This book was released on 2017-10-28 with total page 798 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on Criminal Law and Procedure The book is divided into three parts. Part one deals with certain preliminary topics pertaining to the substantive law of crimes. It consists of ten chapters, each of which contains a discussion of a preliminary topic. Part two deals with specific crimes. This part comprises, of course, a very large portion of the book. It contains sixty-three chapters. It divides crimes into seven general classes, as follows: Crimes against 1, the person; 2, the habitation; 3, property; 4, public justice; 5, public peace; 6, public welfare, health, safety, morals and religion; 7, sovereignty. It then enumerates and discusses the various specific crimes that belong to these respective classes. Part three deals with criminal pleading and procedure. It discusses arrest and extradition, preliminary proceedings, in cluding bail; modes of accusation, including indictment, ar raignment and pleas; trial, and the various proceedings after verdict. The cases supporting the text have been selected with dis criminating care, and it is believed that they are sufficiently numerous and apt to serve the purpose intended. Book A Treatise on Trial by Jury Including Questions of Law and Fact

Download or read book A Treatise on Trial by Jury Including Questions of Law and Fact written by John Proffatt and published by Forgotten Books. This book was released on 2018-02-02 with total page 618 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on Trial by Jury, Including Questions of Law and Fact: With an Introductory Chapter on the Origin and History of Jury Trial It is the first attempt of the kind, and therefore it is hoped it will be received somewhat indulgently, since there have been no models to choose from and therefore I had to form my own plans of procedure. There have been works written on the history and on some features of the jury system; but this is the first time in this country, as far as I am aware, that a treatise has been written, treating of the history as well as the practical details and proceedings of the jury. This is the more to be wondered at since in France, where the jury is comparatively a modern institution, there are no less than a dozen works on the subject devoted to the practice as well as the theory of the system. I have given considerable attention to the subject of ques tions of law and fact, and have endeavored to give some satis factory mode for distinguishing between them. It is hoped that this attempt to gather within a single vol ume the law relating to proceedings in trial by jury may be favorably regarded by the profession, whose suggestions may hereafter enable me, I trust, to make the work more accept able to their favor and patronage, and to supply defects which, in spite of all my care and exertion, I know must be found in a work upon a new subject. Book A Treatise on the Law of Evidence in Criminal Issues

Download or read book A Treatise on the Law of Evidence in Criminal Issues written by Francis Wharton and published by Forgotten Books. This book was released on 2017-11 with total page 912 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on the Law of Evidence in Criminal Issues: On One Volume IN the four years which have elapsed since the pub lication of the eighth edition of this volume, nearly one thousand cases have appeared bearing on the particular topics it discusses. Most of these cases are affirmatory of the positions taken in the text, and are noted as such but many of them present new distinctions which it has been necessary to introduce in detail. The task has been labo rions; but it has not been without interest. The vast increase of reported cases, while adding to the value of treatises in which these cases are cited and classified, is preparing the way for the adoption of a general national system of criminal law in which local peculiarities will be gradually absorbed. Of this an interesting illustration will be found in a case hereafter noticed, ' in which the Su preme Court of Massachusetts, a State remarkably reten tive of judicial traditions, has abandoned, on a question of great importance, in deference to the Opinions of other courts and of the profession at large, a position which. Book The Law of Arrest in Civil and Criminal Actions Classic Reprint

Download or read book The Law of Arrest in Civil and Criminal Actions Classic Reprint written by Harvey Cortlandt Voorhees and published by Forgotten Books. This book was released on 2017-11-15 with total page 224 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Law of Arrest in Civil and Criminal Actions IN the preparation of this treatise the writer has endeavored to produce a work so exhaustive that the profession might feel justified in pronouncing it a standard authority on the subject with which it deals. At the same time it has been the effort to produce a work of such simple style that it would be intelligible to those not versed in legal lore, and that the many officers of the law who are called upon to invade the sacred right of personal liberty might do so with a full understanding of the rights of the accused, as well as their own rights. On the points of law where the cases are not in harmony, and cannot be reconciled, as, for example, whether, at common law, a seal was essential to the validity of a warrant, a careful examination of the decisions has been made, and what has appeared to be the better reasoning and weight of authority has been presented. The citations, covering the best decisions of both English and American courts, have been selected with view of making the work exceedingly useful as a general treatise on this important subject in the different States. Book Strengthening Forensic Science in the United States

Download or read book Strengthening Forensic Science in the United States written by National Research Council and published by National Academies Press. This book was released on 2009-07-29 with total page 348 pages. Available in PDF, EPUB and Kindle. Book excerpt: Scores of talented and dedicated people serve the forensic science community, performing vitally important work. However, they are often constrained by lack of adequate resources, sound policies, and national support. It is clear that change and advancements, both systematic and scientific, are needed in a number of forensic science disciplines to ensure the reliability of work, establish enforceable standards, and promote best practices with consistent application. Strengthening Forensic Science in the United States: A Path Forward provides a detailed plan for addressing these needs and suggests the creation of a new government entity, the National Institute of Forensic Science, to establish and enforce standards within the forensic science community. The benefits of improving and regulating the forensic science disciplines are clear: assisting law enforcement officials, enhancing homeland security, and reducing the risk of wrongful conviction and exoneration. Strengthening Forensic Science in the United States gives a full account of what is needed to advance the forensic science disciplines, including upgrading of systems and organizational structures, better training, widespread adoption of uniform and enforceable best practices, and mandatory certification and accreditation programs. While this book provides an essential call-to-action for congress and policy makers, it also serves as a vital tool for law enforcement agencies, criminal prosecutors and attorneys, and forensic science educators.
