Book Trade Union Law Classic Reprint

Download or read book Trade Union Law Classic Reprint written by Henry H. Slesser and published by . This book was released on 2015-07-06 with total page 360 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Trade Union Law The legal problems which the subject of Trade Unionism produces are considerable. In the first place, the Trade Union shares with other voluntary societies that ambiguous intermediate region between the individual and the corporation which the law has so tentatively defined; secondly, the common law doctrine of restraint of trade and conspiracy have given a fundamental taint of illegality to Trade Union activity which the statute law has not entirely succeeded in removing; thirdly, both the judicial decisions and the legislation (the latter often reversing the former) are so conflicting and difficult to reconcile, that in many cases they have but made confusion worse confounded. Moreover, recent decisions on the legal position of commercial combinations as Trade Unions show that Trade Union Law is destined to have great developments in a region hardly contemplated by the framers of the Act of 1871 - developments which it may be predicted are likely in the future to have very far-reaching effects. All the cases bearing upon each and all of these Acts are cited and explained in connection with the various sections of each Act. The Combination Laws, Repeal of. - With respect to the Trade Union Acts, it is necessary to explain that the right of combination was conceded by the repeal of the Combination Laws, first in 1824 by 5 Geo. IV. 0. 95, and then, in a slightly modified form, by 6 Geo. IV. C. 129, in 1825, the former being repealed, and the latter substituted therefor. But though combinations of workmen were no longer illegal, singularly enough the right to com bine thus conceded did not carry with it the citizen's right of protection, as regards funds and property. Book Trade Unions and the Law Classic Reprint

Download or read book Trade Unions and the Law Classic Reprint written by Walter V. Osborne and published by Forgotten Books. This book was released on 2018-02-11 with total page 50 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Trade Unions and the Law For this reason the genuine Trade Unionists have all to lose by the conversion of their organisations into political bodies, whereas the Socialists have all to gain, as they have no use for, and see no value in, the Unions apart from politics. It is altogether wrong to claim, as the socialist-labour Party are doing, that the Unions have for the past forty years engaged in political activities in the same sense as they have recently been doing but it is true that a few Unions, chiefly amongst the miners, have sent one or more Of their members to Parliament to watch their industrial interests, but on all other matters they were wholly free to Obey the dictates of their own conscience and the wishes of their constituencies. In other words the Unions only paid for the industrial services and recognised no party politics. It was not until after the year 1900 that anything of a party nature was to be found in any Trade Union rules. Political and religious matters were purposely kept outside the Unions as being subjects-likely to cause dissension amongst the members, and in some cases the rules provided for fines if any member insisted in introducing such subjects. The more general method was to provide a fine for disregard of the Chairman's ruling in the branches, and the bye-laws debarred the introduction of political and religious matters, and thus the fines were more indirect but not less real. Book excerpt: Excerpt from The Law Relating to Trade Unions For the performance of their duty under Her Majesty's Commission the Trade Unions Commissioners had to ascertain the state of the existing law, both Common and Statute, connected with Trade Unions, in order that amendments might be proposed with knowledge of their probable effect. For this purpose I prepared the following Memorandum, with the intention of its being laid before my colleagues, and forming part of the proceedings of the Commission. It has, however, so grown under my hand as to embrace some topics beyond the immediate scope of our Commission; and I now offer it on my own responsibility. Download or read book The Law Relating to Trade Unions written by Henry Herman Slesser and published by Forgotten Books. This book was released on 2018-02-15 with total page 174 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Law Relating to Trade Unions: Four Lectures Delivered for the Council of Legal Education, Michaelmas Term, 1920 Ing to Trade Unions as is to be found in this book. The belief has been entertained that Trade Unions and their activities are outside the law; it will be dispelled by a glance at the contents. On the other hand, the remarkable fact that in a country Where the rule of law has been predomin ant it has been considered advisable to make im mune from civil liability for tortious acts the vast associations of capital and labour styled Trade Unions, equipped as they are with huge resources in money and men and possessing elaborate organ izations conducted with consummate ability, renders it highly important to know the conditions of such immunity and the legal relations of Trade Unions both to their members and to the community at large. It was partly because of the important nature of the subject that the Council of Legal Education selected, for the first series of evening lectures to be delivered after the War, the subject of the Law Relating to Trade Unions, and asked the author to be the lecturer, and I am satisfied that the reader will find the subject treated in illuminating fashion. The history of the law, so necessary for present day interpretation, will be found to be very completely recorded. The ex position of the law and the discussion of practical difficulties seem to me acute and dispassionate. I can only wish for the book the success attained. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Handbook of Industrial Law: A Practical Legal Guide for Trade Union Officers and Others The handbook is the outcome of a number of courses of lectures on Industrial Law delivered at Ruskin College, Oxford, during the last five years. At these lectures I have found that the legal relationships between trade unions and their members, and amongst the members themselves, cannot very well be understood without a knowledge Of the fundamental principles Of Contract Law. Nor can the law relating to industrial disputes be properly appreciated without some acquaintance with the Criminal Law and the Law of Torts. In Chapters I and II Of the handbook an attempt has been made to meet these requirements. It is hoped that the chapters on Securities and Invest ments, and on Trusts and Trustees, will be helpful not only to trustees of trade unions, friendly societies, and other similar bodies, but also to those members Of the general lay public who assume the honourable but sometimes thankless office Of trustee. The chapters on National Health and Unemployment Insurance, and on the Workmen's Compensation Act, deal with these matters from the general point of view, and are intended to serve as a guide to all who are concerned with the working Of these Acts. Every important provision Of the various National Insurance Acts is included, together with much additional information from the Official Regula tions and Circulars, and an attempt has been made, by means of abundant references, systematically to incorporate with the text the Regulations and Circulars themselves. Book An Introduction to U S Collective Bargaining and Labor Relations

Download or read book An Introduction to U S Collective Bargaining and Labor Relations written by Harry C. Katz and published by Cornell University Press. This book was released on 2017-09-15 with total page 542 pages. Available in PDF, EPUB and Kindle. Book excerpt: This comprehensive textbook provides an introduction to collective bargaining and labor relations with a focus on developments in the United States. It is appropriate for students, policy analysts, and labor relations professionals including unionists, managers, and neutrals. A three-tiered strategic choice framework unifies the text, and the authors’ thorough grounding in labor history and labor law assists students in learning the basics. In addition to traditional labor relations, the authors address emerging forms of collective representation and movements that address income inequality in novel ways. Harry C. Katz, Thomas A. Kochan, and Alexander J. S. Colvin provide numerous contemporary illustrations of business and union strategies. They consider the processes of contract negotiation and contract administration with frequent comparisons to nonunion practices and developments, and a full chapter is devoted to special aspects of the public sector. An Introduction to U.S. Collective Bargaining and Labor Relations has an international scope, covering labor rights issues associated with the global supply chain as well as the growing influence of NGOs and cross-national unionism. The authors also compare how labor relations systems in Germany, Japan, China, India, Brazil, and South Africa compare to practices in the United States. The textbook is supplemented by a website (ilr.cornell.edu/scheinman-institute) that features an extensive Instructor’s Manual with a test bank, PowerPoint chapter outlines, mock bargaining exercises, organizing cases, grievance cases, and classroom-ready current events materials.
