Book The Complete Guide to Government Contract Types

Download or read book The Complete Guide to Government Contract Types written by Kenneth R. Segel and published by Berrett-Koehler Publishers. This book was released on 2016-04-01 with total page 270 pages. Available in PDF, EPUB and Kindle. Book excerpt: Everything You Need to Know About Government Contract Types As the world's single largest buyer of goods and services, the federal government has many ways to structure its procurements. Different situations and conditions often determine the best vehicle for a particular purchase. Contracting officers must assess a wide range of factors to determine which contract type will provide the government the best value and the least risk. The Complete Guide to Government Contract Types provides a comprehensive overview of the key government contract vehicles and types: fixed-price, cost-reimbursement, incentive, and other (which includes letter, indefinite-delivery/indefinite-quantity, and time-and-material contracts). The author first explains the selection process for contract vehicles, which is the basis for selecting the appropriate contract type for the work in question. He then presents a comprehensive, in-depth analysis of each contract type, explaining how each works best to meet certain types of requirements and conditions. This is an essential resource for both contracting officers and contractors seeking to understand and work effectively within the nuances of contract selection and compliance.

Book Evaluating the Past Performance of Federal Contractors

Download or read book Evaluating the Past Performance of Federal Contractors written by Congressional Research Service and published by CreateSpace. This book was released on 2015-02-05 with total page 24 pages. Available in PDF, EPUB and Kindle. Book excerpt: Poor performance under a federal contract can have immediate consequences for contractors, who could be denied award or incentive fees, required to pay damages, or terminated for default. In addition, it could affect their ability to obtain future contracts because federal law generally requires agencies to evaluate contractors' past performance and consider past performance information when making source selection decisions in negotiated procurements and determining whether prospective contractors are “responsible.” “Past performance” refers to performance on “active and physically completed contracts” and certain orders under existing contracts. Federal law generally requires agencies to evaluate and document contractor performance on contracts or orders whose value exceeds the simplified acquisition threshold (generally $150,000). The evaluation must generally address the quality of the product or service supplied by the contractor, its efforts to control costs, its timeliness and compliance with schedules, its conduct of management or business relations, its performance in subcontracting with small businesses, and other applicable factors (e.g., tax delinquency). The evaluation and any contractor response comprise the past performance information that is stored in government databases (e.g., Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS)) and may be used in future source selection decisions. Federal law also generally requires agencies to consider contractors' past performance when making source selection decisions in negotiated procurements whose value exceeds the simplified acquisition threshold. In a negotiated procurement, the contract is awarded to the offeror whose proposal represents the “best value” for the government based on various factors identified in the solicitation. These factors typically must include price and past performance. However, other factors may be considered, and procuring agencies determine the weight given to various factors. Additionally, agencies are required by law to consider whether the contractor has a “satisfactory performance record” when determining whether the contractor is sufficiently “responsible” to be awarded a federal contract. Agencies generally cannot award a contract without determining that the contractor is “responsible.” While agencies are generally prohibited from repeatedly finding a contractor nonresponsible based upon the same deficient past performance, they may debar or suspend contractors for willful failure to perform under a contract or contracts, or for a history of failure to perform or of unsatisfactory performance of a contract or contracts.

Book The Use of Incentive Contracting in Aircraft Procurement

Download or read book The Use of Incentive Contracting in Aircraft Procurement written by Edward G. Redden and published by . This book was released on 1965 with total page 44 pages. Available in PDF, EPUB and Kindle. Book excerpt: The largest program in the Navy budget is procurement and one of the largest appropriations within this program is aircraft procurement. Because it does represent such a substantial portion of the budget, aircraft procurement is potentially one of the most important areas for improving cost effectiveness in the Navy. One important available instrument for increasing this cost effectiveness, by increasing efficiency in aircraft procurement, is the incentive type contract. The value of the incentive type contract lies in its ability to compensate for the lack of economic market conditions associated with aircraft procurement. The Navy's use of incentive contracts since 1951 and the resultant opinions and actions of the Navy, government legislative agencies, and the aircraft industry are presented. These actions and opinions are discussed and recommendations for more effective employment of contractual incentives are offered. (Author).

Book Contracting for Development

Download or read book Contracting for Development written by Ruben Berrios and published by Praeger. This book was released on 2000-02-28 with total page 192 pages. Available in PDF, EPUB and Kindle. Book excerpt: Development assistance, long seen as a giveaway to developing countries, is, according to Berríos' assessment, actually a giveaway to large for-profit U.S. contractors. Berríos shows that a small but influential number of contractors continue to be awarded most of the contracts, both in value and number, despite their average or substandard performance. Berríos documents the commercial considerations that drive U.S. development assistance. The increasing delivery of development aid in the form of contracts has led contractors to increase their weight and influence on USAID's programs. As Berríos contends, the reasons for giving aid often have little to do with helping other countries, because, instead, it ends up mainly helping U.S. firms. Little is known about contracting for development. The contracting process is often neither open nor competitive. Despite the talk of restructuring, USAID continues to award contracts that are unfavorable to the agency. Berríos documents the practices of private sector contracting, how they compete for USAID contracts, how they fit into the stated aims and needs of the agency, and what their performance evaluations say upon completion of contracts. Berríos also provides a sweeping review of U.S. development assistance policies, the trend toward privatization, the rhetoric about reinventing government, and the issue of past performance. A controversial assessment, this will be of interest to scholars, researchers, and policy makers involved with U.S. developmental strategies.
