The book looks both at the British context as well as experience in other developed economies and takes stock of how the policy has evolved. It examines the rationale for planning gain, how it has delivered substantial funds for infrastructure and affordable housing and, in the light of this, how it might continue to play a role in the funding of these. Book excerpt: The Committee's report considers the potential impact of recent government proposals for a major house-building programme for the South East region in response to the huge demand for affordable housing in the area, and whether sustainable communities are likely to be created as a result. Conclusions drawn include that building more homes is not a panacea in one of the most densely populated regions in Europe, and the environmental impact could be unsustainable, in terms of the loss of greenfield sites and excessive pressures on the water supply and other natural resources. It will be an expensive and complex task to build so many homes, and the Government has yet to estimate the costs of providing necessary infrastructure such as transport links, health care, education and all the other facilities which new neighbourhoods require. It must be questionable whether the benefits justify such a huge outlay. The issue of promoting local employment opportunities is important to discourage unsustainable commuting patterns, as is developing high-density neighbourhoods with mixed tenure and environmentally efficient homes.

Book excerpt: Section 6 of the Human Rights Act (HRA) makes it unlawful for public authorities to act in breach of Convention rights. UK courts have adopted a restrictive interpretation of the meaning of public authority, potentially depriving numerous, often vulnerable people, from the human rights protection afforded by the HRA. There has been little evidence of progress since the previous report on this matter (HL 39/HC 382, 7th report session 2003-4, ISBN 9780104004173). Chapter 2 examines developments in case-law since 2004 and the Committee considers the Government's 2005 guidance on contracting for services in the light of the Human Rights Act takes a very negative approach to the difficulties facing the use of contracts to secure better the protection of human rights, lacks accessibility and is difficult to understand, and has little or no influence on the procurement policies of local authorities. In Chapter 3, the Committee considers the case for further action to overcome the problems arising from a narrow interpretation of public authority. It concludes that the practical implications of the current case law are such that some service users are deprived of a right to an effective remedy for any violation of their Convention rights. The Committee has not seen any convincing evidence that providers would leave the public services market if they were subject to the duty to act compatibly with Convention rights, despite the Government's premature and unsupported concerns about market flight. In Chapter 4 the Committee considers steps which could be taken to resolve the problems identified, including use of legislation to clarify the meaning of public authority in section 6 HRA through a separate, supplementary and interpretative statute.

Book excerpt: In this report the Communities and Local Government Committee says the Government must stick to its long term house building targets, despite the credit crunch, but a greater proportion of the homes built should be social housing. The Committee is concerned that the £975 million borrowed by the Government from its 2010-11 budgets to build social rented housing now is not new money, and that the Government has been unable to say how that borrowing will be replaced. The Committee urges the Department for Communities and Local Government to: put pressure on the Treasury to ensure measures to revive the mortgage markets are implemented immediately; increase construction of new social housing, both to provide for housing need and as a means of maintaining capacity in the homebuilding industry whilst the market recovers; accelerate refurbishment programmes for social housing; acquire further social housing through the purchase of unsold stock and street properties; consider the purchase of unsold family homes which have been on the market for more than a year; encourage public sector bodies to make land available for the development of new homes. The report also urges the Government to do more to help those at risk of repossession by considering sanctions against lenders who repossess too quickly and by doing more to protect tenants and homeowners from unscrupulous landlords. An Office of Fair Trading recommendation for sale-and-rent back schemes should be implemented as a matter of urgency to protect the growing number of households falling behind in mortgage payments. The Committee would like to see more done to support housing associations, including increasing social housing grant where necessary.

Book excerpt: The Joint Committee on Human Rights examined the implementation of the UN International Covenant on Economic, Social and Cultural Rights in the UK. Domestic legislation protects many of the economic, social and cultural rights, with the Covenant itself having little impact in UK domestic law. The Committee believes that there is scope for incorporating further protection of rights in the UK, by enshrining some of the guarantees contained in the Covenant. Further, that for the Covenant rights to be effective, they should be part of a framework for government policy development, and that Government along with the Commission for Equality and Human Rights should develop ways of measuring the progress of these rights. The Committee also recommends, that explanatory notes to Bills, should include discussion of the Bills compatibility with Covenant rights, which is a way of enhancing the scrutiny of proposed Government legislation. Furthermore, the Committee recommends the introduction of an Equality Bill, to address the concerns of discrimination faced by ethnic minorities and persons with disabilities in employment, housing and education.
