triggering a cascade of responses from journalists, media outlets, cartoonists and caricaturists from diverse geographies of freedom of expression and journalistic cultures. This book is a multifaceted case study that describes and explains sameness and difference in diverse journalistic conceptualizations of the Charlie Hebdo affair from a comparative, international perspective. It explores how different journalistic traditions, cultures, worldviews and styles conceptualized and reacted to the clash between freedom of expression and respect for religious sentiments in the context of terrorism, where those sentiments are imposed on the media and secular societies through intimidation, coercion and violence. The book analyzes the political and cultural clashes between the core human right of freedom of expression, and rite of respect for religious sentiments, which is situated on the outer periphery of the human right of freedom of religion. It also examines how media outlets, editors, and cartoonists from different politico-cultural contexts and journalistic cultures in Africa, Asia, Europe, the Middle East, and North and South America, addressed the delicate issue of Mohammed cartoons in general, and the problem of (re)publication of the controversial Charlie Hebdo Je Suis Charlie Mohammed cartoon, in particular.

Book Sedition and the Advocacy of Violence

Download or read book Sedition and the Advocacy of Violence written by Sarah Sorial and published by Routledge. This book was released on 2013-03 with total page 211 pages. Available in PDF, EPUB and Kindle. Book excerpt: Sedition refers to the uttering or writing of words intended to bring the sovereign state into hatred or contempt, to urge disaffection against the Constitution or democratically elected government, or the attempt to procure change in government by unlawful means. Modern sedition laws, such as those enacted in Australia, the United Kingdom, the United States and The Council of Europe target types of speech advocating violence against the state, in the form of religious sermons preaching violent jihad or glorifying acts of terrorism, although they have the potential to cover much more than this. For this reason, the modernisation of sedition laws renewed debate about the status of free speech and religious expression in a time of so-called terror. This book will look at the issue of sedition by providing an explanatorily account of the relation between speech and action using speech act theory as developed by J.L. Austin and applying this to the task of developing a defence of freedom of speech as a qualified right. This book contributes to the debate over the contested status of freedom of speech that sedition laws give rise to by filling in the explanatory gaps in our current understanding of the value of free speech as a qualified right. It provides arguments that go beyond the traditional parameters of the debate by exploring, in significant detail, the ways in which speech is also conduct, the ways in which it can harm the social interest, and why, for these reasons, sedition might be defensible, but also suggest ways in which their scope could be limited to ensure that such laws are not open to abuse.

Book The Protection of Witnesses and Collaborators of Justice

Download or read book The Protection of Witnesses and Collaborators of Justice written by Council of Europe. Committee of Ministers and published by Council of Europe. This book was released on 2005-01-01 with total page 46 pages. Available in PDF, EPUB and Kindle. Book excerpt: In order to combat terrorism, states often rely on the testimony of people who are closely connected to terrorist groups and who are more vulnerable than others to the use of intimidation against them or against people close to them. This may endanger the success of prosecutions often based on long and complicated investigations. Strengthening international co-operation in this field is also a useful means to ensure the protection of those persons whose protection would prove difficult on a merely national basis, given the conditions in the country where they are located. The Council of Europe has extensive experience in this area, based on existing European conventions and other standards. On that basis, and having drawn up a survey of national laws and practice in member and observer states, the Council of Europe has drawn up a new standard, Recommendation Rec(2005)9 of the Committee of Ministers to member states on the protection of witnesses and collaborators of justice, which is the subject of this publication.

Book Terrorism and the Limitation of Rights

Download or read book Terrorism and the Limitation of Rights written by Stefan Sottiaux and published by Bloomsbury Publishing. This book was released on 2008-02-29 with total page 472 pages. Available in PDF, EPUB and Kindle. Book excerpt: Taking as a starting point the widely accepted view that states confronted with terrorism must find a proper equilibrium between their respective obligations of preserving fundamental rights and fighting terrorism effectively, this book seeks to demonstrate how the design and enforcement of a human rights instrument may influence the result of that exercise. An attempt is made to answer the question how a legal order's approach to the limitation of rights may shape decision-making trade-offs between the demands of liberty and the need to guarantee individual and collective security. In doing so, special attention is given to the difference between the adjudicative methods of balancing and categorisation. The book challenges the conventional wisdom that individual rights, in times of crisis, are better served by the application of categorical rather than flexible models of limitation. In addition, the work considers the impact of a variety of other factors, including the discrepancies in enforcing an international convention as opposed to a national constitution and the use of emergency provisions permitting derogations from human rights obligations in time of war or a public emergency. The research questions are addressed through a comparative study of the terrorism-related restrictions on five fundamental rights protected under the European Convention on Human Rights and the United States Constitution: the right to freedom of expression, the right to freedom of association, the right to personal liberty, the right to privacy, and the right to a fair trial. The book offers both a theoretical account of the paradoxical relationship between terrorism and human rights and a comprehensive comparative survey of the major decisions of the highest courts on both sides of the Atlantic.

Book Human Dignity and Human Security in Times of Terrorism

Download or read book Human Dignity and Human Security in Times of Terrorism written by Christophe Paulussen and published by Springer Nature. This book was released on 2019-12-09 with total page 373 pages. Available in PDF, EPUB and Kindle. Book excerpt: In this book, it is explained that despite a current drop in the number of deaths, terrorism should still be considered a serious and widespread problem. However, the responses to this phenomenon are often more problematic from a long-term perspective. With the human rights framework under serious pressure, this edited volume offers a timely, important and critical in-depth analysis of human dignity and human security challenges in the lead-up, and in the responses, to current forms of terrorism. It aims to map how human dignity and human security can be secured and how law can constitute a source of trust at a time when Europe and the rest of the world continue to be plagued by terrorism. The authors are both established names and upcoming talent in this fastchanging and exciting field of law. They thoroughly analyse a variety of topical subjects, in more conceptual chapters—for example calling for the humanisation of the security discourse—and in highly practical contributions, in which for instance the Kafkaesque situation in which rendition and torture victim Abu Zubaydah still finds himself today is considered. This book, which focuses on, but is not limited to the situation in Western countries, aims to inspire not only academics—through further theorisation on the sometimes elusive but important concepts of human dignity and human security—but also practitioners working in the field of countering terrorism. It will hopefully convince them (even more) that following a human rights approach will be indispensable in securing human dignity and human security for all. Even—or in fact: especially—in times of terrorism. Christophe Paulussen is a Senior Researcher in the Research Department of the T.M.C. Asser Instituut in The Hague, The Netherlands and Martin Scheinin is Professor of International Law and Human Rights in the Department of Law of the European University Institute (EUI) in Florence, Italy.
