Jaffary chronicles colonial and nineteenth-century beliefs and practices surrounding conception, pregnancy and its prevention, and birth. Tracking Mexico's transition from colony to nation, Jaffary demonstrates the central role of reproduction in ideas about female sexuality and virtue, the development of modern Mexico, and the growth of modern medicine in the Latin American context. The story encompasses networks of people in all parts of society, from state and medical authorities to mothers and midwives, husbands and lovers, employers and neighbors. Jaffary focuses on key topics including virginity, conception, contraception and abortion, infanticide, "monstrous" births, and obstetrical medicine. Her approach yields surprising insights into the emergence of modernity in Mexico. Over the course of the nineteenth century, for example, expectations of idealized womanhood and female sexual virtue gained rather than lost importance. In addition, rather than being obliterated by European medical practice, features of pre-Columbian obstetrical knowledge, especially of abortifacients, circulated among the Mexican public throughout the period under study. Jaffary details how, across time, localized contexts shaped the changing history of reproduction, contraception, and maternity.

Book excerpt: In From Back Alley to the Border, Alicia Gutierrez-Romine examines the history of criminal abortion in California and the role abortion providers played in exposing and exploiting the faults in California's anti-abortion statute throughout the twentieth century. Focused on the patients who used this underground network and the physicians who facilitated it, Gutierrez-Romine provides insight into the world of illegal abortion from the 1920s through the 1960s, including regular physicians as well as women and African American abortionists, and the investigations, scandals, and trials that surrounded them. During the 1930s the Pacific Coast Abortion Ring, a large, coast-wide, and comparatively safe abortion syndicate, became the target of law enforcement agencies, forcing those needing abortions across the border into Mexico and ushering in an era of Tijuana "abortion tourism" in the early 1950s. The movement south of the border ultimately compelled the California Supreme Court to rule its abortion statute "void for vagueness" in People v. Belous in 1969--four years before Roe v. Wade. Gutierrez-Romine presents the first book focused on abortion on the West Coast and the U.S.-Mexico border and provides a new approach to studying how providers of illegal abortions and their clients navigated this underground network. In the post-Dobbs moment, From Back Alley to the Border shows us how little we have learned from history.

It analyzes how various political entities shape the physical landscapes of inclusion and exclusion to reproductive healthcare access, and questions what architecture's responsibilities are in respect to this spatial conflict. Employing writing, drawing and mapping methodologies, this interdisciplinary project explores restrictions and legislatures which directly influence abortion policy in the US, Mexico and Canada. It questions how these legal rulings produce spatial complexities and why architecture isn't more culturally and spatially engaged with these spaces. In Mexico, where abortion is fully legal only in Mexico City during the first trimester, women must travel vast distances and undergo extreme conditions in order to access the procedure. Conservative state governments continue to make abortion a severely punishable crime. In Canada, there are nowhere near the cultural and religious stigmas to abortion as in the US and Mexico. Completely legal and without restrictions, Canada offers an important contrast to the ongoing abortion issues within the US and Mexico. Researching the spatial implications of such a politicized space, this book expands beyond a study of abortion clinic and includes other spaces such as women's shelters and hospitals that require multiple levels of secured spaces in order to discuss the spatial ramifications of access and security within spaces that are highly personal, private, and sometimes secret or even hidden. In questioning what architecture's responsibility is in these spatial conflicts, the book looks at how what architecture 'does' can be used to reconsider the spaces and security around such contested places, and ultimately suggests what design's potential impact might be. In doing so, it shows how architecture's role might be redefined within social and spatial practices.

To complicate matters, between 2008 and 2009, 16 state constitutions were amended to protect life from conception. While these reforms do not annul existing legal abortion indications, they have created additional obstacles for women. Health providers increasingly report women who seek life-saving care for complications such as haemorrhage to the police, and some cases eventually end up in court. The Grupo de Información en Reproducción Elegida (GIRE) has successfully litigated such cases in state courts, with positive outcomes. However, state courts have mainly focused on procedural issues. The Mexican Supreme Court ruling supporting Mexico City's law has had a positive effect, but a stronger stance is needed. This paper discusses the constitutional framework and jurisprudence regarding abortion in Mexico, and the recent Costa Rica decision of the Inter-American Court of Human Rights. We assert that Mexican states must guarantee women's access to abortion on the legal grounds established in law. We continue to support litigation at the state level to oblige courts to exonerate women prosecuted for illegal abortion. Advocacy should, of course, also address the legislative and executive branches, while working simultaneously to set legal precedents on abortion.
