Excerpt: ... an essay, etc. Few subjects have furnished literary men with a greater variety of fanciful theories, and speculative systems, than the origin and personal characteristics of nations: in discussing which many able writers have employed far more ingenuity than sound argument; wasting erudition in support of mere hypothesis. Yet from Pinkerton, the founder of the present system, down to Dr. Macculloch, the last writer of distinction, who has given it his support, they all appear, however differing upon collateral points, to have adopted one fixed and common principle; the fallaciousness of which it is the object of the present Essay to expose. The system, which Pinkerton and his disciples have adopted, is the following. That the Gothic and Celtic races were origi B natty and generically different: that this difference has ever been clear and distinct, in their physiognomical, physiological, and moral character; neither time nor accident having had power to change it; so that the Gothic breed or race is as distinct, and as distinguishable from the Celtic, at this day, as it was two thousand years ago. The respective characteristics of the two races they assert to be as follows. The Gothic tribes, it is said, were and still are red, or yellow-haired, blue-eyed, fair complexioned, large of limb, and tall of stature. The Celtic, on the other hand, dark-haired, dark-eyed, of swarthy complexion, and small in stature. Now the existence of these characteristics, as generic distinctions, I mean most positively to deny, whether as between the Goths and Celts of antiquity, or their descendants at the present day. And I persuade myself, that I shall be able to prove the several varieties of physiognomical and physiological character to have no...

Book English Law the Legal Profession and Colonialism

Download or read book English Law the Legal Profession and Colonialism written by Cerian Griffiths and published by Taylor & Francis. This book was released on 2023-10-18 with total page 272 pages. Available in PDF, EPUB and Kindle. Book excerpt: Modern legal history is increasingly interested in exploring the development of legal systems from novel and nuanced approaches. This edited collection harnesses the lesser-researched perspectives of the impact of global and imperial factors on the development of law. It is argued that to better understand these timely discussions, we must understand the process and significance of colonisation itself. The volume brings together experts in the field of law and history to explore the ways in which law and lawyers contributed to the expansion of the British Empire, and the ways in which the Empire influenced the Metropole. The book sheds new light on the role of the law and legal actors during the pivotal centuries that saw the establishment of the Empire. Exploring such topics as Atlantic relations, the impact of British jurists upon Indian law, and the development of the law settler colonies, this collection reveals some of the lesser-known intersections between law, history, and empire. The book will be of interest to students and researchers in legal history, comparative history, equity and trusts, contract law, the legal profession, slavery, and the British Empire.

  • Author : Robert J. C. Young

Download or read book Colonial Desire written by Robert J. C. Young and published by Routledge. This book was released on 2005-08-05 with total page 260 pages. Available in PDF, EPUB and Kindle. Book excerpt: The language of contemporary cultural theory shows remarkable similarities with the patterns of thought which characterised Victorian racial theory. Far from being marked by a separation from the racialised thinking of the past, Colonial Desire shows we are operating in complicity with historical ways of viewing 'the other', both sexually and racially. Colonial Desire is a controversial and bracing study of the history of Englishness and 'culture'. Robert Young argues that the theories advanced today about post-colonialism and ethnicity are disturbingly close to the colonial discourse of the nineteenth century. 'Englishness', Young argues, has been less fixed and stable than uncertain, fissured with difference and a desire for otherness.
