Book Australia s American Constitution and the Dismissal

Download or read book Australia s American Constitution and the Dismissal written by David Long and published by Rowman & Littlefield. This book was released on 2021-04-28 with total page 315 pages. Available in PDF, EPUB and Kindle. Book excerpt: David Long traces the cause of the 1975 constitutional crisis to the influence of English legal positivism, a theory which isolates the meaning from the political scheme the text was framed to support. He shows the fundamental premise of a Constitution, framed in Convention, ratified by the people that cannot be altered without their consent, the consent of the governed. Legal positivism was adopted by the High Court in 1920 when it abolished the federal scheme and therewith the sovereign States. The responsible judge had opposed federalism at the 1897 Convention. Long examines two juristic opinions that excused the Governor-General’s 1975 unprecedented dismissal of a government with the confidence of the House of Representatives. He identifies their reliance on legal positivist constitutional interpretations that are expressly rejected by the Founders. Long provides a theoretical defence of the Founders original understanding as the object of constitutional construction.

Available in PDF, EPUB and Kindle. Book excerpt: The Australia Acts, one enacted in Australia and the other in the United Kingdom, are fundamental constitutional documents for Australia: they terminated the remaining constitutional links between the two countries. Negotiated behind closed doors, little has been known of their background and purpose.Using previously confidential documents, this book reveals what was intended, what was disputed and what was rejected. It analyses each provision, its background, objectives, drafting changes and its current operation. It also provides a close analysis of the power to enact the Australia Acts, the validity of the provisions and their impact on the Crown and Australia's independence. The book addresses fundamental historical, political and constitutional matters, such as:the current basis for Australian sovereignty and the binding nature of the Constitution the relationship between federalism and the Crownthe status of the Queen of Australia and whether there is also a separate Queen of each State, and the source of the power to amend Australia's constitutional documents and the limits on its exercise. It is also essential for those who need to ascertain the extent of State legislative power, including:the reach of the extra-territorial power of the States and whether a nexus is neededwhether the States can constitutionally entrench laws, such as a bill of rightswhy the States cannot abdicate or limit the scope of their legislative powerswhether the States can apply the Australia Acts with retrospective effect to validate defective State laws.

Book The Spirit of American Government

Download or read book The Spirit of American Government written by J. Allen Smith and published by Cosimo, Inc.. This book was released on 2006-05-01 with total page 421 pages. Available in PDF, EPUB and Kindle. Book excerpt: Democracy-government by the people, or directly responsible to them-was not the object which the framers of the American Constitution had in view, but the very thing which they wished to avoid. In the convention which drafted that instrument it was recognized that democratic ideas had made sufficient progress among the masses to put an insurmountable obstacle in the way of any plan of government which did not confer at least the form of political power upon the people. Accordingly the efforts of the Constitutional Convention were directed to the task of devising a system of government which was just popular enough not to excite general opposition and which at the same time gave to the people as little as possible of the substance of political power.-from "Chapter III: The Constitution Reactionary Document"It was written a century ago, in 1907, but this rethinking of the legacy of the American founding fathers continues to inspire historical revisionists today. The opening salvo in what was to become a cottage industry of conspiracy theories, this startling and angry work posits that the American Constitution is not, in fact, a bastion of power-to-the-people philosophy but is, rather, the result of a political plot by the economic elite of the colonies to retain as much supremacy as possible for themselves.A shattering blow to the iconic images of the men who made America, this is a provocative and shocking read.OF INTEREST TO: readers of American history, students of the culture warsJAMES ALLEN SMITH (1860-1926) was professor of political science at the University of Washington.
