Book excerpt: Excerpt from A Treatise on the Federal Income Tax Under the Act of 1894 The object of this work is to furnish a practical treatise for the benefit of lawyers, government officials, and laymen, on the interpretation of the new law im posing an income tax. The authors have scrupulously abstained from expressing any opinion upon the econ omical merits or the constitutionality of the act. The book, however, contains a chapter in which is a summary of the arguments which may be used on either side of the principal constitutional objections that may be raised to the whole act or any particular provisions of the same. This was prepared by Mr. Foster, and the greater part of it is extracted from an unpublished work by him on Constitutional Law. Mr. Foster has also prepared the chapter on Remedies of the Taxpayer. Nearly all the rest of the book was first drafted by Mr. Abbot; but each of the authors has care fully edited the work of the other and is responsible for any statement in the book, except that for the state ments in Chapter II. Mr. Foster, and for those in Chapter III. Mr. Abbot, is solely responsible. They desire to acknowledge their obligations to the Notes on the Revised Statutes by Messrs. Gould and Tucker, and also to the work of Dowell upon the English Income Tax; both of which have been of great assist ance to them. This book was released on 2017-10-30 with total page 1184 pages. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from A Treatise on the Power of Taxation, State and Federal, in the United States It was said, in prefacing the First Edition of this book in 1902, that questions of taxation were then engaging more than ever before the attention of the legislatures and courts, as well as economists. It can be said without fear of contradiction that this is true of the present time to a far greater degree. The necessity of meeting new demands for human betterment in the develop ment of our civilization has caused throughout the states of the Union a pressing demand for new methods in taxation to secure needed revenue; and the pressure of national emergencies in war as well as in peace, has called for the exercise of all the Federal powers of taxation. Book excerpt: Excerpt from A Treatise on the Federal Corporation Tax Law of 1909: Together With Appendices Containing the Act of Congress and Treasury Regulations With Annotations and Explanations and Forms of Returns The publication of a commentary upon the new federal tax on corporations, companies and associa tions needs no apology. Upon a matter of such importance as this new tax law, corporations should certainly know their rights, - even those which they may not, knowing, dare maintain. All business corporations throughout the country will be called upon within the next few weeks to make returns under this statute; and in order to do so intelligently and Without risk to themselves, they and their counsel must ascertain their rights and liabilities much more thoroughly than can be done by a mere perusal of the Act of Congress. In order, however, to be of assistance at this juncture, it is necessary that a treatise should be published speedily. Time is of the essence. The indulgence of the reader is, therefore, asked for any defects in this book Which but for the necessity of despatch in its preparation and publication the author might have been able to remedy. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from The Impact of Federal Taxes Common prudence might dictate the postponement Of any book Of this sort until the war is over, and we can view in retrospect the wisdom Of the changes in the federal tax system enacted to meet the needs Of this greatest emergency. A scholar could delay his judgments, but in this case a legis lator and a businessman cannot. Taxes must be collected and paid day after day. A decision in Congress even to main ta1n the status quo will have great repercussions. A'determi nation to lower an exemption here; to increase a rate there; to add this new Victory tax or that spendings tax to the sys tem affects vitally the family and business lives Of millions Of people. Expediency and gross revenues produced are poor guides to fairness in taxation, even in wartime. The government owes it to itself to encourage citizens to produce to maxi mum capacity.'a badly designed tax system, however much it may yield, can be a serious brake on incentive. Ours, with the best intentions, IS beginning to function as a brake today. Hence, it is certainly worth while to consider, as best we can, how a fairer and more adequate tax system may be con structed which will be as little harmful as possible to the economy we fight to preserve. This is intended merely to serve the purpose of a practical guide to those who, either for themselves or others, are called upon to prepare returns. Statements contained herein are predicated: first, upon the Income Tax Law enacted September 8, 1916, which was retroactive and took effect as of January 1, 1916; second, upon rulings by the Treasury Department thereon; and third, upon such rulings and court decisions under the Excise Tax of 1909 and the Income Tax Law of 1913, which are consistent and not in conflict with the requirements of the present law. An expression of gratitude is due to various officials and officers of Internal Revenue of the Treasury Department at Washington and New York for the courtesies shown to the writer in matters submitted to them, but this acknowledgment should not' be construed as an endorsement by them of the contents of this book. The writer also acknowledges the help fulness of the Income Tax Service of the Corporation Trust Company, the index to which was especially useful as a ready reference to Treasury Decisions. Mention should also be made of Mr. Henry Campbell Black's treatise on the law of Income Taxation under Federal and State laws, to which the writer has referred. Available in PDF, EPUB and Kindle. Book excerpt: Excerpt from Essays in Federal Taxation The investigation of the Federal tax system now being undertaken by the Ways and Means Committee assumes that there is, or may be, something seriously wrong with the Federal tax system. This as sumption would command general agreement, and I would not quar rel with it. The committee has drawn up a long list of aspects of Federal taxation about which it is commonly claimed that something is wrong. These aspects of the tax system will be discussed by experts. The function of the contributors to the introductory section of this study is, as I see it, to suggest what might be wrong with the Federal tax system. What are the standards by which each of the numerous aspects of the tax system should be judged? What do we expect from the tax system that it may not be providing for us? Book excerpt: Excerpt from A Treatise on the Law of Taxation, Including the Law of Local Assessments The decisions in this country on the subject of taxation have become so numerous, that it would be impossible to give abstracts of them all, Within any reasonable compass. The author has thought it preferable, instead of attempt ing a digest of them, to group the references about the con trolling principles. The tax systems of the several states are so dissimilar, that a mere digest of the cases is exceedingly liable to mislead, by giving, as a general rule of law, what is only a conclusion from a local law or custom. There are, or should be, general principles underlying all the cases; and an understanding of these will enable one to make use of decisions under the various tax systems without confusion.
