Book excerpt: During the 1960s, President Lyndon Johnson and his administration substantially altered the structure of the American administrative state. Creating intergovernmental programs to forward the goal of the Great Society, they changed the contours of national-state-local relationships, and these changes largely have remained, despite the attempts of later administrations to reverse them. Intergovernmental Relations in the American Administrative State is the first comprehensive study of how and why these changes occurred. Drawn from a wealth of primary material in the Lyndon Baines Johnson Library, the study probes the objectives of the president and other framers of new policies and programs, within the institutional and political context of the time. The authors give special attention to the inherent incongruities that arise when intergovernmental programs are used to address problems defined in national terms. In addition, they reveal how certain programs actually challenged the power of established national bureaucracies. They conclude with a thoughtful overview of the Johnson legacy in intergovernmental relations during subsequent administrations.

Book excerpt: The limited scope of participation in the making of EU law remains a continued source of controversy, featuring prominently in recent institutional and political developments that have been shaping the EU's constitutional framework - most intensely in the follow up of the Commission's White Paper on Governance. Yet little attention has been paid to participation rights as a means of ensuring the procedural protection of persons affected by EU regulation in its diverse forms. This is a dimension of the rule of law that has been largely ignored by EU legislative and judicial bodies. Not only the legislator, but also the Court of Justice and the Court of First Instance tend to adhere to excessively formal conceptions of participation rights that are premised on the right to be heard in individual procedures, as well as to a restrictive view regarding the relationships between the citizens and the administration. This book shows why, in the face of new regulatory developments, these conceptions are currently inadequate to ensure the legal protection of rights and interests affected by EU regulation. Combining a conceptual analysis with thorough empirical scrutiny, this book assesses the scope of participation rights in EU law against their rationales and underlying legal values. It makes a case for the extension of participation rights to new situations and new types of procedures, in particular those that would generally fall within the category of rulemaking. It brings distinct normative insights into a crucial theme of EU administrative law, and makes a topical and timely contribution to the increasingly notable theme of public participation in EU regulation. Showing how people experience state public administration, The Bureaucrat and the Poor provides a realistic view of French welfare policies, institutions and reforms and, in doing so, dispels both of these myths. Combining Lipsky's street-level bureaucracy theory with the sociology of Bourdieu and Goffman, this research analyses face-to-face encounters and demonstrates the complex relationship between welfare agents, torn between their institutional role and their personal feelings, and welfare applicants, required to translate their personal experience into bureaucratic categories. Placing these interactions within the broader context of social structures and class, race and gender, the author unveils both the social determinations of these interpersonal relationships and their social functions. Increasing numbers of welfare applicants, coupled with mass unemployment, family transformations and the so-called 'integration problem' of migrants into French society deeply affect these encounters. Staff manage tense situations with no additional resources - some become personally involved, while others stick to their bureaucratic role; most of them alternate between involvement and detachment, assistance and domination. Welfare offices have become a place for 're-socialisation', where people can talk about their personal problems and ask for advice. On the other hand, bureaucratic encounters are increasingly violent, symbolically if not physically. More than ever, they are now a means of regulating the poor.
