Download or read book Unreasonable Searches and Seizures written by Otis H. Stephens Jr. and published by Bloomsbury Publishing USA. This book was released on 2005-11-23 with total page 478 pages. Available in PDF, EPUB and Kindle. Book excerpt: A timely, historical look at Fourth Amendment jurisprudence, covering more than two centuries of search-and-seizure law, from landmark judicial decisions to enduring controversies. Unreasonable Searches and Seizures: Rights and Liberties under the Law provides a comprehensive exploration of the development of the Fourth Amendment from the late 18th century to the present. The work clearly explains complex legal questions and pivotal judicial decisions, illustrating the controversial nature of Fourth Amendment issues and differentiating between reasonable and unreasonable searches and seizures. Presenting a wealth of cases and examples, the authors analyze important developments, such as the impact of the Supreme Court's decision in Weeks v. United States (prohibiting federal courts from admitting evidence obtained in violation of the Amendment), the expansion of Fourth Amendment protections in the 1960s, the apparent weakening of rights since the early 1970s, and the contraction of the exclusionary rule in response to the war on drugs and the war on terror.

Book excerpt: A July 2012 supplement of the book is available at this link (updated July 6, 2012). Due to the thousands of daily governmental intrusions -- such as airport checks, traffic stops, drug testing, obtaining of digital evidence, traditional criminal law enforcement practices and regulatory inspections -- the Fourth Amendment is the most commonly implicated and litigated part of our Constitution. This treatise comprehensively treats United States Supreme Court caselaw and takes a structural approach to the Fourth Amendment, addressing foundational questions, such as: What is a search? What is a seizure? What does the Amendment protect? Who does it protect? When is it satisfied? When does the exclusionary rule apply? The treatise is organized by topic so a reader can have ready access to current doctrine and is able to examine in additional sections how current doctrine developed. The historical events and the Court's development of search and seizure principles provide context to, and perspective on, current doctrine.

Through full-color and black-and-white photos, engaging text, and primary sources, this book examines the events leading up to the creation and ratification of the Fourth Amendment and its impact on modern American life, including how the Supreme Court must balance the rights of the individual against the needs of the government to keep the nation safe and how technological advances affect our privacy. Book More Essential than Ever

    Book Details:
  • Author : Stephen J. Schulhofer
  • Publisher : Oxford University Press
  • Release : 2012-07-09
  • ISBN : 0199752990
  • Pages : 214 pages

Download or read book More Essential than Ever written by Stephen J. Schulhofer and published by Oxford University Press. This book was released on 2012-07-09 with total page 214 pages. Available in PDF, EPUB and Kindle. Book excerpt: When the states ratified the Bill of Rights in the eighteenth century, the Fourth Amendment seemed straightforward. It requires that government respect the right of citizens to be "secure in their persons, houses, papers, and effects, against unreasonable searches and seizures." Of course, "papers and effects" are now digital and thus more vulnerable to government spying. But the biggest threat may be our own weakening resolve to preserve our privacy. In this potent new volume in Oxford's Inalienable Rights series, legal expert Stephen J. Schulhofer argues that the Fourth Amendment remains, as the title says, more essential than ever. From data-mining to airport body scans, drug testing and aggressive police patrolling on the streets, privacy is under assault as never before--and we're simply getting used to it. But the trend is threatening the pillars of democracy itself, Schulhofer maintains. "Government surveillance may not worry the average citizen who reads best-selling books, practices a widely accepted religion, and adheres to middle-of-the-road political views," he writes. But surveillance weighs on minorities, dissenters, and unorthodox thinkers, "chilling their freedom to read what they choose, to say what they think, and to associate with others who are like-minded." All of us are affected, he adds. "When unrestricted search and surveillance powers chill speech and religion, inhibit gossip and dampen creativity, they undermine politics and impoverish social life for everyone." Schulhofer offers a rich account of the history and nuances of Fourth Amendment protections, as he examines such issues as street stops, racial profiling, electronic surveillance, data aggregation, and the demands of national security. The Fourth Amendment, he reminds us, explicitly authorizes invasions of privacy--but it requires justification and accountability, requirements that reconcile public safety with liberty. Combining a detailed knowledge of specific cases with a deep grasp of Constitutional law, More Essential than Ever offers a sophisticated and thoughtful perspective on this important debate.

Book The Failed Experiment

Download or read book The Failed Experiment written by Mart Grams and published by Xlibris Corporation. This book was released on 2018-02-14 with total page 551 pages. Available in PDF, EPUB and Kindle. Book excerpt: When the American government was founded, the Founders and Framers assumed a government of the people, by the people, and for the people. That government is dying. It is under the authority of not we, the people but rather a small elite that is trying to snuff out the great experiment of man ruling himself, the common man, the man that within the right system of government can attain his purpose to achieve happiness. Were the Framers wrong? Were the ideas of Alexander Hamilton right? Is man incapable of self-rule? Does he need to be taken care of, watched, manipulated? No! It is not a failed experiment! It is time to retake that government.

Book The Fourth Amendment

Download or read book The Fourth Amendment written by Jesse V. Kessler and published by . This book was released on 2010 with total page 0 pages. Available in PDF, EPUB and Kindle. Book excerpt: The Fourth Amendment of the U.S. Constitution requires government-conducted searches and seizures to be supported by probable cause and a warrant. Federal courts have long recognised that there are many exceptions to these requirements, one of which is the border search exception. The border search exception permits government officials to conduct "routine" searches based on no suspicion of wrongdoing whatsoever. On the other hand, when warrantless border searches are particularly invasive, and thus "non-routine", they are permissible only when customs officials have, at a minimum, a "reasonable suspicion" of wrongdoing. This book examines the Fourth Amendment of the U.S. Constitution as it relates today to border security, government access to phone calling activity and related records, student strip searches, and governmental drug testing and compulsory DNA collection from people who have been convicted on criminal charges.
