Download or read book Legal Research Demystified written by Eric P. Voigt and published by . This book was released on 2019 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: Legal Research Demystified offers a real-world approach to legal research for first-year law students. The book guides students through eight steps to research common law issues and ten steps to research statutory issues. It breaks down the research steps and process into "bite-size" pieces for novice researchers, minimizing the frustration often associated with learning new skills. This text also gives students context, explaining why and when a source or finding tool should be used when researching the law. The process of legal research, of course, is not linear. This book constantly reminds students of the recursive nature of legal research, and it identifies specific situations when they may deviate from the research steps. Through the book's step-by-step approach, students will connect seemingly unrelated tools (e.g., citators and the Key Number System) and understand how to leverage them to answer legal questions. Every chapter includes charts, diagrams, and screen captures to illustrate the research steps and finding methods. Each chapter concludes with a "summary of key points" section that reinforces important concepts from the chapter. This book provides students and professors with multiple assessment tools. Each chapter ends with true-false and multiple-choice questions that test students' understanding of chapter content. These questions are replicated on the book's companion website, Core Knowledge. Students may answer these end-of-chapter questions, as well as more advanced questions, on Core Knowledge and receive immediate feedback, including an explanation of why the answer is correct or incorrect. Professors can generate reports to track students' performance. Based on students' performance, professors will know whether to review a topic in more detail or to move to the next topic. (New books contain an access code to Core Knowledge; students purchasing used books can buy an access code separately.) Core Knowledge offers yet another assessment tool: interactive research exercises. These online exercises walk students through the research steps on Westlaw and Lexis Advance, giving professors the option to "flip" the classroom. Through many screen captures and tips, students can navigate both research platforms outside of class, allowing students and professors to dig deeper into the material during class. Each research exercise simulates a real-world research experience and contains self-grading questions. For example, in one exercise, students research on Westlaw to determine whether the client could recover damages against a neighbor for the emotional distress for the death of the client's dog. To answer the client's question, students must complete the research steps, including finding and reviewing secondary sources on Westlaw, using the Key Number System and KeyCite, and performing keyword searches. Professor support materials include a Teacher's Manual, sample syllabi, and sample research exams.

Download or read book Nuclear Verdicts written by JR. Robert F Tyson and published by . This book was released on 2020-02-11 with total page 222 pages. Available in PDF, EPUB and Kindle. Book excerpt: This is the first book ever written for the defense on how to avoid runaway jury verdicts. I wrote this book because I care about fairness. I believe everyone has the right to a fair trial, not just plaintiff lawyers and their clients. Defendants are entitled to have a jury decide their case without being stirred with passion and bias by creative plaintiff lawyers. This is the defense "playbook" for justice. You will learn trial techniques to even the playing field for defendants seeking a fair trial. Every aspect of a civil jury trial will be covered, from voir dire to opening statements to witnesses and finally closing arguments. There is a formula for defeating plaintiff attorneys' deceptive tactics and psychological gamesmanship, and you will learn it. While full of 30 years of trial victories and personal experiences, this is a "how to" book. How to defend at trial. How to beat plaintiff attorneys at their own game. How to win. It is time to bring an end to the epidemic of nuclear verdicts across our country. It is time for you to take back justice for all! NUCLEAR VERDICTS MUST BE STOPPED! YOU CAN STOP THEM. RESPONSIBILITY. In every jury trial, accepting responsibility is not only the right thing to do, it is the most important thing you will do, no exceptions. Own what you did in every single jury trial, no excuses. REASONABLENESS. Be the most reasonable person in the courtroom. Do not take the typical defense approach of fighting every little thing. Show the jury you care, and they will return a verdict that is fair and just for all. COMMON SENSE. The ultimate equalizer in any case is common sense. It allows the jury to come to a conclusion that is fair and reasonable. You must go beyond the evidence and the law, and help the jury apply their common sense for a righteous verdict.

Available in PDF, EPUB and Kindle. Book excerpt: 1. As you know, in the last few months since the President's death and the abrupt retirement of the Vice President, there have been some instances of public unrest. I fully appreciate that the threat of disorder occasioned by the absence of a Chief Executive precipitated your assumption of power as Commander-in-Chief, UAFUS, and your designation of yourself as permanent Military Plenipotentiary of the United States. It is obvious to me that strong leadership is needed in these troubled times. Indeed, I am convinced that it was inept civilian leadership that caused our defeat in the Second Gulf War. 2. Despite the approval of your actions by The Referendum, it was still necessary to make several arrests for acts of sedition. One of these traitors, I am sorry to say, is a retired officer and a 1992 graduate of the National War College. The officer, Prisoner 222305759, has been convicted by court-martial and is awaiting execution. In violation of my standing orders, the prisoner was allowed writing materials. Somehow he managed to draft a letter to a fellow alumnus chronicling what he calls the "Origins of the American Military Coup of 2012." By hand-writing the letter he defeated the electroscriber scanners we placed in his cell. Fortunately, our security forces were still able to intercept it. 3. Because of its potential interest to you, a copy of the prisoner's letter is attached. As the document indicates, the prisoner evidently had secreted into the stockade old notes, articles, and newspaper clippings he saved from his War College days. These documents were recovered in a search of the prisoner's cell. For your edification, I have had an intelligence agent analyze them and annotate your copy of the letter with endnotes citing these references where appropriate. 4. Upon receipt of your order affirming the sentence of the court, Prisoner 222305759 will be executed in accordance with applicable directives. /s/ Ben N. Dykarnilt General, UAFUS
