Book excerpt: Court officials must balance the interests of public safety with the needs of youth when making decisions about which program to place a juvenile offender and which level of restriction is required. Juvenile offenders who commit serious and/or violent crime may require confinement to protect public safety and intensive supervision and intervention to become rehabilitated. On the other hand, many offenders can be effectively rehabilitated through community-based supervision and intervention. Secure detention differs from secure confinement both in terms of the reasons a youth is being held and in the range and intensity of programs available to an offender in each setting. Secure detention refers to the holding of youth, upon arrest, in a juvenile detention facility (e.g., juvenile hall) for two main purposes: to ensure the youth appears for all court hearings and to protect the community from future offending. In contrast, secure confinement refers to youth who have been adjudicated delinquent and are committed to the custody of correctional facilities for periods generally ranging from a few months to several years. These confinement facilities have a much broader array of programs than detention facilities.

Book excerpt: Adolescence is a distinct, yet transient, period of development between childhood and adulthood characterized by increased experimentation and risk-taking, a tendency to discount long-term consequences, and heightened sensitivity to peers and other social influences. A key function of adolescence is developing an integrated sense of self, including individualization, separation from parents, and personal identity. Experimentation and novelty-seeking behavior, such as alcohol and drug use, unsafe sex, and reckless driving, are thought to serve a number of adaptive functions despite their risks. Research indicates that for most youth, the period of risky experimentation does not extend beyond adolescence, ceasing as identity becomes settled with maturity. Much adolescent involvement in criminal activity is part of the normal developmental process of identity formation and most adolescents will mature out of these tendencies. Evidence of significant changes in brain structure and function during adolescence strongly suggests that these cognitive tendencies characteristic of adolescents are associated with biological immaturity of the brain and with an imbalance among developing brain systems. This imbalance model implies dual systems: one involved in cognitive and behavioral control and one involved in socio-emotional processes. Accordingly adolescents lack mature capacity for self-regulations because the brain system that influences pleasure-seeking and emotional reactivity develops more rapidly than the brain system that supports self-control. This knowledge of adolescent development has underscored important differences between adults and adolescents with direct bearing on the design and operation of the justice system, raising doubts about the core assumptions driving the criminalization of juvenile justice policy in the late decades of the 20th century. It was in this context that the Office of Juvenile Justice and Delinquency Prevention (OJJDP) asked the National Research Council to convene a committee to conduct a study of juvenile justice reform. The goal of Reforming Juvenile Justice: A Developmental Approach was to review recent advances in behavioral and neuroscience research and draw out the implications of this knowledge for juvenile justice reform, to assess the new generation of reform activities occurring in the United States, and to assess the performance of OJJDP in carrying out its statutory mission as well as its potential role in supporting scientifically based reform efforts.

Book excerpt: Current trends in juvenile justice programming incorporate collaborative partnerships as a response to concern surrounding recent punitive approaches to juvenile justice that emphasize the use of secure confinement in juvenile detention facilities for youthful offenders. The Juvenile Detention Alternatives Initiative (JDAI), a project from the Annie E. Casey Foundation, is one such movement toward utilization of collaboration in response to the criticisms of the condition of America's juvenile detention halls. This research illustrates the efforts of Green County Missouri as a participating JDAI jurisdiction to build and sustain collaboration for juvenile detention reform through a process evaluation of collaboration implementation. Findings support that building from existing relationships is critical to initially building collaboratives. Similarly, emphasis on major themes of buy-in (to improve the community and garner public recognition for self-involvement in collaborative endeavors) is important to prospective partners when considering buy-in. Successfully sustaining collaboration depends heavily on leadership and the availability of benefits for collaborators. Implications from this reserarch extend to prospective JDAI sites and beyond.

Book excerpt: Over the last thirty years, the prison population in the United States has increased more than seven-fold to over two million people, including vastly disproportionate numbers of minorities and people with little education. For some racial and educational groups, incarceration has become a depressingly regular experience, and prison culture and influence pervade their communities. Almost 60 percent of black male high school drop-outs in their early thirties have spent time in prison. In Punishment and Inequality in America, sociologist Bruce Western explores the recent era of mass incarceration and the serious social and economic consequences it has wrought. Punishment and Inequality in America dispels many of the myths about the relationships among crime, imprisonment, and inequality. While many people support the increase in incarceration because of recent reductions in crime, Western shows that the decrease in crime rates in the 1990s was mostly fueled by growth in city police forces and the pacification of the drug trade. Getting "tough on crime" with longer sentences only explains about 10 percent of the fall in crime, but has come at a significant cost. Punishment and Inequality in America reveals a strong relationship between incarceration and severely dampened economic prospects for former inmates. Western finds that because of their involvement in the penal system, young black men hardly benefited from the economic boom of the 1990s. Those who spent time in prison had much lower wages and employment rates than did similar men without criminal records. The losses from mass incarceration spread to the social sphere as well, leaving one out of ten young black children with a father behind bars by the end of the 1990s, thereby helping perpetuate the damaging cycle of broken families, poverty, and crime. The recent explosion of imprisonment is exacting heavy costs on American society and exacerbating inequality. Whereas college or the military were once the formative institutions in young men's lives, prison has increasingly usurped that role in many communities. Punishment and Inequality in America profiles how the growth in incarceration came about and the toll it is taking on the social and economic fabric of many American communities.

Many serious and violent offenders at this stage may be appropriate for placement in an intensive supervision program that serves as an alternative to secure incarceration. The Intensive Supervision of Probationers Program Model is a highly structured, continuously monitored, individualized plan that consists of five phases with decreasing levels of restrictiveness: 1. Short-term placement in community confinement. 2. Day treatment. 3. Outreach and tracking. 4. Routine supervision. 5. Discharge and followup. Program models such as these have been found to be effective for many serious, violent, and chronic juvenile offenders, obviating the need for secure incarceration. OJJDP views the intensive supervision program as a positive response to the need to address the overcrowding of juvenile detention centers. The Planning Guide offers practitioners the tools they need to implement confidently an ISP as an alternative to long-term institutional confinement for designated juvenile offenders. OJJDP believes the intensive supervision program offers the juvenile justice system a needed alternative to incarceration for the right juvenile offender.
