Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Modern American Law: A Systematic and Comprehensive Commentary on the Fundamental Principles of American Law and Procedure, Accompanied by Leading Illustrative Cases and Legal Forms, With a Revised Edition of Blackstone's Commentaries The attention of citizens generally is being at tracted to a reform of our penal institutions. Some progress in that direction has been made by legisla tion and some by improvements in state institutions. Thus many of our offenders are now treated as pa tients for the surgeon or physician rather than as criminals to be confined in penitentiaries. Public spirited bodies are also investigating the causes of crime and are seeking to find ways and means for its prevention. Success in reducing the number of criminal ofiend ers rests largely upon a reform in the administration of criminal law and criminal procedure as enforced in the courts today. In turn, a knowledge of the basic principles of these branches of the law is the first essential to reform. Book excerpt: Excerpt from Cases on Criminal Procedure: Selected From Decisions of English and American Courts For years past the science of law has been taught by lectures, the use of text-books and more recently by the detailed study, in the class-room, of selected cases. Each method has its advocates, but it is generally agreed that the lecture system should be discarded because in it the lecturer does the work and the student is either a willing receptacle or offers a passive resistance. It is not too much to say that the lecture system is doomed. About the Publisher Forgotten Books publishes hundreds of thousands of rare and classic books. Book Occasional Papers and Addresses of an American Lawyer Classic Reprint

Download or read book Occasional Papers and Addresses of an American Lawyer Classic Reprint written by Henry W. Taft and published by . This book was released on 2015-07-07 with total page 360 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Occasional Papers and Addresses of an American Lawyer An interruption of professional activities is generally detrimental. There are so many competent lawyers that there is little difficulty in replacing those who forsake for politics their practice at the bar; and a lawyer who yields to the allurements of public life by accepting office generally finds that the political prestige he gains is of little practical use and that on returning to the law he must make new professional connections. In England the case is quite different and leaders of the bar may continue to practice their profession while they engage in parliamentary activities. To participate in partisan politics in a great city like New York, and, at the same time, build up and keep together a law practice, is most difficult. It is surprising how few men of real talent have performed the double role of lawyer and politician. This always becomes manifest when the state or federal appointing power seeks to fill vacancies on the bench. Lawyers of eminent qualifications for such positions are numerous, but to find those who are politically anything more than ciphers is most difficult. And yet it ought to be possible to maintain a first-rate position at the bar and at the same time acquire an influence in politics of sufficient importance to enable a lawyer to contribute something to the elevation of the tone of our public life. By training, environment and aptitude, lawyers are usually well equipped to engage in political activities, and if circumstances do not permit them to hold office, at least they may and ought to devote a substantial part of their time to the discharge of the duties and responsibilities of citizenship. Conspicuous examples show that this can be done without detriment to professional success. The career of Mr. Elihu Root is a striking illustration. Book excerpt: Excerpt from Private Corporations: This Treatise on Private Corporations Is Taken From Volume VIII of a Series of Non-Technical Law Books Entitled "American Law and Procedure," Published by La Salle Extension University This view is that the corporation has a personality s'e'reul as that of the state; that in law a person is any thing that is a distinct subject of rights and liabilities. Juristic persons are no more fictitious than, say, the conception of ownership is fictitious. In the eye of the law they are in the fullest sense persons, that is, subjects of legal rights and duties, and to that extent 'real, ' as far as modern law is concerned. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Cases on Civil Procedure: Selected and Annotated The purpose of this volume is to point out through selected cases, the principal problems of civil procedure, to explain how they were approached at common law and to indicate how they are com mouly dealt with in modern courts. Such a course it is believed will not only prepare the student for the more intelligent study of the procedure of the state in which he expects to practice, but will also assist him in those branches of substantive law that are rooted in procedure. It is hoped, too, that in schools where the local practice alone is taught and in the ofiice, preceptor and student may find here material useful for comparative study. Indeed, as the practice of the law tends in this country to extend beyond state boundaries, it becomes increasingly dangerous to restrict one's information to the methods of a single locality. While one can hardly expect to become expert in the daily routine of courts other than those in which his life's work is centered, a broad comprehensive view of the more im portant points upon which a diversity of practice may be anticipated is an equipment not to be despised. Book Cases on Criminal Law Classic Reprint

Download or read book Cases on Criminal Law Classic Reprint written by Augustin Derby and published by Forgotten Books. This book was released on 2017-11-25 with total page 584 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Cases on Criminal Law The cases included in this volume have been selected mainly from American Reports dating to the year 1914, and widely chosen from many state and federal jurisdictions, without preference, a few from the English decisions recognized as leading, with the aim of being equally serviceable in Law Schools of the different states devoting from one to two hours a week to the study of Criminal Law. To show the historical development of the subject, quota tions from authoritative text writers of the past, and modern'cases reviewing the older decisions, have been used, in place of the ancient English decisions, to which the author has observed stu dents give little heed; in this way necessary economy of space has been effected. A brief chapter on the much neglected, yet highly important, subject of Constitutional Rights of the Accused has been inserted; otherwise the cases are confined to a consideration of the substantive law of Crimes, without special reference to the law of Procedure. A logical arrangement of topics has been striven for, and the cases placed, as far as possible, in a sequence which will permit the student to advance from one to another without leaving missing links of knowledge necessary to progress. Effort has been made to present cases interesting upon the facts. The footnotes have been designed to show where the law is in conflict, and also to indicate the law upon topics of which space has for bidden a fuller discussion.
