Book excerpt: This study was undertaken in an attempt to document the perceptions of the legal literacy of educators and to discuss the implications for teacher preparation programs. The research further attempted to study the impact and fear of legal issues on the educational practices of teachers, principals, and university professors and to determine the areas of school law that teachers, principals, and university professors felt should be included in undergraduate (preservice) teacher preparation programs. It was hypothesized that this research design would illustrate differences between the three professional groups and that the university professors would be represented as outliers in the data. This hypothesis was sometimes confirmed, but other interesting findings originated in this research. (Contains 2 tables and 1 figure.).

Book excerpt: This document is a compendium of teacher education strategies intended to strengthen law related education efforts by providing ideas, activities, and experiences drawn from the perspectives of veteran teacher educators. The book grew out of a conference on advanced law related education leadership exploring what is known about preparing precollegiate teachers for the 1990's and beyond. This comprehensive volume includes diverse inservice teacher education programs, ranging from creative strategies for workshops of short duration to summer institutes of several weeks. Preservice models for infusing law relate education into college and university teacher preparation courses are highlighted. In addition to presentations of exemplary preservice and inservice teacher education programs, an important element of the conference was reflective discussions among teacher education faculty, school district staff development specialists, and law related education program directors. The volume is divided into two parts. The first includes six articles on preservice models. Articles in this section discuss training future teachers in U.S. government and politics, integrating law related education into social studies using language arts methods, and a model for using law related education as a vehicle for teaching secondary social studies method courses. The second section on inservice models discusses statewide law related education certification, national teacher training workshops, graduate level programs, summer institutes for teachers, and community/school partnerships such as a mock trial program in Ohio, and the national MENTOR program of law firm/high school partnerships. The Miseducation of English Learners examines the initial policy impact of Structured English Immersion (SEI), an English-only program mandated for English Learners (ELs) in California, Arizona, and Massachusetts in the United States. The book features analyses of: the legal context and parameters of SEI; research history on SEI; SEI language policy and policy implementation according to situated context; and the educational priorities and legal rights of ELs. The book examines the history of SEI in the educational research literature and as it has been interpreted in the context of the legal requirement for schools to take “appropriate action” to meet the needs of ELs following the historic Lau v. Nichols (1974) court decision. The Miseducation of English Learners also presents and considers the implementation of SEI in comparative contexts from various perspectives including teacher education, the classroom, and legal. In several of the chapters, SEI implementation is examined in concert with other factors that have effected the teaching and progress of ELs such as Senate Bill 2042 (2001) that overhauled the teacher education process in California, and the federal No Child Left Behind legislation (signed into law on January 8, 2002). Unfortunately, over the past five decades, two major trends have become clearly evident in the Black community: (a) the decline of the academic achievement levels of Black students and (b) the disappearance of Black teachers, particularly Black males. Today, of the 3.5 million teachers in America’s classrooms (AACTE, 2010) only 8% are Black teachers, and approximately 2% of these teachers are Black males (NCES, 2010). Over the past few decades, the Black teaching force in the U.S. has dropped significantly (Lewis, 2006; Lewis, Bonner, Byrd, & James, 2008; Milner & Howard, 2004), and this educational crisis shows no signs of ending in the near future. As the population of Black students in K-12 schools in the U. S. continue to rise—currently over 16% of students in America’s schools are Black (NCES, 2010)—there is an urgent need to increase the presence of Black educators. The overall purpose of this edited volume is to stimulate thought and discussion among diverse audiences (e.g., policymakers, practitioners, and educational researchers) who are concerned about the performance of Black students in our nation’s schools, and to provide evidence-based strategies to expand our nation’s pool of Black teachers. To this end, it is our hope that this book will contribute to the teacher education literature and will inform the teacher education policy and practice debate.

Available in PDF, EPUB and Kindle. Book excerpt: This study determined the level of legal literacy among classroom teachers in a suburban metropolitan division in Virginia. I have focused on aspects of the law that relate to student safety and student rights, and my operational definition of legal literacy is the understanding of these laws. The results from 239 respondents indicated that teachers in this division are not knowledgeable of essential legal content specific to student/teacher interactions. The mean percent of correct answers hovered at the 50% mark on a survey of 20 true/false questions related to landmark cases, important legislation, and Virginia law. I was unable to trace legal literacy to a particular demographic, and I concluded that more than half of the respondents had received no training in legal issues. I propose that Virginia's licensure requirements be upgraded to include competence in legal literacy because knowledge of law is among the standards of the National Council for the Accreditation of Teacher Education (NCATE, 2008). Based on comments from respondents to my survey, teachers are interested in learning more about education law.
