Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on Street Railway Accident Law The recent development of our American street railway system has been little short of marvelous. Today our country is covered with hundreds and thousands of miles of track, designed for the use of horse, electric, and cable cars, dummy lines, and elevated trains. Great as have been the advantages attending the extension of the system, corresponding defects have not been lacking, and the appalling number of street railway accidents, instead of growing less year by year, as the public becomes more and more familiar with the dangers attending the operation of street cars, seems, on the contrary, to be steadily increasing. It is perhaps hardly necessary to add that these accidents are a most prolific source of litigation. Believing that the tendency of the present day is towards specialization and concentration, the author, in 1902, published a book on the Street Railway Accident Law of Massachusetts. The kind reception accorded this work by the bench and bar has led to the production of the present volume, dealing with the street railway accident law of the entire country. The author has endeavored to make thoroughness and system his watchwords. Every volume of the United States and state reports has been carefully searched, and the eases thus collected have been examined and classified with the most painstaking thoroughness. Book excerpt: Excerpt from Railway Accident Law: The Liability of Railways for Injuries to the Person My object in writing this book has been that of providing in a compact form a treatise, which should be of practical use to judges and to counsel in the trial of actions against railways for injuries to the person, not only by furnishing references to the leading, and to the more recent, cases, but also by stating clearly the general principles, whose application must deter mine cases for which exact precedents are not to. I am as conscious, as any of my readers can be, of the many imperfections of my work, but I submit it to the indulgent judgment of my professional brethren in the h0pe that they will appreciate the labour and the pains that have been devoted to its preparation. Book Street Railway Accidents

Download or read book Street Railway Accidents written by John J. Moorhead and published by . This book was released on 2015-08-05 with total page 162 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Street Railway Accidents: Compiled for the Use of the Trial Department of the New York City Railway Company These monographs respecting diverse surgical ailments are the outgrowth of requests from the Trial Counsel for information on respective subjects. It was finally deemed advisable to anticipate such demands by furnishing articles on the more common injuries alleged, and these took the form of manifolded typewritten brochures. The list has now grown large enough to warrant publication in the present form, and in offering the following pages, no attempt has been made to exhaustively treat any given topic, the aim being to furnish the necessary working knowledge for Trial purposes; and to give enough technical explanation to understandingly consult recognized quoted or mentioned standard authorities. There has constantly been in mind the description of the average and usual, rather than the exceptional or unusual case, and careful mention has been made of the elements liable to modify the causation or outcome of a given injury. The diagrams used were obtained through the courtesy of the medical publishers, W.B. Saunders Company, of Philadelphia. Book excerpt: Excerpt from A Treatise on the Law of Street Railways: Embracing Urban, Suburban and Interurban, Surface, Sub-Surface and Elevated Roads, Whether Operated by Animal Power, Electricity, Cable or Steam Motor We have undertaken to cite every important reported case decided by the courts of the United States and Canada, except negligence cases which were merely cumulative. The controlling facts of all cases which interpret recent statutes or establish or apply new rules of law have been stated in the notes, while lead ing cases have been made the basis of additions to the text. Many changes have been made in the text especially in Chapters I and VI, and the development of the law treated in each of the original fifteen chapters is fully shown and brought down to date by the numerous decisions cited, from many of which we have quoted. Chapter XVI on Interurban Railways, is a new contribution to legal literature, being the first attempt to treat this new and important subject fully and systematically. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Railway and Other Accidents: With Relation to Injury and Disease of the Nervous System, a Book for Court Use, With Fifteen Plates, Two Superimposed Charts and Thirty-Six Illustrations It would be a difficult matter to estimate the amount of damages paid annually throughout the world by rail roads to claimants who present themselves with real or assumed injuries. Sums of thirty to forty thousand dol lars have been many times awarded by sympathetic juries, and one serious accident will often wreck a corporation. The trolley or street lines fare worse than the steam roads, for the reason that on the former it is impossible to safe guard passengers who often persist in getting off the car before it stops or in the wrong way, and because, to a cer tain degree, it is obliged to pick up or set down passen gers at places, most convenient for the latter. A steam road, on the contrary, stops only at fixed stations, its cars are enclosed, its lines are fenced off, and it has the right of way. Book excerpt: Excerpt from A Treatise on American Railroad Law Torts, which is less considered in textbooks than almost any other. The author has amplified the statements of ele mentary principles in some chapters, more than a professional reader might desire, in order to render the volume of more service to persons outside of the profession, whose occupations or interests are con cerned in the affairs of railroad companies, and who may be disposed for that reason to consult a treatise on the subject. The same consideration has induced the liberal extracts from judicial opinions, which have been inserted in the notes.
