Available in PDF, EPUB and Kindle. Book excerpt: The USA Patriot Act (Patriot Act) is an extensive anti-terrorism law that aims to strengthen the nation's defenses against terrorism. The money laundering provisions under Title III of the Act target the financial infrastructure of criminal organizations and terrorist groups. The new anti-money laundering (AML) legislation requires the private sector to take a more active role in the fight against money laundering and terrorist financing. Accordingly, the cost of doing business has increased dramatically for businesses, most of which are in the financial services industry. However, the regulatory burden of the Patriot Act fell more heavily on some institutions than the others. In this dissertation, I use the heterogeneous-firm model of regulation derived from the interest-group theory of government to test whether or not the money laundering provisions of the Patriot Act led to a wealth transfer from small commercial banks and thrifts to large ones. The empirical evidence suggests that small institutions have borne a disproportionately greater compliance burden than their large competitors. I also test a number of hypotheses derived from the public-interest theory of government that institutions which are more likely to be targeted by money launderers have been affected more by the new law in terms of compliance burden than the ones which are not. Empirical findings do not support a positive correlation between money laundering risk and compliance burden borne by institutions.

It flows from a consultation draft circulated by the Department of Justice, to which Congress made substantial modifications and additions. The stated purpose of the Act is to enable law enforcement officials to track down and punish those responsible for the attacks and to protect against similar attacks. The Act grants federal officials greater powers to trace and intercept terrorists' communications both for law enforcement and foreign intelligence purposes. It reinforces federal anti-money laundering laws and regulations in an effort to deny terrorists the resources necessary for future attacks. It tightens our immigration laws to close our borders to foreign terrorists and to expel those among us. Finally, it creates a few new federal crimes, such as the one outlawing terrorist attacks on mass transit; increases the penalties for many others; and institutes several procedural changes, such as a longer statute of limitations for crimes of terrorism. Critics have suggested that it may go too far. The authority to monitor e-mail traffic, to share grand jury information with intelligence and immigration officers, to confiscate property, and to impose new book-keeping requirements on financial institutions, are among the features troubling to some. The Act itself responds to some of those reservations. Many of the wiretapping and foreign intelligence amendments sunset on 31 December 2005. The Act creates judicial safeguards for e-mail monitoring and grand jury disclosures; recognises innocent owner defences to forfeiture; and entrusts enhanced anti-money laundering powers to those regulatory authorities whose concerns include the well being of our financial institutions.

The Code was first published in 1926, and a new edition of the code has been published every six years since 1934. The 2012 edition of the Code incorporates laws enacted through the One Hundred Twelfth Congress, Second Session, the last of which was signed by the President on January 15, 2013. It does not include laws of the One Hundred Thirteenth Congress, First Session, enacted between January 2, 2013, the date it convened, and January 15, 2013. By statutory authority this edition may be cited "U.S.C. 2012 ed." As adopted in 1926, the Code established prima facie the general and permanent laws of the United States. The underlying statutes reprinted in the Code remained in effect and controlled over the Code in case of any discrepancy. In 1947, Congress began enacting individual titles of the Code into positive law. When a title is enacted into positive law, the underlying statutes are repealed and the title then becomes legal evidence of the law. Currently, 26 of the 51 titles in the Code have been so enacted.
