Naval arms control includes: numerical or structural limitations (hulls, weapons, bases, etc.); operational constraints (exclusion zones, size and duration of exercises, distance from coasts, etc.); and confidence building measures (notification, observers, signaling intentions, etc.). One aspect of naval arms control that has met with some success has been the development of Confidence-Building Measures at Sea. The 1972 U.S.-USSR INCSEA Agreement has been successful for 18 years in ameliorating one potential area of superpower tension. Two other U.S.-USSR agreements, containing confidence-building measures, that have built upon the experience of INCSEA are the Dangerous Military Activities Agreement and the Nuclear Risk Reduction Centers Agreement. Eight bilateral INCSEA agreements have been signed between the Soviet Union and individual NATO nations. Confidence-and-Security-Building Measures (CSBMs) are the subject of the 34 nation CSCE conference in Vienna, Austria; CSCE agreement at the Stockholm conference in 1987 led to inclusion in the CSBM regime of naval exercises functionally linked to the shore. Development of enhanced Confidence-Building Measures appears to offer the best prospect for reducing residual U.S.-Soviet confrontations and tensions at sea. Such Confidence-Building Measures, in conjunction with force reductions, lessening of the Soviet threat and curtailment of operations due to fiscal pressures, might make further numerical or structural reductions and operational constraints unnecessary.

Book excerpt: This thesis traces the British role in the evolution of international law prior to 1914, utilizing naval arms control as a case study. In the thesis, I argue that the Foreign Office adopted a pragmatic approach towards international law, emphasizing what was possible within the existing system of law rather than attempting to create radically new and powerful international institutions. The thesis challenges standard perceptions of the Hague Peace Conferences of 1899 and 1907 which interpreted these gatherings as unrealistic efforts at general disarmament through world government, positing instead that legalized arms control provided a realistic means of limiting armaments. This thesis explores how a great power employed treaties to complement maritime security strategies. A powerful world government was not advocated and was unnecessary for the management of naval arms control. While law could not guarantee state compliance, the framework of the international legal system provided a buffer, increasing predictability in interstate relations. This thesis begins with an account of how international law functioned in the nineteenth century, and how states employed international law in limiting armaments. With this framework, a legal analysis is provided for exploring the negotiations at the Hague Conferences of 1899 and 1907, and in the subsequent Anglo-German naval arms race. What emerges is how international law functioned by setting expectations for future behaviour, while raising the political cost of violations. Naval arms control provided a unique opportunity for legal regulation, as the lengthy building time and easily verifiable construction enabled inspections by naval attachés, a traditional diplomatic practice. Existing practices of international law provided a workable method of managing arms competition, without the necessity for unworkable projects of world government. Thus failure to resolve the arms race before 1914 must be attributed to other causes besides the lack of legal precedents.

Book excerpt: On 27 September 1991, President Bush wrote a truly fresh page of history in arms control reductions: He announced removal of nuclear-tipped missiles and strike and depth bombs from U.S. warships. Naval arms thus removal to the center stage of the arms reduction drama. The President's unilateral initiative challenges the Soviets to reciprocate. Most of all, it marks a dramatic break from earlier, protracted, suspicious, and unyielding U.S-Soviet arms reductions negotiations, especially regarding nuclear weapons. Given this environment, this paper will analyze the new U.S. approach to naval arms control. Fist, it will offer background on the naval arm control issue and indicate its relation to U.S. national security. Then it will describe the current U.S. and Soviet naval arms reduction positions. Finally, it will present conclusions regarding future U.S. security strategies. The analysis will support the President's decision to allow this transition to new political and economic realities to impact on future U.S.-Soviet naval arms reduction negotiations and strategies. It is time to seriously consider substantial measures to de-escalate military tension. Even so, much negotiations must recognize the U.S. naval forces unique role in sustaining forward presence as called for by our national security strategy.
