Book excerpt: This book is about how work enters and affects the lives of children in Africa, taking for granted neither the traditional values surrounding childrens work, nor the international standards against it. Many African societies nurture their children on the ingrained notion that children must work as part of their process of growing up. Children participate in their families and communities through the work they do in the house and in whatever else their families do. Such views are, however, antithetical to the dominant views in Europe and North America which see childhood as a time of freedom from responsibility and economic activity. These views have become so popular with the elites in other countries to the extent that they now drive international campaigns against child labour, and have been incorporated into what are now considered universal international standards and conventions. This book was conceived within the framework of the CODESRIA tradition of taking African perspectives seriously and not allowing social research in Africa to become subservient to values from outside. African scholars remain keenly aware of the need not to isolate themselves from developments in the wider world, which could lead to stagnation. This book, through empirical observation of the lives of African children, the work they do, its place in their lives, and what the children say about it, proposes new perspectives towards a new understanding of this complex stage of human development. Work is not simply about the right to income: work provides identity and status in society, and participation in the community. People relate to one another through work. Those who do not work are often without status and are at the periphery of society. One of the major ways in which this book differs from most of the available literature is in the understanding it brings to the problem of child labour. There are economic reasons why children may need an income of their own. There is the demographic fact that the proportion of children to adults in low-income countries is nearly double that in high-income societies. This book attempts to demonstrate that work is both necessary and beneficial in terms of a childs development to become a full, responsible, and respectable member of society.

What are the theoretical and methodological challenges and possibilities for ethical understandings of childhoods and poverty? The ‘poor child’ at the centre of development activity is often measured against and reformed towards an idealised and globalised child subject. This book examines why such normative discourses of childhood are in need of radical revision and explores how development research and practice can work to ‘unsettle’ the global child. It engages the cultural politics of childhood – a politics of equality, identity and representation – as a methodological and theoretical orientation to rethink the relationships between education, development, and poverty in children’s lives. This book brings multiple disciplinary perspectives, including cultural studies, sociology, and film studies, into conversation with development studies and development education in order to provide new ways of approaching and conceptualising the ‘poor child’. The researchers draw on a range of methodological frames – such as poststructuralist discourse analysis, arts based research, ethnographic studies and textual analysis – to unpack the hidden assumptions about children within development discourses. Chapters in this book reveal the diverse ways in which the notion of childhood is understood and enacted in a range of national settings, including Kenya, India, Mexico and the United Kingdom. They explore the complex constitution of children’s lives through cultural, policy, and educational practices. Confronted with their parents and siblings health predicaments and the inadequacies of state and familial care, or urgent negotiation of their sexualities, they demonstrate incredible resilience. Similarly, their perceptiveness is demonstrated in a unique appreciation of politics and its actors and a capacity to assume responsibilities beyond their chronological age. Thus while highlighting some of the challenges confronting African children, the book provides gripping evidence of how they resiliently negotiate those challenges.

Book excerpt: Personal status laws remain a highly politicized area of debate in the Middle East, as the arena in which the contentious issues of women's rights, religion and minority groups meet. This is especially so when it comes to divorce. In Tunisia, with the moderate Islamist party Ennahda winning the first elections following the 2011 revolution, questions of religion in public life have gained greater primacy. The country is often hailed for its progressive personal status code, seen as an exception to the practice in many other Muslim countries. Polygamy is banned, for example, and in divorce cases there is gender equality. However, Tunisia's legal system contains many gaps and leaves much room for interpretation. Bearing in mind this importance of the role of Islam in judicial courts, Maaike Voorhoeve investigates whether the more progressive, and ostensibly secular, principles enshrined in Tunisia's Personal Status Code of 1956 are in fact adhered to in divorce cases. And if not, whether judges frequently turn to the Sharia, custom or societal norms as their primary sources of guidance. Through extensive research in the Tunisian courts, Voorhoeve investigates the different types of divorce, the arguments presented to the court and the consequent legal decisions made. She focuses on the role of female judges, testing the assumption that they adjudicate in a more gender-neutral way and examining the impact they have had on Tunisian legal culture and through this, Tunisian society. Gender and Divorce Law in North Africa therefore sheds light on the wide-reaching debate throughout North Africa and the Middle East concerning the role of Islam and Sharia in the public, political, legal and private spheres. This debate, which often pits secularists against Islamists, but is in reality much more nuanced, is key in a variety of fields, including Middle East studies and Islamic law.
