Available in PDF, EPUB and Kindle. Book excerpt: The ‘whores’ and ‘highwaymen’ of Gregory Durston’s title are just some of the dubious characters met within this absorbing work, including thief-takers, trading justices, an upstart legal profession whose lower orders developed various ways to line their own pockets and magistrates and clerks who often preferred dealing with those cases which attracted fees. The book shows how little was planned by government or the authorities, and how much sprang up due to the efforts of individuals—so that the origins of social control, particularly at a local level, had much to do with personal ideas of morality, class boundaries and perceived threats, serious and otherwise. Based on news reports, Old Bailey and local archives, and other solid records the book weaves a compelling picture of a critical time in English history, through the voices of contemporary observers as well as the best of writings by experts ever since. At its broadest point, the book spans the period from the Glorious Revolution to the early 1820s. It falls into three parts: Crime and the Metropolis—including Metropolitan crime, attitudes to crime and policing, explanations for crime, and criminal law and procedure. Policing—including policing the metropolis, constables, the watch, beadles, the role of the military, and the detection of crime. Justice—including the magistracy and its work, ways of prosecution, trial in the lower and higher courts, and the penal regimes of the day. A colourful account, which captures the essence of the period.

Book Police and Government

Download or read book Police and Government written by Geoffrey Marshall and published by Taylor & Francis. This book was released on 2023-03-31 with total page 140 pages. Available in PDF, EPUB and Kindle. Book excerpt: Despite the recent outcrop of controversy about the police and their accountability in the 1960s, there was no work dealing in detail with the problems discussed in this book. Originally published in 1965, it examines an unresolved issue, namely the position of the police in the constitutional framework and the extent to which police activities are subject to control by the electorate and their representatives in local authorities and in Parliament. The book attacks the well-known doctrine and the ‘independence’ of the police which had been widely accepted at the time. Topics dealt with include the legal status of constables and chief constables; pre- and post-war controversies about accountability for police operations; relations between local police authorities and the Home Secretary; the Royal Commission of 1962; the new Judges’ Rules for police questioning; and the Police Act, 1964. This work is an informed analysis of the problems being discussed at the time about police powers and activities. Relevant to courses in Government, Local Government and Constitutional Law, today it can be read and enjoyed in its historical context.

Book Controlling the Constable

Download or read book Controlling the Constable written by Tony Jefferson and published by Taylor & Francis. This book was released on 2023-03-31 with total page 206 pages. Available in PDF, EPUB and Kindle. Book excerpt: In the early 1980s, the question of how far the police should be accountable for their actions had become extremely vexed. The impending new Police Bill, the Scarman report and the pressure from many sides for an independent complaints machinery hinged on this issue, and a careful review of the problem was badly needed. The Cobden Trust commissioned Tony Jefferson and Roger Grimshaw to research into the matter, and Controlling the Constable, originally published in 1984, is the result of their findings. The authors examine closely the concept of constabulary independence at the time. They look at the relevant legal history and at how this independence was used by chief constables from day to day. On this basis, they then re-assess two of the most controversial policing operations of modern times – Brixton prior to the 1981 Riots and Southall on 23 April 1979, a day which resulted in hundreds of arrests and the death of Blair Peach. They conclude that the concept embodies a fundamental incoherence: the reliance on the law to guide the chief constable, and the failure of the law to do so. They show that all the current proposals for reform, which entailed greater emphasis on the democratic system as a guide, could result in similar incoherence. A new approach to the conflict between legal authority and democratic authority was urgently needed. Controlling the Constable points the way to the only satisfactory resolution – and this included a concept of justice which was coherent and which could serve as a real guide for the chief constable in using his discretion. The book was controversial, but quite clear on one point: however independent any new complaints procedure may become, and however much committees were ‘consulted’ by chief constables via ‘Scarman-type’ liaison committees, until the problem was tackled on this fundamental level, there could be no significant change in police behaviour.
